DEPARTMENT OF THE AIR FORCE

355TH CONTRACTING SQUADRON (ACC)

DAVIS-MONTHAN AIR FORCE BASE ARIZONA

19 September 2013

MEMORANDUM FOR ALL PROSPECTIVE OFFERORS

FROM: 355 CONS/MSCAC

SUBJECT: Pre-Proposal Conference Meeting Minutes; FA4877-13-R-0001, (SABER) Simplified

Acquisition of Base Engineer Requirements; Davis-Monthan Air Force Base, Tucson, Arizona.

1. A Pre-Proposal Conference/Site Visit was held at Davis-Monthan Air Force Base on 28 August

2013 at 09:00 AM, Local AZ Time. See attached “Record of Meeting” sign in sheet for listing of those who attended.

2. SSgt David A. Maida opened the meeting with a Power Point Presentation; copies of the briefed sides are attached to these meeting minutes, See Attachment 2 for more details. The briefing contained an overview, purpose, introduction of key personnel, solicitation requirements, technical requirements, additional information, a pre-briefing of the Seed project and finished with a transfer to the physical site (DM Bowling Center).

3. The following is a summary of the briefing, to include the rules of engagement for the site visit:

a. The Contracting Officer is the only person who has the authority to, or can, obligate the

Government. Any comments, thoughts, proposals, or answers to questions, are to be considered brainstorming until they are published as an amendment to the solicitation.

b. A review of the solicitation requirements, and a highlighted review of Sections L & M from the actual solicitation (FA4877-13-R-0001) was conducted. After the review of the solicitation requirements, the technical requirements were briefly addressed. At this time, it was clearly stated that no questions (Technical or otherwise related to the solicitation) would be answered during the site visit. (see paragraph c. below for details pertaining to questions/answer)

c. To maintain a fair opportunity for all participants in this solicitation, the rules of engagement for the site visit were:

i. No questions were answered during the site visit; all questions were to be written down throughout the site visit, and submitted, in writing via email, or at the end of site visit. The exact format for questions are outlined on slide 11 and 12 of the power point briefing slides. All questions to be submitted no later than, 4:30 PM, Friday, 30 August 2013.

ii. No sidebar/ private conversation with CE or the users will be authorized.

iii. Please remain with the group. Do not wander off; especially in controlled areas!

iv. Industry comments are welcome but any changes to the solicitation will be published only on FBO via an amendment.

v. All questions shall be addressed to the Contract Administrator, SSgt David Maida.

Resulting answer and/or comments, will be (and have been) recorded and available for all interested parties via the Federal Business Opportunities website (FBO). As such, these questions are listed within this memorandum, and have been incorporated, by addendum to the Solicitation (FA4877-13-R-0001)

d. A pre-briefing of the Seed Project was conducted. The Project Manager /Lead Architect gave the briefing. This was conducted as the best way to ensure each personnel in attendance could hear and understand the briefing. The noise levels at the actual site often make it hard, if not impossible to address a large group. This information is located on slides 14 through 17 of the attached power point presentation.

3. As stipulated in the rules of engagement for the Pre-Proposal Conference, question was not to be asked, or answered at the time of the Conference. Instead, all questions were to be written down and submitted directly (email preferred) to the Contract Administrator, before close of business (1630 hours) 4:30 PM, Friday, 30 August 2013. All questions received prior to the stipulated deadline are listed below. Answers have been provided for by the respective technical expert and/or Contracting Officer; answers are in red.

PRE-PROPOSAL CONFERENCE; SOLICITATION QUESTIONS

FA4877-13-R-0001

Simplified Acquisition of Base Engineer Requirements (SABER)

GENERAL (SOLICITATION) QUESTIONS

1. The RFP indicates that the offeror is to provide projects valued in price from $2,000 to

$750,000. Can an offer provide projects greater than $750,000 to demonstrate relevancy in the maintenance, repair, alteration or new construction of real property; showing capabilities to perform multi-trade construction or must they be in the range stated above?

Answer: “Relevant projects are defined as projects valued in the price range of $2,000 through

$750,000, in which the offeror’s performance was that of the prime contractor, to include …”

(Section M, Paragraph K.3.)

2. Do the design drawings and supporting documents, and the line item estimate count towards the page count in Volume 1?

Answer: No, See Solicitation Amendment 0001; ‘35% Design Submission does not count towards the maximum sheet page count.’

3. Where do the Bid Schedule and Total Evaluated Price worksheet get inserted in Volume 3; at the beginning of section B before the seed project line item pricing; please advise.

Answer: Volume III is to have 3 Sections, see Section L – L. (Volume III) Priced Proposals

Details, paragraph 2. for details and instructions.

4. RFP section L.2.b. section C states ‘It is assumed that an average of 40 projects are awarded per year, with an estimated aggregate total of $9M per year; the estimated average per year is between $4M and $6M….”. These two statements are in contradiction to each other, Please

Clarify.

Answer: Referenced statement changed; see Solicitation Amendment 0001

5. Are all factors listed in Section L.4. and L.5.a.-m. considered ‘design fee’ for purpose of Task

Order proposals?

Answer: Section L.4. provides a definition of “Design” and stipulates that by law design costs shall not exceed 6% of the construction cost. Section L.5. provides a list of “Non-Design” costs. The Design fee is considered “earnest money from the requesting User and for the

Contractor to bring the delivery order from design inception to final negotiated proposal amount.” (SABER SOW 8.5.)

6. Is this SABER a new requirement, or the replacement of and expiring SABER? If this is a replacement, please provide the previous contracts maximum amount, actual volume, and number of task orders performed.

Answer: This is a replacement of an expired SABER contract; however, should be treated as new requirement. The previous contract awarded on average forty projects per year with an average annual total award amount of $8M to $9M.

7. Per RFP Pg. 65 of 73 - Section L – K. Past Performance 1.f: Is there a minimum % of how complete the project has to be?

Answer: There is not set minimum percentage; ‘Uncompleted projects with work-in-progress may be included …’ Section L - K. 3

8. Per RFP Pg. 66 of 73 – Section L – K. Past Performance 4.: If the project already has a

CCASS, can that be turned in with the proposal in lieu of sending out a PPQ?

Answer: Not required; The Government will use data independently obtained from other

Government (i.e. PPIRS, FAPIIS) and commercial sources; this includes CCASS information.

Offerors need not submit this information with their proposals.

9. Per RFP Pg. 1 of 73 – Box 13.A. – Can you please clarify the Proposal due time? We would have to ship on Thur. Sept 5 th to get it there by Friday to make the due date? Is that correct?

Answer: It is the offerors responsibility to ensure proposals are received by the contracting office at the place and specified time stipulated within the solicitation, inclusive of all amendments. (See Block 13, SF 1442)

10. Per RFP Pg. 71 of 73 – 6. Teaming arrangements. Will the past performance of both partners in a Prime/Sub Team be evaluated equally?

Answer: IAW FAR 9.604 – Limitations; the Government can only determine the responsibility of the prime contractor. IAW FAR 9.104-4 -- Subcontractor Responsibility.

(a) Generally, prospective prime contractors are responsible for determining the responsibility of their prospective subcontractors.

11. We see there is no company identification allowed beyond the cover letter. Does this include the binder covers?

Answer: No other page (within Volume I) shall contain information that would identify the company (or logo) of which has submitted its proposal. This includes binder cover pages and/or binder side pages/inserts of Volume I. (See Section L – D. Preparation instructions, 2.

Construction of Volumes) Company identification is allowed and would be inherently required for Volumes II – Past Performance and III – Price Proposal Details.

12. Can we have colored text in the volumes?

Answer: Text shall be single spaced and printed black on white paper (black and white requirements does not apply to graphics, photos, etc.) (See Section L – D. Preparation instructions, 2. Construction of Volumes)

13. The solicitation asks for pricing in both volumes 1 & 3; in volume 1 do you want just the lump sum?

Answer: See Section L. J. b. “*Important to note. The offeror is expected to provide the itemized price proposal for the seed project, in both their technical details (Volume I), and their price details (Volume III). … “

14. Based on the AZ transaction Privilege Tax Ruling (TR 99-1) we received with the solicitation, we are exempt from city tax but must still pay state tax. Is this correct? Also, we need to include the state tax in our coefficient, correct?

Answer: Any applicable taxes should be included in the Contractor's coefficient calculation.

This solicitation and any resulting contract(s) and/or task order(s) are subject to the Arizona

Transaction Privilege Tax Ruling; TPR 99-1. Ensure your offer is in compliance with this ruling and applicable laws & statues.

15. Solicitation Page 65, Item ‘b.’ in italics states, “*Important to note. The offeror is expected to provide the itemized price proposal for the seed project, in both their Technical details

(Volume I), and their price details (Volume III). Does the price proposal in the Technical

Details – Volume 1 count toward the page count?

Answer: No - The itemized price proposal is part of the 35% design submission. See

Solicitation Amendment 0001; ‘35% Design Submission does not count towards the maximum sheet page count.’

16. Solicitation Page 65, Item ‘b.’ calls for the 35% Design Submission in the Technical Approach.

Are the Design Sheets to be 11 x 17? If different, please specify size.

Answer: Design sheets requested/required for the solicitation may utilize 11” x 17” as appropriate (See Revised Section L – d. 2. Construction of Volumes)

17. Solicitation Page 67, Paragraph 3 states, “Contractors shall submit a price proposal (consisting of a coefficient, design fee, and seed project pricing).” Is the design fee to be stated as a percentage?

Answer: The design fee is to be stated as a dollar amount.

18. Will the Government publish the site visit attendance list?

Answer: Yes.

19. Would the Government consider increasing the page limit for past performance from 8 pages to 12 pages, as we are allowed to submit up to 10 projects?

Answer: No - The Government does not desire lengthy proposals; information submitted shall be clear, consolidated and concise.

20. RFP/Solicitation; Pages 66/67; Section L, 2.b.section c; The RFP is assuming that 40 projects are to be awarded each year with an average of 4-6 million historically. Are all the task orders received during fiscal year end? If not, when will the task orders be issued?

Answer: Referenced statement changed; see Solicitation Amendment 0001 – Task orders are issued as Government requirements arise, there is no way to anticipate when future task order will be issued, awarded or otherwise advertised.

21. RFP/Solicitation; Pages 66/67; Section L, 2.b.section c; what considerations are made if the estimated amount of dollars is not awarded?

Answer. None; IAW 52.216-19 and SABER SOW, the minimum order amount under this solicitation/contract is (not less than) $2,000.00. The Government is not obligated to furnish additional dollars beyond the contract stated minimum. (Note: Referenced statement changed;

see Solicitation Amendment 0001) (See IDC constraints for additional information)

22. RFP/Solicitation; Pages 66/67; Section L, 2.b.section c; Why is the pricing based on 9 million, however historically, the magnitude is 4-6 million?

Answer: Referenced statement changed; see Solicitation Amendment 0001

23. Is the SABER contract to design for the MACC? Will projects be competed between both contracts?

Answer: No.

24. Amendment number 0001, page 7 of 9, b.5. states to include in Volume I five factors including #5. “Technical Approach Seed Project (35% design submission)”. The definition of a

35% design as stated in SOW SABER page 3 of 26, is quite extensive. It is doubtful that we can supply all of the required information into Volume I and stay within the 12 page limit. The itemized pricelist alone could be 12 pages.

Question; would you consider raising the page limit for Vol I, exempting some of the factors from the page limit (i.e. #5) or reducing the requirement for a 35% design?

Answer: Referenced statement changed; see Solicitation Amendment 0001 - 35% Design

Submission does not count towards the maximum sheet page count.’

25. Page 62 of 73, 4. b. of the RFP states: “Any legally organized offeror may submit a proposal…”

Question: Does this mean that the offeror must be a General Contractor (B-1 license) licensed by the Arizona Registrar of Contractors as is necessary in order to do this type of work legally in the State of Arizona (Arizona Revised Statutes)?

Answer: Please refer to the local SBA servicing office in Phoenix on the requirements of meeting the criteria as defined for the solicitation under the 8(a) program. The Arizona Small

Business Administration certifies the business entity within the state of Arizona as required by the Code of Federal Regulations. The only requirement stipulated by the Government is the business entity must be certified in the state of Arizona as an 8(a) business entity at the time of submission of proposals.

26. Page 65 of 73, K, 1, (Past Performance Volume II) of the RFP states: “the offeror shall provide, as a minimum, a list of their past performance data….”

a. Is this list a “minimum” or is it a requirement in addition to the up to ten past performance examples?

Answer: The offeror is to provide a list of their past performance data; data can be from government and/or private industry contracts performed within the past five (5) years; however, that list should not exceed ten (10) projects.

b. Should this list be submitted within our proposal or submitted to you before our proposal?

Answer: This list is to be submitted within Volume II.

c. If it is to be submitted within our proposal is it included in Volume II, 8-page limit?

Answer: Yes, this list is part of the stipulated page limit. (Past Performance

Questionnaires do not count towards the page limit, as they are submitted by your references, directly to the Contracting Squadron)

27. Page 65 of 73, K.1. Volume II has an 8-page limit but yet we are allowed to submit data on up to ten past performance examples.

Question: Are the past performance examples (up to ten) to be included in the 8-page limit?

Answer: Yes, Volume II has an 8-page limit. The Government does not desire lengthy proposals, elaborate listing and/or extensive comments. All information submitted is to be clear, consolidated and concise.

28. SABER SOW 8.5 – Is the design fee the same as the cost of design (to include stamped drawings, development, all engineering, field surveying, SABER SOW 5.3) that is included in the Contractor’s coefficient?

Answer: No, these are distinct and separate items. The design costs which are to be included in the Contractor’s coefficient as noted in SABER SOW paragraph 5.3 represents full compensation to the contractor for their cost of completing the required 35% design upon delivery order award. The design fee is intended as earnest money to compensate the

Contractor for their proposal efforts. The design fee does not represent any design cost, as those are to be compensated through the Contractor’s coefficient. See SABER SOW paragraph 8.5 for more details.

29. Page 66 of 73, L. 1. of the RFP states: “1. The Offeror shall provide a price proposal

(consisting of a coefficient, design fee, and seed project pricing)…. “

Page 67 of 73, 4 of the RFP states: “4. Definition Of Design Costs: Design costs are limited by law to not exceed 6% of the construction cost. “Design” means defining the construction requirement (including the functional relationships and technical systems to be used such as architectural, environmental, structural, electrical, mechanical, and fire protection), producing the technical specifications and drawings.”

a. Is our price proposal to be submitted as if it were a real SABER Task Order and NOT include a design fee that will not exceed 6% of the cost?

Answer: The Seed Project Price should be inclusive of all cost elements required to complete the project, IAW all stipulated Terms and conditions of both the SABER SOW and Seed Project SOW and all supporting documents contained therein.

b. Or are we to apply a coefficient to our seed project cost proposal and the coefficient should cover the design fees?

Answer: A coefficient is applied to the seed project cost proposal and is to be included within the total seed project price; the coefficient is not applied to the design fee. Please see answer to question #28.

c. Or may we include up to 6% design fee in our seed project cost proposal unlike if it were a real (future) SABER Task Order?

Answer: Please see answer to question #28.

30. Page 69 of 73, 4. (5) of the RFP states: “(5) [show] the capability of providing and utilizing the

RSMeans (Computerized Pricing Guide – CPG) cost estimating database to develop and provide a 35% Design Submission.”

Question: Is our PMP to include an actual completed computerized cost proposal line-item cost break-down or are we just to explain to you that we have the “capability” to provide you them in the future if we are awarded the SABER?

Answer: Proposals are to include actual completed computerized itemized priced proposals/ line-item cost break-downs. This requirement is part of the Technical Approach - 35% Design

Submission.

31. Please confirm that the seed project evaluation will require bids to fall between the floor

$250K and the ceiling $500K stated in the RFP for acceptance as a viable bid for this proposal.

Answer: IAW FAR 36.204 Disclosure of the Magnitude of Construction Projects, the aforementioned magnitude has been disclosed. (See Solicitation, Section M – E. Price, Paragraph 6. for additional information.)

32. Doc: Proposal Preparation Instructions; Pages: 7/9 Amendment 0001, Section#: K.4 Question:

Clarification from attachment #2. Within attachment #2 it only states to mail the completed questionnaire. Do the references have the options to fax, email or mail the completed forms?

Answer: References have the option to fax, email or mail the completed Past Performance

Questionnaire(s) DIRECTLY to the Contracting Squadron. (Solicitation, Section L – K.

Volume II (Past Performance Details, Paragraph 4.)

33. P 12 of 73; Note 3 – Hauling costs can be a significant element of the coefficient. This note states that there is a “primary hauling route” for the project. What is that route? The note also states that the primary route can be unilaterally changed. Since different routes could be many miles longer than the most efficient route (especially with gate closures), is there any limit on how far out of the way the Air Force may require contractors to go to haul things onto and off the project? Is there any limit on the number of times such changes will be made?

Answer: The primary haul route onto Davis-Monthan AFB is through the Swan Gate at Golf

Links Road then direct to the project site. The alternate entry would be through the Craycroft

Gate at Golf Links Road. Whereas there is no limit to the number of times a change of route may be required, this is a very rare occurrence.

34. P 12 of 73; Note 4 – This requires manufacturer’s warranties to be supplied but states that the minimum warranty is one year. If a manufacturer warranty is less than one year, such as 90 days on an appliance, will the contractor have to supply their own warranty for the difference? If so, what form must that warranty take? Is this a cost element for the coefficient or can it be an NPP item?

Answer: The contractor will have to supply their own warranty for the difference. The format of the warranty shall be as proposed by the contractor and as approved by the

Contracting Officer. This is not a cost element for the coefficient. Any additional cost would be negotiated as applicable to the specific delivery order.

35. P 13 of 73; Note 6 – This note references “extremely tight performance parameters” and suggests that performance of work orders will be awarded with absolute minimum performance periods. Please explain what the “extremely tight performance parameters” will be, and provide information that will allow bidders to estimate how much to include in their coefficients for accelerated schedules and liquidated damages.

Answer: Note 6 is in reference to an offerors Representations and Certifications. The referenced “SAM” site is a relevantly new system, and our solicitation has specific parameters (such as bonding capabilities and 8(a) certifications) that must be met in order to be considered for award. Note 6 does not address or pertain to coefficients, accelerated schedules and/or liquidated damages. Note 6 is requesting that offerors reps and certs be completed within this solicitation, as to ensure independent verification of the aforementioned requirements/parameters.

36. P 13 of 73; Note 11 – One of the expenses that must be included in the coefficient is the cost of establishing a job trailer, and the cost of moving the same. How many trailer moves need to be included in the coefficient?

Answer: The awarded contractor can expect to be provided a location to establish an office trailer on the installation. The contractor can also expect that this location will not be changed throughout the life of the contract, to include option years. However, this is not a guarantee that the location will not be changed. Should the Government require the location to be moved during the course of the contract, it will be done at the contractor’s expense.

The cost of an office trailer is considered to be a Division 1 expense, allowed in the coefficient per paragraph 5.3 of the SABER SOW. The location and utilities (except telephone and internet service) are provided by the Government at no cost and should not be included in the coefficient.

37. P 20 of 73; ¶¶ c & d – AFI 31-209 is no longer on the Air Force Publications site. Where can it be found?

Answer: Referenced AFI Removed. See Solicitation Amendment 0003.

38. AFI 31-501 states, “Access will not be approved for individuals who are employees of government contractors unless they meet all ethical requirements and provisions and are on appointment as an unpaid consultant with the Air Force.” How much cost and time need to be accounted for to get each employee appointed as an unpaid consultant to the Air Force?

Answer: Statement taken out of context. (Statement not applicable) This is an excerpt from

AFI 31-501, Paragraph 3.16.4 Granting Access to Retired General Officers or Civilian

Equivalents and Former Presidential Appointees.

39. AFI 31-501 requires each contractor employee to have a National Agency Check (NAC).

How much cost and time need to be accounted for to get a NAC for each employee?

Answer: Statement taken out of context. (Statement not applicable) This is an excerpt from

AFI 31-501, Paragraph 3.24.1 Processing Requests for Access to Restricted Areas, Sensitive

Information or Equipment Not Involving Access to Classified Information. SABER

Contractors (or any Sub-Contractors herein) are not required to have a NAC, nor will this contract require contractors to have access to any such information requiring such.

40. P 25 of 73; ¶ D – What will be the minimum hours of work specified in any delivery order?

What percentage of delivery orders will have the maximum hours of work specified in this paragraph? What percentage of delivery orders will have the minimum described in answer to the above?

Answer: This question/statement has been taken out of context. The information provided in

Section H – Paragraph D. Hours of Work, is provided to as general information as to the working hours of the base; work hours (as in when access to the base will be permitted) would be stipulated within the individual Delivery Order/Task Order (DO/TO). Example: A project requires work on the flight line, or to a building that would require power outages; the

Government would request this work be completed during ‘non-working’ hours and/or the weekends, as such the contractors would be allowed overtime. There are no minimum or maximum hours of work stipulated within the SABER SOW, Seed Project, or any such documents or future DOs/TOs awarded or performed under this solicitation and/or resulting

SABER contract.

41. P 36 of 73; ¶ 52.219-17(c) – This paragraph requires that NO subcontracts be issued unless each is approved in writing by both the SBA and the contracting officer. May the SBA approval come from the assigned offeror’s 8(a) specialist, or is there some particular SBA office or person whose approval must be obtained? What will be the criteria for approval or disapproval by the SBA? What will be the criteria for approval or disapproval by the Air

Force? What will be the time required for approval or disapproval by the SBA? What will be the time required for approval or disapproval by the Air Force?

Answer: Please refer to your Small Business Administration servicing office.

42. Ref: Price Evaluation Worksheet (Solicitation Attachment #3)

Question: The seed project does not include a Design Fee Box, do we add this to the coefficient or an indirect cost to the applied amount?

Answer: Please see answer to question #28. Note – Do not alter the formatting of the provided price Evaluation worksheet, this is locked document. Inputting data other than what was requested and required, or altering the provided worksheet, could render an offeror unacceptable.

43. Ref: Solicitation, Sections L – D. Preparation Instructions.

Question: Should the itemized price proposal for the seed project, submitted within

Technical details (Volume I) include the proposed coefficient?

Answer: No; the itemized price details contained within the (35% Design) Technical details

(Volume I) shall NOT include the contractors proposed coefficient, only the pricing information contained within the RSMeans/CPG.

SEED PROJECT (FBNV 13-4000) QUESTIONS

44. (Seed Project, FBNV 13-4000) Please provide all existing facility 3203 as built drawings in

.pdf and .dwg (CAD) formats ASAP.

Answer: As Built files have been provided; see uploaded “Document Packages/Links” on

FBO.gov posting.

45. (Seed Project, FBNV 13-4000) What is the height of the deck?

Answer: By deck height it is assumed the question is referring to the exterior covered patio deck. The finished floor of the new exterior covered patio deck should be flush with the existing/final interior sports bar finished floor elevation. (As required by ABA accessibility standards).

46. (Seed Project, FBNV 13-4000) What is the height of the ceilings?

Answer: The height of the interior ceilings should be provided at the highest possible level given existing above ceiling constraints. The exterior covered patio should be no less than 9’-

0” in height. As indicated in the SOW it is intended that this exterior covered patio structure should match the character of the existing covered patio on the North side of the Bowling

Center.

47. (Seed Project, FBNV 13-4000) What walls from existing floor plan demo?

Answer: Refer to existing as-built drawings provided and compare with conceptual floor plan provided in the Supporting Documentation. The primary wall that gets affected is the existing wall separating the proposed Sports Bar areas. This bearing wall opening gets wider.

48. (Seed Project, FBNV 13-4000) What type/location of flooring demo?
