About this file

This document consists of meeting minutes from a pre-solicitation/proposal conference for two federal contract opportunities: the GC-MATOC (FA468624R0011) and the Transportation and Paving IDIQ (FA468624R0003).

The Transportation and Paving IDIQ contract requires the contractor to provide design, labor, equipment, materials, and other necessary items for airfield and general paving work at Beale Air Force Base and other locations under the contractor's responsibility. The solicitation is a 100% small business set-aside, with the government intending to award between 5-7 IDIQ contracts. The contract has a base period of 5 years, with additional ordering periods up to a total of 10 years or $500 million. Key topics discussed include teaming agreements, joint ventures, past performance, local office requirements, and scoring/evaluation criteria. The solicitation is anticipated to be released soon with a 30-day response period.

5. The meeting primarily discussed the allocation of work under specific specialty codes in government contracts. Participants debated whether specialty contractors should bid directly or collaborate with general contractors. There was also discussion about how scoring works and whether there are advantages to specializing in certain areas. Ultimately, it was suggested that general contractors would likely have an advantage in selecting specialty subcontractors.

a. Teaming Agreements vs. Joint Ventures: There's a distinction being made between regular teaming agreements and joint ventures. Joint ventures involve more formal processes, including approval from the Small Business

Administration (SBA), and allow for the combined past performance of the partners to be considered. Teaming agreements, on the other hand, are simpler agreements between two companies to collaborate on a specific project.

b. Past Performance Consideration: Joint ventures allow for the past performance of both partners to be considered, which can be advantageous in bidding for contracts. Teaming agreements may not have the same weight in terms of past performance evaluation.

c. Concerns and Clarifications: There are concerns raised about whether using teaming agreements instead of joint ventures might open the door to potential protests from competitors. However, there's also clarification that teaming agreements can still be utilized, but they may not carry the same weight as joint ventures in terms of past performance evaluation.

d. Contract Thresholds: There's discussion about how joint ventures might affect contract thresholds, particularly in terms of size standards for small businesses.

It's clarified that operating under a joint venture might change the threshold classification, but specific details may vary.

e. Emphasis on contractor experience with design-build projects, environmental permits, and financial responsibility.

f. Consideration of adjusting project completion timeframes due to factors like the COVID-19 pandemic.

g. Minimum score requirements and bonus points for contractors meeting certain criteria.

h. Clarification on questions and procedures for submitting bids.

i. Contractor Scoring: Contractors are responsible for scoring themselves based on their qualifications and previous contracts. The government will only subtract points if a submitted contract is irrelevant to the work being contracted. Contractors can earn bonus points for meeting certain criteria, but these are not added by the government.

j. Solicitation Release: The solicitation for the GC may talk is anticipated to be released soon, with a 30-day response period. The contract is expected to span a base period of five years, with additional ordering periods up to a total of ten years or until the contract reaches a limit of $500 million, whichever comes first.

k. The discussion also touches upon the structure of proposals for transportation IDIQ contracts, emphasizing the importance of demonstrating relevant experience and capabilities without needing a perfect score in every category. Participants are encouraged to ask questions and seek clarification on the HR process and related documents.

l. RFI (Request for Information) Details: The participants discuss the RFI, including its due date and the process for posting additional amendments or answers to questions.

m. Amendments and Questions: They mention posting the 1st amendment and plan to address more questions. Participants are encouraged to submit new questions if they have any.

n. Teaming Arrangements: Discussion about teaming arrangements, including formalized teaming arrangements for past performance and SBA, joint ventures, and mentor-protege agreements.

o. Multiple Awards: The intention to target 5 awards, but it may vary depending on proposals received.

p. Local Office Requirement: Clarification is sought regarding the requirement for a local office within the SBA office territory of specific cities.

q. Discussion on Tiebreaker Methodology: Changes in the tiebreaker methodology for cost evaluation are mentioned, and participants are encouraged to seek clarification if needed.

r. Conclusion: The meeting concludes with a round of final comments and thanks.

6. The following questions were asked in relation to the GC-MATOC, the questions asked related to the transportation IDIQ are answered in RFI02, found on SAM.gov:

a. Does the subcontractor definition include subconsultants like Testing, Traffic Control?

In accordance with FAR Subpart 2.1, a subcontractor provides supplies or services for the performance of the prime contractor a subcontract, whereas FAR 31.205-33 defines a consultant as members belonging to a specific profession or possessing a special skill and who are not officers or employees of the contractor. Subcontractors are subject to the control of the prime contractor and are responsible for delivering a portion of the contracted work or supplies. A subconsultant involves providing specialized expertise or advisory services rather than directly performing tasks or services under the prime contract. Subconsultants such as Testing and

Traffic Control may fall within the subcontractor definition depending on their role and the contractual arrangements. It must be demonstrated that a subconsultant supplied goods or services for the execution of the prime contract and that they are under the control of the prime contractor.

b. If the project is allocated the 236220 NAICS but has utility work, can that be used for line 33?

No. The work samples submitted must fall under the primary NAICS code that corresponds to the self-scoring section for which they are being submitted. Work samples can be provided through joint ventures or official partnership agreements. This allows for the inclusion of relevant work samples, even if they were performed in collaboration with other entities. It is essential to ensure that the work samples accurately reflect the capabilities and qualifications of the entity in relation to the contract requirements.

c. What are you looking for in terms of the Professional Employee Compensation Plan?

There is not a specific template related to the Professional Employee Compensation Plan submission requirement. In accordance with FAR 22.1103, offerors shall submit for evaluation a total compensation plan setting forth proposed salaries and fringe benefits for professional employees working on the contract. Supporting information will include data, such as recognized national and regional compensation surveys and studies of professional, public, and private organizations, used in establishing the total compensation structure. Plans indicating unrealistically low professional employee compensation may be assessed adversely as one of the factors considered in making an award.

d. Do you have definitions for the "personnel" for the Volume 3 Bonus Criteria?

In volume 3, the word “Personnel” does not exist. The word “Professional” does. Examples of

Professional Certifications are: Becoming a CCM | Construction Management Association of

America (cmaanet.org), AIC | American Institute of Constructors (aic-builds.org) , PMP

Certification Training Course Online - (Bestseller ⭐) (simplilearn.com), Certified Construction

Quality Management Professional (CCQMP) - AIBM US

e. If I have a contract for a lease for office space pending award of contract, is that sufficient vs having a current local office?

Offerors must have a bona fide registered office within the Fresno, San Francisco, and

Sacramento SBA Districts. Offices must be registered in those districts prior to proposal submission to be considered eligible for award.

f. Will you provide project sheet attachments?

Attached to this document is the Five (5) Year Work Plan for Beale, AFB.

g. Are you required to have an office in Northern California? Or can it be anywhere in

California?

https://www.cmaanet.org/certification/certified-construction-manager/becoming-ccm https://www.cmaanet.org/certification/certified-construction-manager/becoming-ccm https://aic-builds.org/ https://www.simplilearn.com/project-management/pmp-certification-training?eventname=Mega_Menu_New_Select_Course https://www.simplilearn.com/project-management/pmp-certification-training?eventname=Mega_Menu_New_Select_Course https://aibm.us/certified-construction-quality-management-professional-cqmp/ https://aibm.us/certified-construction-quality-management-professional-cqmp/

This acquisition is solicitated as a 100% total Small Business Set-aside. Eligible Small

Businesses are required to have bona fide offices located, and registered, within the San

Francisco, Fresno, or Sacramento SBA regional districts. Use of military installation addresses being used as registered offices with the SBA will result in ineligibility. Please note that due to a

Moratorium for 8(a)s, there is no restriction on having bona fide offices in the above referenced districts.

h. How will all this be verified? Projects as verified NAICS by Gov Spending or other database? Staff, Payroll records?

Please refer to Sections L and M of the Solicitation which details evaluation processes and criteria for submitted work samples.

i. Has anyone worked on SCIF’s before?

The GC-MATOC SOW encompasses the full range of methods, technologies, and supporting activities necessary to conduct project construction at Beale AFB, CA and other locations for which Beale AFB is responsible to maintain in accordance with technical and regulatory requirements.

j. Are you going to allow the Teaming Agreements for Past Performance on this contract as well?

The Past Performance section has been eliminated from the self-scoring worksheet.

k. Is this a multiple award?

This Solicitation is for a Multiple Award Task Order Contract, Indefinite Delivery Indefinite

Quantity (IDIQ) contract, with the government intending to award between five (5) and seven (7) contracts.
