HSCG85-15-C-P45450
HSCG85-15-C-P45450 Work Item 53
(4) Identification of Statutory Authority Permitting Other Than Full and Open Competition:
The statutory authority permitting other than full and open competition is 10 U.S.C. 2304 (c)(1) as implemented by FAR Subpart 6.302-1.
(5) Demonstration that the nature of the acquisition requires use of the authority cited.
The need to repair the hole in the hull is critical due to the nature of the work as it can only be completed while the ship is in dry dock. Because the ship is currently in dry dock, refloating the cutter without completing the repair and taking it to another repair facility would incur additional risk as well as a substantial cost duplication.
Additionally, completing these repairs is crucial to the completion of the hull preservation work item that is already being accomplished as part of this availability. Due to interactions with other work items, if this item was not coordinated by the prime and completed during this dry dock availability, the ship would not be able to refloat.
(6) Description of efforts made to ensure that offers are solicited from as many potential sources as is practicable.
Attempting to receive multiple offers would involve the risk of unacceptable delays to the USCGC Polar Star’s mission due to the amount of integration involved with other Work Items in the Dry Dock.
(7) Determination by the Contracting Officer that the anticipated cost to the government will be fair and reasonable.
The anticipated cost is determined to be fair and reasonable based on historical pricing.
The Contracting Officer will make a determination that the anticipated price(s) will be fair and reasonable using pricing analysis techniques in FAR 15.404-1(b) (2).
(8) Description of market research.
Market research indicates that there are multiple contractors who can accomplish this work however, based on experience, the Contracting Officer has determined that the prime contractor is the only contractor who will be capable of performing/overseeing the service required without risk to breach of operational mission due to the urgency and inherent cost and time savings by doing this work in conjunction with already awarded work items.
