EXHIBIT 9 - GENERAL CERTIFICATIONS
This document is a General Certifications exhibit applicable to state and local government contracting entities. The exhibit establishes mandatory certifications and representations that contractors must make regarding their business practices, compliance status, and eligibility to conduct business with public agencies. The certifications address debarment status, suspension eligibility, conviction records, tax compliance, drug-free workplace requirements, and organizational legitimacy. Contractors must affirm they are not debarred from federal contracts, have not been suspended or proposed for debarment, and have disclosed any relevant criminal convictions or civil judgments. Additionally, contractors certify compliance with applicable tax laws, maintenance of drug-free workplaces where required, and verification that they are duly organized and validly existing entities authorized to do business in their respective jurisdictions. These certifications serve as prerequisites for contract award and are required at the time of proposal submission or contract execution.
The certifications function as regulatory compliance requirements rather than pricing or commercial terms mechanisms. Contractors must provide sworn declarations or affidavits attesting to their compliance status across multiple categories including federal exclusion listings, state debarment databases, and tax authority records. The exhibit typically requires certification that no relevant information has been withheld and establishes the contractor's acknowledgment of penalties for false statements. These general certifications are standard across most state and local procurement processes and represent mandatory conditions precedent to bid consideration or contract award, with enforcement typically managed through contract provisions allowing termination for cause if certifications are later determined to be false or misleading.
