QUESTIONS & ANSWERS: 25 Apr 2012
Q1. Our company has requested the consent letter (ITO Attachment A-4) from our teaming partners. Teaming partners have provided the consent letter except for the following reply from one of our team members. Their response is quoted below.
“While we understand the Government’s request in this proposal and have seen it on numerous others, it is our policy to decline these requests and we have had many of our partners do the same when we were functioning as the prime contractor. This practice is not unusual and the
Government is accustomed to receiving such responses. “
My question is this: can we use their past performance without penalty, or do I drop their past performance from our proposal?
A1. Please refer to RFP Attachment 07, Section L, ITO Attachment A-4, which indicates the following: “Past performance information concerning subcontractors and teaming partners cannot be disclosed to a private party without the subcontractor’s or teaming partner’s consent.
Because a prime contractor is a private party, the Government will need that consent before disclosing subcontractor/teaming partner past and present performance information to the prime during exchanges.”
The prime’s overall past performance can include the subcontractor’s past performance in this case, however, the subcontractor will have to submit its Past Performance Information (PPI) to the Government separately, and the Government will not be able to discuss, disclose, or otherwise communicate any information regarding this subcontractor’s past performance to the prime during the proposal evaluation process, even if this subcontractor’s PPI has impacted the prime’s overall past performance rating. All information regarding this subcontractor’s PPI will be redacted from any discussion regarding the prime’s offer.
Please note that when submitting relevant past performance information separately from the prime contractor, the subcontractor in question must provide a point of contact for the
Government proposal evaluation team.
