Justification for Other Than Full and Open Competition Under 10 U.S.C. 2304 (c)(1)
Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements Modification to Existing Contract
HSCG85-15-C-P45450
HSCG85-15-C-P45450 WI-14
Pursuant to the requirements of the Competition in Contracting Act (CICA) as Implemented by FAR subpart 6.3 and in accordance with the requirements of FAR 6.303-1, the justification for the use of the statutory authority under FAR subpart 6.3 is justified by the following facts and rationale required under FAR 6.303-2 as follows:
(1) Agency and Contracting Activity.
The Department of Homeland Security (DHS), United States Coast Guard (USCG), Surface Forces Logistics Center (SFLC), Long Range Enforcement Product Line (LRE PL) proposes to enter into a modification on a basis other than full and open competition.
(2) Nature and/or description of the action being approved.
The USCG has a requirement for additional underbody hull preservation work to be provided for the USCGC POLAR STAR Dry Dock Availability FY15 under Contract HSCG85-15-C-P45450. This additional work was not competed as part of the original Request for Proposal (RFP) because the need was not apparent until the ship was dry-docked as part of the above contract. The only way to identify the need for this type of work is to view a section of the hull while in dry-dock that would normally not be visible and submerged. The need for additional hull preservation work was identified as part of the Hull Plating Underwater Body Inspection and will require additional preservation due to paint failure on sections of the hull that are not covered under the current specification Work Item (WI) 14, Underwater Body Preservation. The additional work can only be completed while the ship is in a dry-dock availability. The total estimated cost of additional work associated with this justification is . This justification is required to allow negotiations with the currently awarded prime contractor, Mare Island Dry Dock LLC.

Additionally there is an increase to the amount of material needed that was provided as part of a name brand specific requirement as part of the base contract. The justification for the paint was posted on Federal Business Opportunities as part of the base solicitation. The authorized paint for use on Polar Class Vessels is Inerta 160 and will increase by approximately .

(3) Description of Supplies/Services.
The USCG intends to issue a modification to Mare Island Dry Dock LLC’s contract HSCG85-15-C-P45450 to accomplish this additional work during the currently awarded 90 day USCGC Polar Star Dry Dock availability in fiscal year 2015.
Upon underbody hull inspection, it was determined that there was significant patches of hull that have paint failure, which means that the protective anti-abrasive coating (Inerta
160) has come off. Because of the failures the steel hull is exposed to the salt water and abrasion of the ice. Without re-coating this surface, the structural steel on the hull will start rusting and will become rougher which will cause point loading from ice while icebreaking increasing the risk of damage to the hull. The patching of the coating is only possible when the hull is dry and out of the water in dry-dock and therefore can only be done now.
Due to paint failure on the hull from previous partial preservation efforts and significant risk to growth as a result of unknown condition of existing paint coatings, 100% hull preservation is required rather than the partial preservation currently required in WI-14 or partial preservation with patching.
(4) Identification of Statutory Authority Permitting Other Than Full and Open Competition:
The statutory authority permitting other than full and open competition is 10 U.S.C. 2304 (c)(1) as implemented by FAR Subpart 6.302-1.
(5) Demonstration that the nature of the acquisition requires use of the authority cited.
The current prime contractor, Mare Island Dry Dock LLC, is the sole contractor capable of performing the service required without substantial duplication of costs to the Government and without unacceptable delays to mission. Not completing the hull preservation while in the current dry dock would cause unacceptable delays in fulfilling the agency’s requirements, as the preservation, needs to be completed prior to the next mission.
Any other source would not have ease of access to the ship, nor the ability to integrate the additional work with the existing package without inducing risk to other critical path work items involving the propulsion hubs replacement.

HSCG85-15-C-P45450 WI-14
prime contractor is the only one capable of completing this work without significant delays and re-work resulting in duplication of costs.
(9) Any Other Facts Supporting the Use of Other Than Full and Open Competition.
The currently awarded prime contractor is capable of completing the work using the sub-contractor that is currently performing the partial preservation. Completing the work at another location and time would cause substantial delays and almost certainty of mission delay/disruption.
(10) A listing of sources, if any, that expressed, in writing, an interest in the acquisition.
A synopsis is not required under FAR subpart 5.2 because WI-14 has been determined to be within the scope of the original synopsis for solicitation HSCG85-15-R-P45450.
Multiple proposals were received on the solicitation to the base contract, HSCG85-15-C- P45450, USCGC POLAR STAR Dry Dock Availability FY15. The Contracting Officer has not received any interest in writing for additional work under WI-14, other than the Condition Found Report submitted by the prime contractor.
(11) A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for supplies or services.
The subsequent dry dock on the USCGC POLAR STAR, tentatively in 2016, is anticipated to be awarded competitively.
