1 RFP Amendment 2 and RFP Att. 22 Section L.3.2.4
The Government helpfully has clarified in the RFP that past performance citations from an offeror’s joint ventures, partners, and affiliates are acceptable. However, the RFP requirement that “three (3) contracts must be prime contractor contracts” could be read to operate as an undue limit on competition.
This is a set-aside procurement for companies in SBA’s 8(a) program for small, disadvantaged businesses. The RFP will credit only past performance citations that are relevant, “determined by the similarity to the scope, magnitude of effort and complexity” of this $100M+ procurement (estimate based on incumbent contract information). If Section 3.2.4 is read to require that three cited contracts must be held by the prime contractor, the Government would be restricting the competition to small, 8(a) companies that have three $100M+ contracts and that also meet the recency requirements (at least 12 months of performance during the past three years). Accordingly, if the requirement is that three cited contracts must be held by the prime contractor, this would exclude many 8(a) companies. Indeed, if that is the requirement, the company submitting this question will not bid. We also note that under the procurement rules, the past performance of affiliates and joint venture members typically is attributed to the offeror itself (unlike, e.g., a subcontractor citation) so could be fairly considered a “prime contractor contract.”
QUESTION: Will the Government please clarify Section L.3.2.4 so that the three contracts that must be “prime contractor contracts” may be satisfied with citations from an offeror’s joint ventures members or affiliates?
