Equal Benefits Compliance Ordinance Summary
This is an ordinance document from San Mateo County, California, establishing equal benefits compliance requirements for county contractors. The ordinance applies to all contracts exceeding $5,000 for public works, consulting, or other services, and for purchases of supplies, materials, or equipment. The core requirement mandates that contractors cannot discriminate in providing employee benefits between employees with domestic partners and employees with spouses. The ordinance defines domestic partners as individuals registered with the California Secretary of State or equivalent state registry. Contractors must provide equal benefits or, when actual costs differ, allow employees to pay excess costs. If a contractor cannot extend a particular benefit to domestic partners despite reasonable efforts, the contractor must provide a cash payment equal to the cost of the benefit for a spouse. The ordinance became effective July 1, 2001, and applies to any contract awarded or amended on or after that date, with special provisions for contractors with existing collective bargaining agreements.
The San Mateo County Executive's office holds enforcement authority and may impose sanctions for violations, including contractor disqualification from county bidding for up to five years, contract termination, and liquidated damages of $2,500 per violation. The ordinance applies only to contractor operations within San Mateo County, on county-owned property outside the county, and at locations elsewhere in the United States where work related to county contracts is performed. Notably, the requirements do not extend to subcontractors. The Board of Supervisors may waive ordinance requirements when deemed in the county's best interests, and the County Executive may grant waivers for emergency contracts, sole-source procurements, situations where no compliant contractors are available, grants with conflicting requirements, or cooperative purchasing agreements.

2. The Contractor shall not be deemed to discriminate in the provision of Employee Benefits if, despite taking reasonable measures to do so, the Contractor is unable to extend a particular employee benefit to domestic partners, so long as the Contractor provides the employee with a cash payment equal to the Contractor's cost of providing the benefit to an employee's spouse.
(b) The Board of Supervisors may waive the requirements of this Chapter when it determines that it is in the best interests of the County.
