Justification for Other Than Full and Open Competition Under 10 U.S.C. 2304 (c)(1)
Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements Modification to Existing Contract
HSCG85-15-C-P45450
HSCG85-15-C-P45450 Work Item 54
Pursuant to the requirements of the Competition in Contracting Act (CICA) as Implemented by FAR subpart 6.3 and in accordance with the requirements of FAR 6.303-1, the justification for the use of the statutory authority under FAR subpart 6.3 is justified by the following facts and rationale required under FAR 6.303-2 as follows:
(1) Agency and Contracting Activity.
The Department of Homeland Security (DHS), United States Coast Guard (USCG), Surface Forces Logistics Center (SFLC), Long Range Enforcement Product Line (LRE PL) proposes to enter into a modification on a basis other than full and open competition.
(2) Nature and/or description of the action being approved.
The USCG has a requirement for additional work to be provided for the FY 15 USCGC POLAR STAR Dry Dock and Ship Repair under Contract HSCG85-15-C-P45450. This additional work was not competed as part of the original Request for Proposal (RFP) because the need was identified as a result of a casualty that happened during the current Dry Dock period. The casualty caused extensive damage to the sewage transfer system.
The additional work item is mission critical and has potential loss of mission for the upcoming training availability and follow on Operation Deep Freeze Patrol. The sewage system is a mission critical system which without repair would likely cause further contamination of living spaces and create an inhospitable environment for the crew. The repairs are estimated to require a 20 day period of performance that cannot be done at any other point in the ship's upcoming schedule due to the tight window for maintenance without impact to mission. USCGC POLAR STAR cannot deploy without completing these critical repairs. The total estimated cost of work associated with this justification is
. This justification is required to allow negotiations with the currently awarded prime contractor, Mare Island Dry Dock LLC.

(3) Description of Supplies/Services.
The USCG intends to issue a modification to Mare Island Dry Dock LLC’s contract HSCG85-15-C-P45450 to accomplish the Work Item during the currently awarded 90 day USCGC Polar Star Dry Dock availability in fiscal year 2015.

(4) Identification of Statutory Authority Permitting Other Than Full and Open Competition:
The statutory authority permitting other than full and open competition is 10 U.S.C. 2304 (c)(1) as implemented by FAR Subpart 6.302-1.
(5) Demonstration that the nature of the acquisition requires use of the authority cited.
Due to the agency’s mission requirements for the POLAR STAR, the work needs to be completed prior to the next mission. With the limited maintenance time available, the source for this justification is the only known source with the ability to complete this work in the limited time frame available without unacceptable delay to the next mission.
The repair effort is expected to take approximately 20 days. Due to the extension in Dry-dock, there is not a continuous uninterrupted 20 day period available after this work period and before the departure for Operation Deep Freeze. Due to the limited time left in dry dock and the program management required to de-conflict with other work items, any other source would be unable to complete this work in a timely manner without interfering with the critical path. Competition would cause unacceptable delays in fulfilling the Coast Guard’s mission.
(6) Description of efforts made to ensure that offers are solicited from as many potential sources as is practicable.
Attempting to receive multiple offers would involve the risk of unacceptable delays to the USCGC Polar Star’s mission due to schedule impacts from the other Work Items in the Dry Dock.
(7) Determination by the Contracting Officer that the anticipated cost to the government will be fair and reasonable.
The anticipated cost is determined to be fair and reasonable based on historical pricing with both the prime contractor and sub-contractors. The Contracting Officer will make a determination that the anticipated price(s) will be fair and reasonable using pricing analysis techniques in FAR 15.404-1(b) (2).
