9 General Regarding Personnel Assignment within JV:
Please confirm that JV can assign their own qualified personnel to any positions to perform duties by their own discretion depending on their corresponding shares. In an extreme case, a JV member whose corresponding share is 0% in the Task Order may not provide its staff to the JV, if the Government has no compulsive requirement for such managerial formation. We expect this extreme assumption may happen when the Joint Venture is formed between Building Contractor and Design firm under Design-Bid-Build Task Order, where the share and personnel assignment by the Design firm to the said Task Order JV may be zero.
Subcontracting among MACC holders are not explicitly restricted. However, each MACC holder shall comply with FAR 52.203-2, Certificate of Independent Price Determination for this RFP and Request for Quotation of individual task orders
10 General Regarding Utilization of MACC competitor as subcontractor(s):
Can an awardee of a task order utilize other MACC members to subcontract to effectively perform the required works?
It depends on rationale and business ethics of the Contractor.
But at least the contractor shall comply with FAR clause 52.236-1.
11 General Actualization of MOC Project:
Please confirm the MOC project is for evaluation purposes only, and the subject project will not be actualized as an actual task order to applicants.
Yes, it is for evaluation purpose only.
12 Block 13, SF1442 Regarding RFP due date:
We have reviewed the Bidding Documents and carried out the preliminary assessment of the overall requirements for preparation of our Offer. We have determined that, taking in consideration of Christmas and new year holidays, we expect that our subcontractors will have more detailed questions at a later date and we need further time to make such high quality of several documents comprising all the requirements in these Bidding Documents. Could you extend the inquiry and offer due date for approx. 4 weeks?
Please see the amendment 0008.
