I. Contracting Activity.

II. Nature and/or description of the action being processed.

This is a Class J&A for construction services to allow the 375th Contracting Squadron to modify, by supplemental agreement, twelve (12) indefinite delivery, indefinite quantity contracts compromising the Scott AFB Multiple Award Construction Contract (MACC) program, to increase the total program ceiling from $60M to $69.95M. The MACC is comprised of the following prime contracts: FA4407-14-D-0005 (Patriot LLC); 14-D-0008 (Valient Construction); 14-D-0009 (Abba Construction); 14-D-0011 (MKB Construction); 14-D-0013 (RB Construction); 14-D-0014 (HOF Construction); 14-D-0020 (Accel Pacific JV);

14-D-0021 (Ma Chis Kawv); 15-D-0002 (JM Industrial/River City JV)); 16-D-0002 (J.E. Novack); 16-D-0003 (Pangea Inc.); and 16-D-0004 (Interface Construction Corp). All contracts are subject to the stated program ceiling.

III. Description of supplies/services required to meet agency needs.

The MACC provides project execution for the delivery of design-build and/or bid-build general construction services supporting all facilities located at or under the jurisdiction of Scott AFB. The program consists of four 8(a) and eight small business IDIQ awards that independently compete for individual projects. Work consists of new construction and/or repair of architectural, civil (structural), mechanical, electrical, fire suppression and alarm notification systems. The current ordering period expires 18 September 2019

IV. Statutory authority permitting Other than Full and Open Competition.

V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).

The current MACC program consists of four 8(a) set-aside prime contractors and eight small business contractors providing general construction services to Scott AFB under the IDIQ contracts. The current MACC program was solicited as a combined 8(a) and small business set-aside. Out of the 20 proposals evaluated, 14 contracts were awarded consisting of six 8(a) set-asides and 8 small businesses. In FY16 Options were not exercised for two of the IDIQ 8(a) set-asides and three small business contracts:

FA4407-14-D-0003; 14-D-0006; 14-D-0007; 14-D-0012; and 14-D-0017.

Contracts awarded on 15 September 2014 consisted of an ordering period ending in September 2019.

The 2nd option year was recently exercised in addition to on-ramping three (3) small business contractors to support the FY16 program execution. Due the success of this program and unforeseen/ increased workload, the current ceiling is insufficient to support any potential modifications on current FY16 task order awards and FY17 CTO program needs.

Increasing the ceiling will allow the 375th CONS to administer current contract requirements in addition to execute the remaining FY17 CTO projects through the end of the 2nd option period, year 3, of the total MACC performance period. The original ceiling was based on a $12M per year estimate for a 5-year period for projected requirements. Actual requirements have exceeded that per year estimate with approximately $2.9M remaining under the current ceiling. Two CTO FY17 projects totaling have also been awarded leaving a balance of less than $600K to support the current construction program. The $9.95M increase is based on the independent government estimate provided by the requirements owner, 375th Civil Engineering Squadron, broken out as follows:

Given the long lead time to conduct a new MACC source selection, the current twelve (12) prime contractors under the MACC are considered the only firms capable of providing the services described above without the U.S. Air Force experiencing unacceptable delays and costs associated with individual project source selections.

VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.

The contracting officer will provide each prime contractor a fair opportunity to be considered for awards on task orders exceeding $2,000. The contracting officer shall provide a fair notice to all the prime contractors of the intent to issue a task order for construction services and the basis upon which the selection will be made. A notice of intent to modify the above contracts to increase the MACC program ceiling will be published in FedBizOpps to comply with FAR 5.201(b)(1)(ii).

VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

Due to highly competitive nature of the MACC program, all project costs will be determined fair and reasonable based on adequate price competition. In the event competition is limited or only one proposal is received, the contracting officer will ensure price and/or cost analysis is conducted to ensure fair and reasonableness.

VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.

Market research (MR) consisted of reviewing alternatives compared to the current multiple award competition environment to meet known construction projects slated for FY17 execution. Based on a review of historical participation rates, availability of local sources, and MR summary report supporting the current program, it was determined there is no realistic opportunity to improve the competitive environment based on re-solicitation of the entire MACC program. The current program is the third such multiple award construction program on Scott AFB.

XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required.

Market research and acquisition planning actions are underway to refresh the MACC program with a target award of July 2017. Based on historical experience and previous market research, there is an expectation that a sufficient number of qualified small business firms will compete for inclusion in the multiple award program. The follow-on acquisition strategy will review historical and programmed workload volume to develop a more realistic program ceiling to minimize the potential for future actions of this type before reaching the contract expiration period.
