About this file
This is a Living Wage Program Submittal for the City of Austin, Texas, applicable to Invitation for Bid (IFB) 7800 MAS1007REBIDA for OEM Parts and Repairs for Chevrolet Light and Medium Duty Vehicles. The document establishes wage compliance requirements that contractors and all tiers of subcontractors must meet when directly assigned to the City contract. All contractor employees and subcontractor personnel assigned to the contract must be compensated at a minimum rate of $22.15 per hour, unless Published Wage Rates are specified elsewhere in the solicitation. Contractors are required to submit a certification with their bid listing all employees directly assigned to the contract, including their names and job titles, and to provide individual Employee Certifications for each employee within 30 days of contract execution. The City reserves the right to request individual Employee Certifications at any time during the contract term and requires annual recertification on the anniversary date of contract execution.
Contractors must maintain employment and wage records for all employees as required by the Fair Labor Standards Act and must update employee lists as changes occur. The City Contract Manager will periodically review submitted employee data and has the authority to audit employee records to verify living wage compliance. Violations of the living wage provision, including failure to pay the minimum rate or retaliation against employees, may result in daily deficiency payments to affected employees, contract termination for cause, suspension or debarment of the contractor, or legal action. Fraudulent statements on the certification may also result in these penalties. Contractors certify that all listed employees of both the prime contractor and all subcontractor tiers are paid a minimum living wage of $22.15 per hour, with the certification requiring signature by an authorized officer or representative.
