Instructions

INSTRUCTIONS
1. This effort is subject to the Service Contract Labor Standards (formerly known as the Service Contract Act) in accordance with FAR 22.10.
2. Contractors shall pay their employees at least the wages and fringe benefits found by the Department of Labor to prevail in the locality in accordance with FAR 22.1002-2. See the applicable Wage Determinations for each respective service location (Hill, AMARG and Randolph Air Force Bases).
3. The minimum wages (direct labor rate) and health & welfare (Fringe) requirements of Executive Order 13706 and 14026 are applicable to this effort. Proposed rates falling below these minimums ($15.00 per hour for Direct Labor Rates and $4.23 per hour for health & welfare) will be determined ineligible for award.
4. The offeror is responsible for classifying each skill category/reference with the appropriate job classification listed in the Wage Determinations or, if applicable, designating an exemption. If the offeror desingates any skill cagegory/reference as exempt, the offeror shall identify the exemption that applies and an explination of why the exemption applies to each identified exempt skill category/reference. A copy of the Service Contract Act Directory of Occupations and the Fact Sheet #17A of 29 Code of Federal Regulations (CFR) Part 541 have been provided for reference. If there is not an appropriate job classification listed on the Wage Determinations and an exemption does not apply, the offeror shall follow the Conformance Process as listed in the Wage Determinations and outlined at FAR 22.1019(a), including submitting form SF-1444 to the Contracting Officer prior to the performance of contract work by such unlisted class(es) of employees. The offeror shall clearly identify each skill category/reference for which the conforming procedure will be initiated.
5. Each skill category/reference identified with a Wage Determination classification shall pay at least the minimum wages (direct labor rates) specified in the respective Wage Determination for the appropriate location. Proposed rates less than the minimums specified in the respective Wage Determination for the appropriate location and/or less than those specified under Executive Order 13706 and 14026 will be determined ineligible for award.
6. The offeror shall propose both fully burdened minimum and maximum rates comprised of Direct Labor Rates, Health & Welfare Rates (fringe), and any other applicable labor rate burdens, such as Overhead, General & Administrative (G&A), and Profit for each designated calendar year (CY). CY 1 will be mapped to the year in which the contract is awarded (expected to be CY 2023), CY 2 will be mapped to the next calendar year after contract award, and so forth. The fully burdened rates proposed by the Offeror selected for contract award will become contractually binding for all task orders issued to that contractor throughout the Period of Performance (PoP) of the contract. As task orders are competed among contract awardees throughout the contract PoP, the rates proposed for each task order shall not be less than the minimum rates and shall not be more than the maximum rates proposed in this spreadsheet for each respective location.
7. Regarding overtime, the Department of Labor mandates that unless specifically exempted, employees covered by Service Contract Labor Standards (formerly known as the Service Contract Act), must receive overtime pay for hours worked in excess of 40 in a workweek at a rate not less than time and one-half their regular rates of pay. See the Performance Work Statement (PWS) section 9.4.1.1.
8. All rates for all years must be populated, do not leave cells blank, even if duplicative.
9. Do not add or delete any rows or labor categories
10. In Row 5 of each Tab (Hill AFB, UT; Davis Monthan AFB, AZ; and Randolp AFB, TX) replace the XX% for health & welfare, overhead, G&A, and profit (for the minimum and maximum rates of each CY) with the percents used to establish the applicable rates in each column. The percentages used as well as the proposed rates for each skill reference will become contractually binding. Do not delete or add labor categories.
11. All rates shall be rounded to the nearest penny. Proposed rates that extend beyond two decimal places may be determined ineligible for award.
12. Do not add or rename the worksheets.
13. The Offeror shall ensure non-exempt proposed rates comply with FAR 52.222-43, in that rates do not include any allowance for any contingency to cover increased costs (year over year escalation) for which adjustment is provided under the Fair Labor Standards Act. Standard inflation will be handled under updated Wage Determination revisions and should not be included in the direct labor rate or health and welfare rates for Fair Labor Standards Act applicable rates. Proposed rates for which an appropriate job classification is not currently listed on the Wage Determinations, and for which an exemption does not apply, but for which the offeror has identified the conformance process will be intiated (as outlined at FAR 22.1019(a)), shall likewise not include any allowance for any contingency to cover increased costs for such rates. Proposed rates not found in compliance with this direction will be determined ineligible for award.
