Cross Teaming
Q: Task orders: May a team member of an awardee bid as a part of another team?
A: Section H, Special Contract Requirements, outlines the contract’s requirements on
Subcontractor/Cross Teaming. Review H-34 to comply with the specific guidelines related to subcontractor reporting.
Q: Cross-teaming: I didn’t see anything in the pws or instructions addressing this. For purposes of forming teams for the IDIQ, may a member team with more than one SB offering?
Subcontractor/Cross Teaming. Cross teaming is allowed, review H-34 to comply with the specific guidelines related to cross teaming.
Q: In the process of creating teams to meet the broad range of requirements for the
USAMS III proposal effort will cross teaming be allowed or will teaming agreements be required to be exclusive?
Q: For the purpose of bidding on task orders, may a team member of one awardee team bid as a member of a second awardee team? i.e. is cross teaming allowed? If so, are there any restrictions?
Q: Can a current USAMS II prime contractor be on multiple submitting winning prime teams on USAMS III? As a small company looking, everyone is grappling to get an incumbent on their team and the concern is that those large companies are going to go in there and take away the leadership of the small companies.
A prime small business must be capable of meeting the requirements set forth in the RFP. Each small business must ensure it does not violate the “ostensible subcontractor” rule set forth at 13
C.F.R. § 121.103.
Q: Are you going to define any of the cross teaming rules as part of the acquisition? If you had someone that performed on a TO and they are the only person that can do this work, how do you make sure that you are not poaching other members to make sure that you are still getting the work done? Maybe you are more interested in OCI issues. Wondering how much of a concern it was to you, or if you would put out additional rules. XYZ company incumbent today, maybe a prime: would you allow them to submit as a team mate on three separate proposals? Bigger problem comes down to if the large company wins on three small prime contracts, and then the issue comes down to the task order level. I don’t see that it is personally in the Gov’ts interest to allow cross teaming.
Q: In order to secure competition on the procurement would the government consider restricting cross teaming for both prime and sub-contractors? If not, would the government consider restricting the primes from subbing to another team? Concerns, if prime has option to sub to another team, they are not helping us compete. Or, they can take our strategy to a different team and give that strategy to them to win and take the win from our team. I’ve seen where they restricted cross-teaming at the IDIQ level, if it makes sense at the task order level, you can submit the case and the CO will allow it if it makes sense.
We don’t want to be on a team where companies are considering which team they want to go with when we want to spend that time developing the solution.
Q: Do you anticipate cross-teaming for the primes? As a small, I do not prefer it. I could see the team they carried on to the contract cut out b/c of cross-teaming. I don’t know that
I care if the subs can cross-team.
Q: Will there be any language about being exclusive to Prime and about cross-teaming?
For us, it’s the ability to be on multiple teams. For smalls that can add goals or goals on there for the prime to meet certain categories, etc. For us it allows to work with multiple primes and learn from them and grow from them.
Q: Will there be any limitation on contract cross-teaming?
Q: Will the Government allow subcontractor cross-teaming?
Q: Will the Government allow the primes to cross team?
Q: Cross-teaming: In study and preparing for this USAMS opportunity it is clear that there is this emerging trend in Government pushing these types of contracts to Small
Business. The larges will, despite the intent to push to sb this work, continue as subs to take the bulk of the work and you have very little going to the sb. So the larges are still getting a substantial amount of the business and the smalls are meeting their 50%. Larges are able to spread across the 3-5.
Q: For the purposes of forming teams for an IDIQ award, may a company be a member of more than one Small business offering?
Q: Will the government eliminate the ability to cross team in order to prevent any potential
OCI?
Q: Will the government consider no cross teaming by a large company (or its subsidiaries) to eliminate the possibility of "flawed competition” on task orders (specifically if large teams and its subsidiaries could possibly lead the task order proposals containing the same incumbent solution with different small business company ‘fronts’)? We believe that requiring exclusive contractor teaming arrangements, as is required in many solicitations, can prevent this potential future issue.
