Questions to Answers
Question 1 Reference - Section B, Paragraph 6, Qualification to Apply
“We are considering to apply as a sole prime contractor for this Yokota Multiple Award Construction Contract (MACC), which seeks additional MACC contractors. Our affiliated company is already among the selected 14 MACC contractors, and we would like to confirm that this does not hinder our participation to this solicitation. We own 24.51% of their issued capital shares, however there are no concurrent management positions except for a part-time corporate auditor (who is a licensed lawyer in Japan). We have found no regulation in FAR that restricts affiliated companies from individually participating in the same competition. Please confirm.”
Answer 1
It is not prohibited to participate individually in the same competition with affiliated company(ies).
Question 2 Reference - Section B, Paragraph 6, Fluctuate Sharing among Joint Venture Parties
Assuming various types of works are presented as task orders under MACC, we may consider to apply as a Joint Venture formed with company (companies) who possess the different specialty. Maintaining "joint and several" responsibility to the owner, can a Joint Venture fluctuate corresponding shares from 0 to 100% according to the nature of works?
Answer 2
Yes. However, when you propose as a JV, SAM information must be registered as JV.
Question 3
Reference – General. Allocation of Work Forces from Each Member of Joint Venture
Assuming the presupposition above [Question 3] is correct, can we consider the assignment of staff for an awarded task order is at the discretion of the Joint Venture, corresponding to the shares of JV members, and with no compulsive requirement by the Government?
Answer 3
Please see the Government's answer to the Question# 22 of Attachment "26 RFP Atch J6 QAs - FA520919RA006"
Question 4
Section (c), H010 COMPETITION, Amendment 0007 - Discretion to Bid to Task Orders
Should a MACC member bid for all task orders, or do you have any criterion to penalize a member to refrain from bidding some of the task orders?
Answer 4
Please see the Paragraph (a) and (b) of H010 COMPETITION stated on the "2 Atc J1 Other Req 30 Apr 21"
Question 5
General - Past and upcoming Task Orders
Kindly provide us the project information about the past and upcoming task orders under this MACC Pool, such as bid issuance dates, title, terms and conditions, description, and contract value/project magnitude.
