Justification for Other Than Full and Open Competition Under 10 U.S.C. 2304 (c)(1)

Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements Modification to Existing Contract

HSCG85-15-C-P45450

HSCG85-15-C-P45450 Work Item 52

Pursuant to the requirements of the Competition in Contracting Act (CICA) as Implemented by FAR subpart 6.3 and in accordance with the requirements of FAR 6.303-1, the justification for the use of the statutory authority under FAR subpart 6.3 is justified by the following facts and rationale required under FAR 6.303-2 as follows:

(1) Agency and Contracting Activity.

The Department of Homeland Security (DHS), United States Coast Guard (USCG), Surface Forces Logistics Center (SFLC), Long Range Enforcement Product Line (LRE PL) proposes to enter into a modification on a basis other than full and open competition.

(2) Nature and/or description of the action being approved.

The USCG has a requirement for additional work to be provided for the FY 15 USCGC POLAR STAR Dry Dock and Ship Repair under Contract HSCG85-15-C-P45450. This additional work was not competed as part of the original Request for Proposal (RFP) because the need was identified as a result of a casualty that happened during the Operation Deep Freeze Patrol that concluded on 09 March 2015. The casualty caused extensive damage to the Emergency Diesel Generator (EDG) system. Initially, it was thought that the repair work was minimal and could be completed by USCG personnel.

After the root cause was identified, it was determined that the necessary repair work was beyond the capabilities of USCG personnel and a contracted overhaul is needed. The additional work item is mission critical and has potential loss of mission for the upcoming training availability and follow on Operation Deep Freeze Patrol. The Emergency Diesel Generator (EDG) system impacts nearly all shipboard systems and the extensive repairs to the USCGC POLAR STAR’s EDG are estimated to require a 45 day period of performance that cannot be done at any other point in the ship's upcoming schedule due to the tight window for maintenance without impact to mission. USCGC POLAR STAR cannot deploy without completing these critical repairs. The total estimated cost of work associated with this justification is . This justification is required to allow negotiations with the currently awarded prime contractor, Mare Island Dry Dock LLC.

(3) Description of Supplies/Services.

The USCG intends to issue a modification to Mare Island Dry Dock LLC’s contract HSCG85-15-C-P45450 to accomplish the Work Item during the currently awarded 90 day USCGC Polar Star Dry Dock availability in fiscal year 2015.

(4) Identification of Statutory Authority Permitting Other Than Full and Open Competition:

The statutory authority permitting other than full and open competition is 10 U.S.C. 2304 (c)(1) as implemented by FAR Subpart 6.302-1.

(5) Demonstration that the nature of the acquisition requires use of the authority cited.

Due to the agency’s mission requirements for the POLAR STAR, the work needs to be completed prior to the next mission. With the limited maintenance window, the source for this justification is the only known source with the ability to complete this work in the limited time frame available without unacceptable delay to the next mission. The repair effort is expected to take approximately 45 days. The maximum amount of continuous time the POLAR STAR will have back at home port is month prior to training and readiness for the next Operation Deep Freeze. Due to the complex nature of work and the inter-relationships between the current work items and WI 52, any other source would be unable to complete this work in a timely manner without interfering with the current scope of work. Competition would cause unacceptable delays in fulfilling the Coast Guard’s mission and result in substantial duplication of costs that cannot be recovered through competition.

WI 52 - Emergency Diesel Generator (EDG) Overhaul and Radiator Repair

This work item is to correct discrepancies found in the Lube Oil (L/O) and Jacket Water (J/W) systems, where there are several leaks between the L/O and J/W systems causing internal damage to the EDG. Although it is capable of being done either dockside or in dry dock, the current dry dock availability is the only continuous time period that will be long enough for the work to be completed before the ship is needed for operations again.

Additionally the urgency of these repairs is driven by the need to have a functioning emergency generator in case of a system casualty while the ship is under way. Should a casualty happen affecting the primary electrical system onboard, the emergency diesel generator is used to provide power to critical systems preventing further casualties.

(9) Any Other Facts Supporting the Use of Other Than Full and Open Competition.

The currently awarded prime contractor has the capability and capacity to oversee these repairs and the use of the prime reduces the government's technical, schedule and cost risk due to the complex interactions of these systems. Completing the work at another location and time would cause substantial delays and almost certainty of mission delay/disruption. Due to interactions with other work items, if this item was not coordinated by the prime and completed during this dry dock availability there would be unacceptable delays in fulfilling the mission, or possibly not fulfilling the mission.

(10) A listing of sources, if any, that expressed, in writing, an interest in the acquisition.

A synopsis is not required under FAR subpart 5.2 because WI-52 has been determined to be in scope of the original synopsis for solicitation HSCG85-15-R-P45450.Multiple proposals were received on the solicitation to the base contract, HSCG85-15-C-P45450, USCGC POLAR STAR Dry Dock Availability FY15. The Contracting Officer has not received any interest in writing for WI-52.

(11) A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for supplies or services.

The subsequent dry dock on the USCGC POLAR STAR, tentatively in 2016, is anticipated to be awarded competitively.

(12) Technical/Requirements Personnel Certification.

I certify this requirement meets the Government’s minimum need and that the supporting data, which forms a basis for this justification, is complete and accurate.

Availability Project Manager

(13) Legal Review and Concurrence.

I have reviewed this justification and deem it legally sufficient.
