About this file
This is a Confidentiality Determination letter issued by the Arizona Department of Administration regarding Request for Proposal #BPM005385 for Foreign Language Interpretation and Translation Services. The determination addresses confidentiality claims submitted by Cayuse Government Services, LLC in their proposal response. The letter outlines the state's evaluation of documents designated as confidential by the offeror, comparing them against Arizona's statutory definition of trade secrets under A.A.C. R2-7-101(52) and applicable procurement code provisions. The determination was made effective January 4, 2024, and establishes which proposal attachments may be disclosed to the public and which will remain confidential.
Of the five attachments designated as confidential in the proposal submission, the Procurement Officer determined that three documents—the Experience and Capacity Response, Method of Approach, and Pricing Document—may be disclosed as they do not contain trade secrets or information that cannot be readily ascertained through web search or legal means. Two documents were determined to remain confidential: the AZ Baseline Infrastructure Security Control document and the AZ Baseline Infrastructure Security Control Pre-Requisite and PreSupplement. The letter clarifies that contract terms and conditions, pricing information, and generally available public information are not considered confidential under Arizona procurement regulations, and the determination may be modified or revoked as circumstances warrant.

Re: Determination of Confidential Documents Request for Proposal #BPM005385 – Foreign Language Interpretation and Translation Services
Dear Preston Eagleheart, Proposal documents are designated confidential when the material is proprietary or a trade secret and therefore not subject to disclosure. Per A.A.C. R2-7-101(52), a trade secret is “information, including a formula, pattern, device, compilation, program, method, technique, or process, that is the subject of reasonable efforts to maintain its secrecy and that derives independent economic value, actual or potential, as a result of not being generally known to and not being readily ascertainable by legal means”.
In accordance with A.R.S. § 41-2502 A.A.C. R2-7-10, Written Determinations and the Arizona Procurement Code R2-7-103, Confidential Information, a Procurement Officer shall, upon receipt of an Offeror’s submission of information designated as “confidential” determine whether such submission is confidential or whether the information may be disclosed. The documents listed below were uploaded and designated “Confidential” in your offer, and we have determined that the documents listed below may be disclosed. This determination was made because none of these documents contained trade secrets or information that could not be ready ascertainable by a web search, or by legal means.
· Attachment 10_Experience and Capacity Response
· Attachment 12_Method of Approach
· Attachment 13_Pricing Document
The documents listed below were uploaded and designated “Confidential” in your offer, and we have determined that these documents will be kept confidential.
· Attachment 16_AZ Baseline Infrastructure Security Control document
· Attachment 17_AZ Baseline Infrastructure Security Control Pre-Requisite and PreSupplement
Please keep in mind that, in accordance with A.A.C. R2-7-103, contract terms and conditions, pricing, and information generally available to the public are not considered confidential information.
This Determination is effective and shall remain in effect unless otherwise modified or revoked.
