JUSTIFICATION AND APPROVAL

FOR OTHER THAN FULL AND OPEN COMPETITION

FOR:

Best Access brand lock cylinders and cores Buildings 785 and Buildings 652/654 Renovation Projects

West Point, NY

1. CONTRACTING ACTIVITY:

The U.S. Army Corps of Engineers (USACE), New York District (NAN), Contracting (CT), 26 Federal Plaza, New York, NY 10278.

2. DESCRIPTION OF ACTION:

This Justification and Approval (J&A) supports the use of brand name components in an upcoming construction project. The government will not purchase the components directly, but rather will require that offerors include the Best Access brand lock cylinders and cores as part of proposals submitted in response to a design-bid-build (785) and design – build (652/654) solicitation that will lead to the award of a new firm-fixed-price (FFP) construction contract. USACE is responsible for the acquisition and administration of a construction contract. Funding for this acquisition will be Sustainment, Renovation & Modernization (SRM).

3. DESCRIPTION OF SUPPLIES/SERVICES:

The requirement is to provide Best Access brand lock cylinders and cores for interior and exterior doors. These cylinders and cores will be installed in all doors that are neither electronic nor capable of status monitoring via electronic security system. These lock cylinders and cores will be compatible with the Best Access brand interchangeable core and master keying system which provides United States Military Academy Command with a single master key access system for operational and maintenance requirements using the same master key compatible with Command Access throughout all United States Military Academy facilities.

The estimated cost of the requested brand-name requirement for the Best Access brand lock cylinders and cores for both projects is $20,000 ($14,000 785 and $6,000 652/654). The average period of performance for both projects is 500 calendar days.

4. AUTHORITY CITED:

10 U.S.C. § 2304(c)(1), Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements, as implemented by FAR 6.302-1(c), Application for Brand Name Descriptions. In accordance with FAR 6.302-1(c), the Contracting Officer will specify that all offerors be required to procure an item particular to one supplier (brand-name item).

5. REASON FOR AUTHORITY CITED:

A. Background:

To maintain compatibility with the interchangeable core and master keying system at the United States Military Academy, Best Access is the United States Military Academy brand-name standard for lock cylinders and cores. This applies to lock cylinders and cores that are neither electronic nor capable of monitoring via electronic security system. The Best Access brand interchangeable core and master keying system is particular to the Best Access brand, and the system is already widely used at the United States Military Academy to provide United States Military Academy Command with a single master key to access to all facilities.

B. Justification:

United States Military Academy, West Point Command and other authorized personnel require access to buildings with a single master key. This existing master key is only compatible with the Best Access interchangeable core system. Cylinders and cores need to be Best Access brand-name to ensure compatibility and interoperability with all existing master keys at United States Military Academy facilities. Additionally, this will maintain the efficiency of maintenance and other operational personnel and eliminate confusion regarding the authority to access any particular area. The Best Access interchangeable core system is the best choice for efficiency and access for United States Military Academy personnel and facility managers across the campus. Additionally, as explained in section C – alternatives to meet the specific United States Military Academy mission has been assessed in the past and implemented only to be replaced at a premium to the end user.

C. Alternatives:

There are no viable alternatives that meet the mission requirements. Any number of manufacturers would be able to provide cylinders and cores to prevent entry to those without keyed access. However, no other brand-name is able to provide cylinders and cores compatible with the existing United States Military Academy Command single master key and interchangeable core system.

The only alternative action to ensure compatibility of a different manufacturer’s hardware locksets with the locksets and master keys used throughout United States Military Academy, West Point facilities would be to remove and replace the hardware locksets in every facility at United States Military Academy with locksets from a single manufacturer. This would be a very cost prohibitive effort.

D. Impact:

If the J&A is not approved and a different lock cylinder and core brand-name is selected instead of Best Access, mission requirements would not be met because a separate master key would be required. This would undermine the operational efficiency of the existing United States Military Academy Command master key and interchangeable core system. In addition to failing to meet the mission requirement, this alternate scenario would create confusion for master key holders and disrupt the efficient operation and maintenance of facilities at United States Military Academy. Additionally, as explained in previous sections; the need to be mission ready is paramount for the facilities engineers and grounds keepers who maintain and operate the facilities at West Point. If this J&A is not approved and a different lock cylinder and core brand-name is to be introduced, the overall efficiency of the personnel who maintain the site may be impacted since a separate master key will need to be casted which can cause confusion in a time of need.

6. EFFORTS TO OBTAIN COMPETITION:

The brand name product has been published as required by FAR 5.201; a Notice of Intent (NOI) to determine sources for this system was synopsized on 23 May 2022. The brand name justification and approval will be posted with the solicitation. No responses were received for the Notice of Intent. As stated in paragraph 5 above, Best Access is the only brand available to ensure compatibility with the West Point existing interchangeable core and master keying system. Best Access interchangeable cylinders and cores are available on the open market for purchase and installation by all offerors.

7. ACTIONS TO INCREASE COMPETITION:

This J&A supports a discrete requirement that will end when the project is complete. Therefore, there are no planned actions to increase competition for the requirement covered by this J&A.

8. MARKET RESEARCH:

A Notice of Intent (NOI) to determine sources for this system was synopsized on 23 May 2022.

The NOI was published for the required 15 days in SAM. There were no responses to the NOI.

Additional research was not done besides the NOI.

9. INTERESTED SOURCES:

There were no responses to the NOI posting. The solicitation will be synopsized in accordance with FAR 5.201 and responses will be evaluated per FAR Part 14.
