Section C – Description /Specifications/Performance Work Statement
The documents listed in Section J of this solicitation constitute the work description, specifications and the Performance Work Statement (PWS) to define the task requirements for performance under this RFP and may be incorporated into the resulting contract either by reference or full text.
Requirements:
The Space Fence (SF) system is comprised of two Geographically Separated Units (GSUs). The Space Operations Center (SOC/Det 4) is currently located at Huntsville, Alabama, co-located within the Reagan Test Site Operations Center. It provides remote operations for Sensor Site 1 which is located at the U.S. Army Garrison-Kwajalein Atoll (USAG-KA), in the Republic of the Marshall Islands in the Western Pacific Ocean. The implementation of the SF Increment One expands and strengthens U.S. space superiority through improved Space Domain Awareness (SDA) mission capabilities. The scope of the requirement is to provide non-personal services to manage, operate, maintain, and provide logistical and general support for the SF system.
Section D – PACKAGING AND MARKING
1. Packaging and marking of technical data, hardware, and software to be delivered pursuant to this contract shall be in accordance with the contractor's standard commercial practices.
2. Requirements for packaging and marking other materials are contained in the PWS. Otherwise, standard commercial practices for routine, miscellaneous materials will be satisfactory if sufficient to protect the materials during transit.
3. See Performance Work Statement for additional requirements.
Section E – INSPECTION AND ACCEPTANCE
Point of Inspection
1. The Government reserves the right to perform quality assurance inspections at the places of performance identified in this contract. The Government will inspect the contractor's submissions (deliverables) and services/products as specified in this contract. To accomplish these inspections, the Contracting Officer will appoint Contracting Officer's Representative(s) (CORs) for the Space Fence.
2. Inspection and acceptance will be performed by the assigned DEL-2 COR.
3. The address, telephone numbers, and e-mail address of the COR will be provided in a memorandum to contractor following award.
Section G – CONTRACT ADMINISTRATION DATA
Notice to Offeror(s)/Supplier(s):
Funds are not presently available for this effort. No award will be made under this solicitation until funds are available. The Government reserves the right to cancel this solicitation, either before or after the closing date. In the event the Government cancels this solicitation, the Government has no obligation to reimburse an Offeror for any costs.
Section H - Special Contract Requirements
Failure to perform in accordance with PWS para 1.28.2 will result in the Government removing 2% from the total amount of the Operations & Maintenance (O&M) Contract Line Item Number (CLIN) of the non-conforming site. The Minimum Quantitative Requirement for the Small Business Participation Commitment Document will not be affected by any adjustment under this section. The 2% removal will occur each month for each vacancy not filled after 60 days. Each month will be calculated based on the total awarded amount and will not change based on the new value and funded amount of the O&M CLINS. The proration will begin on the 61st day and will be based on 2% of the total CLIN value divided by the number of days in the corresponding month and then multiplied by the number of days vacant in that month. All numbers will be rounded to the whole dollar amount. See Example 1 below. Moving, hiring, or promoting personnel from one site to another will constitute a vacancy at the losing site and does not restart the 60 day time period over again as this is not a gain in personnel to the contract, but a re-shuffle of personnel. See Example 2 below.
The total number of vacancies will apply to the entire contract and not per site, and the 2% will be reduced from the CLIN of the non-conforming site(s). The Government considers failure to maintain qualified, certified staffing at the proposed and incorporated staffing level an event of default and reserves all rights and remedies of default. In the event of a termination for default, the Government will assess these damages until the Government reasonably obtains performance of similar services. This removal is in addition to excess costs of repurchase under the termination clause.
Example 1:
The 61st day of an unfilled vacancy falls on the 10th day of a month containing 31 days.
The vacancy is open for the rest of the month, which equals 21 days.
All values will be rounded to the nearest dollar.
CLIN 000X value = $100,000.
2% of CLIN 000X = $2,000.
$2,000/31 days = $64.52 per day (rounded to $65.00) $65.00 times 21 days = $1,365 which will be removed from the appropriate CLIN.
Example 2:
The SOC/Det 4 has two vacancies not filled within 60 days.
4% will be removed from the SOC/Det 4 O&M CLIN on the 61st day.
The contractor moves one person from Sensor Site 1 (SS1) to fill one vacancy at SOC/Det 4.
There is now one vacancy at the SOC/Det 4 and one vacancy at SS1.
2% will be reduced from the SOC/Det 4 O&M CLIN for one vacancy and 2% will be reduced from the SS1 O&M CLIN when the move of personnel occurs.
