TYPE I FAMILY OF ALL TERRAIN CRANE

GOVERNMENT RESPONSE TO DRAFT RFP AND ONE‐ON‐ONE QUESTION & ANSWER SESSIONS

SOLICITATION W56HZV‐19‐R‐0118

1) Will the Government consider, at a minimum, a 120 to 180 day response time for industry to respond/comprehend a final Request for Proposal (RFP) submission?

GOVERNMENT RESPONSE: Due to the streamlined nature of this procurement, additional time will not be allotted for industry to respond/comprehend a final Request For Proposal (RFP) submission.

2) Will the requirements detailed in attachments A001‐A096 Standard Form 1423‐1 Contract Data Requirements List (CDRL) be included in a conformed Request for Proposal (RFP) Statement of Work (SOW)?

GOVERNMENT RESPONSE: The requirements for all CDRLs will be identified within the individual 1423‐1 Standard Forms as well as within the SOW. In addition, a Contract Line Item Number (CLIN) for each CDRL will be identified in Section B of the RFP.

3) The lack of draft CLINs present concerns regarding how the government plans on analyzing proposed pricing, especially as it relates to benchmarking.

GOVERNMENT RESPONSE: All CLINs will be identified in Section B of the RFP. In addition, a Pricing Spreadsheet (Excel) will be provided with the RFP as described in Section L. The spreadsheet will contain proposal instructions for offerors.

4) There are considerable concerns related to government benchmarking of this militarized Commercial‐Off‐The‐

Shelf (COTS) product to the commercial market.

a. Due to the extent of military content in both the product design, technical training/manuals, etc., how does the Government plan to benchmark?

GOVERNMENT RESPONSE: See Attachment 0004, which includes MIL‐PRF‐32216A requirement. MIL‐ PRF‐32216A sections 3.2 (Supplemental Data) and 3.1.4 (Content Requirements) specifies Government's guidance for COTS content and supplementation requirements. Industry should reference those so it can determine what level/degree of supplementation its manuals may require to meet Army requirements.

b. Missing draft CLINs related to potential project cost breakdown analysis presents a gap in our ability to understand how ongoing benchmarking could be determined by the government if the militarized costs are to be included in the potential COTS design.

GOVERNMENT RESPONSE: All CLINs will be identified in Section B of the RFP. In addition, a Pricing Spreadsheet (Excel) will be provided with the RFP as described in Section L. The spreadsheet will contain proposal instructions for offerors.

c. Will service items be part of the Government’s benchmarking, considering all technical manuals (TMs), training and ongoing logistics support is to be mandated per military standards?

Type I FOATC Draft RFP Response

GOVERNMENT RESPONSE: See the supplementation guidance listed in MIL‐PRF‐32216A, section 3.2.

The level of development for service items will be contingent upon the level of development that currently exists in the commercial product.

5) How will the Government account for cost of customizations, when not present in market benchmark examples?

GOVERNMENT RESPONSE: All military requirements are identified within the RFP, to include the corresponding CLINs, which will be identified in Section B of the RFP. In addition, a Pricing Spreadsheet (Excel) will be provided with the RFP as described in Section L. The spreadsheet will contain proposal instructions for offerors. It is the Offerors responsibility to account for the costs to meet RFP requirements in its proposal, including any customization of beyond market benchmark examples.

6) Please consider, redesign of commercial products to a military standard of any type, will yield a non‐COTS product.

GOVERNMENT RESPONSE: The Government is aware that military modification of commercial products will result in a non‐COTS solution.

7) Draft RFP references COTS products, however the CDRLs A001‐A096 add requirements to the procurement, which could possibly result in a non‐COTs outcome. Industry advises Government to further discussion of these possible contradictions.

GOVERNMENT RESPONSE: The Government is aware that military modification of commercial products will result in a non‐COTS solution. If not already identified in contractor’s COTS manuals, some CDRLs related to logistics development may require adherence to non‐COTS processes which is referred to as Supplementation throughout the SOW. Please reference SOW Sections 3, 4, 8, 9 and Attachment 0004.

8) The current lack of understanding as to whether this RFP is a single or multiple award opportunity leads to concerns related to the cost based consequences citations stated in the draft documents. Will additional FAR citation be provided so that the contractor may better understand the consequences of re‐procurement if this contract is cancelled for any reason?

GOVERNMENT RESPONSE: The RFP will contain all applicable clauses and will also identify the resultant contract as a single award, Firm‐Fixed Price (FFP) Requirements type contract.

9) Will the Federal Acquisition Regulation (FAR) and Defense Federal Acquisition Regulation (DFAR), either by reference of full citation, be included in the final solicitation?

GOVERNMENT RESPONSE: Yes, the RFP will contain all applicable clauses and provisions in either full citation or by reference.

10) Will prime contractors be required to disclose their subcontractors?

GOVERNMENT RESPONSE: Only to the extent required by the final RFP, notably Sections L&M in addition to other clause Fill‐Ins that may require the prime contractor to disclose a subcontractor in its proposal submission.

Post‐award, any requirement to disclose a subcontractor is set forth in the remainder of the terms and conditions of the contract.

11) To what extent will subcontractor involvement be required in this project?

GOVERNMENT RESPONSE: Subcontractor involvement is not mandatory, but the RFP includes several clauses encouraging subcontracting to small business firms. For offerors who are not considered to be a small business concern, development and submittal of a Small Business Subcontracting Plan is required with proposal submittal, and small business participation is one of the four evaluation factors.

12) Will Letters of Supply be required for materials to be procured from outside sources?

GOVERNMENT RESPONSE: See SOW sections C.8.3.c and C.8.5. A letter is required for EDFP if a supplier will not sell to or do business with the Government. Foreign Sources of Supply will be disclosed per CDRL A062.

13) Will all of the cited reference documents be supplied at time of RFP? (i.e., Field Technical Manual (FTM))? At this time, without a guide, industry is unable to predict potential ability to comply with military standards.

GOVERNMENT RESPONSE: The Government will supply all Attachments for the RFP. Note that any Government Electronics and Information Technology Association (GEIA), American National Standards Institute (ANSI), or other referenced standards will not be provided to contractors at RFP; contractors will be expected to purchase those themselves in order to be compliant with Government standards.

14) Will Q&A between the Government and industry be ongoing throughout the procurement process?

GOVERNMENT RESPONSE: Pre‐solicitation Q&As were held 7‐14 Jan 2021. Upon issuance of the RFP, there will only be a limited window for RFP related questions prior to the proposal due date and time. During the proposal evaluation phase, there will not be any Q&A. The Government does not intend to conduct any exchanges during the proposal evaluation phase, but reserves the right to if deemed necessary. However, these exchanges will follow the formal process outlined in the FAR/DFARS defined source selection procedures, which is not a Q&A format.

15) At any time when supplemental documentation is required for (reference during the RFP or after award) and presented to the contractor by the government, will the government allow reasonable time for review and analysis for compliance? Will reasonable discussion be allowed, in the event of potential non‐compliance?

GOVERNMENT RESPONSE: During the RFP, the Government will give 30 days for the contractor to review and provide a proposal. After award, the Government will work with the contractor through In‐process Reviews (IPRs) IAW SOW sections C.1.5.6.2 and C.1.5.6.2.1.

16) Will the Government review the Purchase Description (PD) and look for opportunities to detail performance requirements rather than design specifications?

GOVERNMENT RESPONSE:

The Government reviewed the PD after Jan 2021 Q&A Sessions with Industry. Any proposed solution must meet all the threshold requirements identified in the RFP and PD.

17) Will the Government endeavor to include threshold (T) and objective (O) requirements so that an offer which exceeds the performance of the PD can be recognized as offering superior performance capability under a best value acquisition?

GOVERNMENT RESPONSE: The final RFP Sections L&M will state that no additional credit will be given for above‐threshold capability.

18) Are all CDRLs appropriate for the purchase of a COTS item?

GOVERNMENT RESPONSE: The Government acknowledges that the proposed solution may not be a COTS item but rather a modified commercial item. The Government anticipates a commercial item with military modifications. All CDRLs are developed based on commercial item with military modifications.

19) Will the government review with an eye towards proven COTS items which may introduce cost reductions?

GOVERNMENT RESPONSE: The Government will evaluate proposals in accordance with (IAW) the criteria identified in Sections L&M of the RFP.

20) Will the government provide a schedule for the hardware including First Article Testing (FAT) start and key milestones?

GOVERNMENT RESPONSE: Section F of the RFP will identify the required delivery schedule for this effort as identified in FAR 52.211‐8.

21) Please clarify and review CDRLs that have apparent schedule conflicts, for example requiring items at contract award or 30 days after contract award where the information cannot yet be known.

GOVERNMENT RESPONSE: The Government anticipates data being known and available upon contract award or shortly thereafter. Due to the commercial nature of proposed crane, the Government’s presumption is that most data will have already been developed and available commercially.

22) Although this is considered a COTS item, many of the standards and requirements listed on the AT‐PRF0001 are not considered COTS to industry. Therefore, industry expects significant modifications will be needed in order to comply with ATPD. Would the Gov't want to see the options to meet the requirements listed in the proposal? If so, what would be the best method of doing that?

GOVERNMENT RESPONSE: The Government acknowledges that the proposed solution may not be a COTS item but rather a modified commercial item. The Government anticipates a commercial item with military modifications. The Offerors proposed solution must meet all threshold requirements outlined in the Purchase Description as the baseline solution, not as “options” to a proposed solution that currently does not meet threshold requirements. The RFP Sections L&M will not evaluate all requirements in the Purchase Description, however failure to propose a solution that meets all threshold requirements within the RFP will render the offer ineligible for award. The RFP will outline the information required to be submitted in the proposal.

23) What will the minimum order quantity be for this program that will guarantee offers some level of comfort that this program will be worth their investment?

GOVERNMENT RESPONSE: This is a requirements contract. No minimum or guarantee. See pricing worksheet for anticipated quantities.

24) Is it possible the Government will continue purchasing the Type II Heavy Crane that could affect the Type I

FOATC program by terminating this new contract early or reduce the anticipated quantity that was published as 252 units in the synopsis?

GOVERNMENT RESPONSE: Possible but not anticipated.

25) We expect that there may be some deliverables that will be ordered in first contract year, but delivered in years two, three, and four. Some of this may be as a result of the Government scheduling the resources or not available until that time. How can industry account for cost increases when items are not able to be delivered in the year they are placed on contract?

GOVERNMENT RESPONSE: Due to the streamlined fielding approach, keeping schedule is critical. The Government does not anticipate extended delivery periods on this contract.

26) With COTS manuals provided, can the government provide specific guidance of COTS supplementation required to reduce performance and cost risk to the contractor?

GOVERNMENT RESPONSE: See Attachment 0004 which reference MIL‐PRF‐32216A, section 3.2 (Supplemental Data).

a. If the intent is to not develop full MIL Spec TMs, can the Government document and define in detail what is acceptable?

GOVERNMENT RESPONSE: See Attachment 0004, which reference MIL‐PRF‐32216A. The specific MIL‐ PRF ‐32216A section is 3.1.4 (Content Requirements).

27) How does the contractor determine what is "deemed necessary for use by the Target Audience (Soldier)"?

GOVERNMENT RESPONSE: See SOW section C.4.1.2 and MIL‐PRF‐32216A. "Deemed necessary for use" is outlined in MIL‐PRF‐32216A, which describes and implies what the Government deems necessary for Target Audience Soldiers (TAS) to operate and maintain equipment per Army/Department of Defense (DoD) standards.

28) Commercial publications are typically not XML. Since COTS manuals are published using commercial software the source files will not be created using XML, DTDs or MIL‐STD 40051‐2C. Therefore, any future updates will be difficult for the government to execute. Will the government accept data published using commercial software other than XML, DTDs or MIL STD 40051‐2C?

GOVERNMENT RESPONSE: The Government may consider data published using commercial software other than Extensible Markup Language (XML), Document Type Definitions (DTDs) or MIL‐STDs; however, supplementation developed by the contractor shall be published IAW the guidelines set forth in section C.1.3.1.2.1 of the SOW and detailed in Attachment 0004 and MIL‐PRF‐32216A.

29) For Government supported activities, what are the durations? Industry needs this for resource allocation.

GOVERNMENT RESPONSE: While anticipated durations for Government‐supported activities can be provided, the contractor will have to propose to what it thinks its durations will be since the Government does not know each offeror’s crane product. Below durations are an example based on COTS Manuals that require 20‐30% Supplementation IAW Attachment 0004 and MIL‐PRF‐32216A requirements.

‐ Provisioning Conference: 5 business days (max lines per conference: 1200) ‐ Verification: 44 business days ‐ Government Review Times: 10‐20 business days depending on the CDRL ‐ Government Testing: 60 business days ‐ *see CDRLs for additional durations

30) As industry identified, there are several timing and predecessor/successor linkages in the CDRL schedule that industry would propose differently. How does industry best communicate that beyond that which we already have?

GOVERNMENT RESPONSE: The Government thinks industry has communicated accurately its schedule needs for this effort. As well as the Government accurately communicating requirement during Jan 2021 Q&A Sessions.

31) What are the anticipated evaluation factors and criteria the Government expects on this program?

GOVERNMENT RESPONSE: Please refer to Sections L&M of the released final RFP.

32) Will Sections L&M of the solicitation be released in draft format before Final RFP is issued February 10, 2021?

GOVERNMENT RESPONSE: Sections L&M will be released with the final RFP, but not prior to that.

33) Due to the unknown risk of the length of storage (and the delay of the start of the warranty), our recommendation is to have the start of warranty at the time of acceptance.

GOVERNMENT RESPONSE: See SOW section C.5.1. The Government will not allow warranties to start at the time of acceptance.

a. Can the Government commit to a maximum number of days the crane will be in storage before fielding to a unit?

GOVERNMENT RESPONSE: No, see pricing worksheet for estimated days.

b. When does the warranty start for vehicles in storage that have been shipped in place and remain at the contractor's facility?

GOVERNMENT RESPONSE: Warranty will start as outlined in SOW Section C.5.1

34) The Special Tools kit requirement implies the Special Tools and Test Equipment (STTE) will be packed and stored separate from the crane, conflicting with FOATC1‐1146 of the PD. The packaging required is not commercial standard and increases cost. Will the Government consider changing the PD to allow Special Tools to be provided by delivery order and packed and stored separate from the crane?

GOVERNMENT RESPONSE: The Government amended the PD to reflect that the contractor shall provide the kits by delivery order and packed and stored separate from the crane.

a. Can the Special Tools be packed in a commercially acceptable solution?

GOVERNMENT RESPONSE: See SOW section C.13.10. The Government will not accept the commercially acceptable solution for the Special Tools kit. It must meets the requirements outlined in MIL‐STD‐2073.

35) Industry recommends the Government review the list of requirements and CDRLs to determine if any can be waived for a COTS based product considering the additional cost and schedule impacts.

GOVERNMENT RESPONSE: Requirements and CDRLs reflect a commercial item with military modifications. As outlined in the PD and SOW, this procurement has streamlined requirements to align with commercial industry as much as possible.

36) The program documents require a full military logistics development effort. Much of the analysis, documents, and reports required are outside of standard commercial practices and thus increase the program cost and schedule.

GOVERNMENT RESPONSE: This program does not require a full military logistics development effort. This program as documented within the SOW, requires COTS manuals with Supplementation. Attachment 0004 and MIL‐PRF‐32216A outlines the required level of development for Supplementation and SOW Section 8 identifies provisioning requirement.

37) The results from the full Logistics Development activities naturally flow into the development of the TMs. COTS

TMs do not adequately capture the results of these activities and will require significant updates to meet Government requirements outlined in the SOW and MIL‐STDs. Thus, industry does not believe COTS Manuals with Supplementation will add any cost or schedule benefit over doing full MIL‐STD manuals.

GOVERNMENT RESPONSE: See SOW sections C.4.1.1 and C.4.1.2. The Government's prevailing sustainment strategy for the Type I FOATC is to utilize COTS TMs with Supplementation. Supplementation will be determined based on COTS TM conformance to MIL‐PRF‐32216A section 3.2.2 and Attachment 0004 – COTS Publications Requirements.

38) Is commercial warranty data an acceptable replacement for FMECA?

GOVERNMENT RESPONSE: See SOW section C.3.4 for information on FMECA. The Government reserves the right to accept a commercial warranty as a replacement for FMECA if the offeror’s warranty information is complete enough and can be applied to a FMECA.

39) Will corrections be made to the final RFP for things such as erroneously numbered CDRLs and Attachments? Will the SOW be updated?

GOVERNMENT RESPONSE: Prior to final RFP, the Government will ensure all contract data items are reviewed for accuracy, including the SOW.

40) Please define National Maintenance Work Requirement (NMWR) candidates requested for the final RFP.

GOVERNMENT RESPONSE: See SOW section C.1.5.6.2.1.1.1.1 for NMWR Candidates List instructions. Offerors should inform the Government of which items industry identifies as NMWR candidates. For additional information and guidance pertaining to NMWRs, reference Army Regulation (AR) 750‐1, AR 25‐30, AMC‐P 25‐31, AMC‐R 25‐76, DA‐PAM 24‐40, and MIL‐STD‐40051C.

41) SOW section “Maintainability Evaluation Execution” suggested change:

Current: The contractor shall provide two production cranes in support of the Maintainability Evaluation, and shall participate and facilitate Maintainability Evaluation efforts.

Proposed: The Government shall provide two (or more*) production cranes (as GFP) in support of the Maintainability Evaluation, and shall participate and facilitate Maintainability Evaluation efforts. *to meet schedule requirements

GOVERNMENT RESPONSE: The subject language has been revised at C.7.1 to read, “The contractor shall produce two production cranes that the Government will provide as Government‐furnished property (GFP) in support of the Maintainability Evaluation. The contractor shall participate in and facilitate Maintainability Evaluation efforts.”

42) For section C.8.5 of the SOW, “Foreign Sources of Supply Notice,” will the Government consider adding “if possible” the end of the paragraph?

GOVERNMENT RESPONSE: The Government will not add “if possible” to the Foreign Sources of Supply Notice language in the SOW.

GOVERNMENT RESPONSE TO PURCHASE DESCRIPTION

43) Received multiple questions on FOATC1‐1058. Will the Government accept an All‐Terrain Crane (ATC)? Will the Government remove the reference to the

FMVSS? Will the Government revise the definition of certification? Will the Government endeavor to include threshold (T) and objective (O) requirements so that an offer that exceeds the performance of the PD can be recognized?
