Change Order 01

Wekiwa Springs State Park – Site Grading Improvements

Wekiwa Springs, Apopka, FL

Statewide Contract CN202, Task Assignment 45

Project Objective: Under TA #45, Michael Baker is completing the final Design Plans for grading improvements at the Wekiwa Springs State Park is in Orange County, Florida. Now that likely permit requirements have been identified, this change order adds full permitting services to perform site reviews to document protected species, data collection of wetland limits (if present) and permit applications for all required environmental permits.

This Change Order adds the following tasks to the project:

Subtask 3: Environmental Field Surveys

3.1 General Protected Species Survey

The CONSULTANT will perform a general protected species survey within the limits of the project to look for evidence of use of the project area by protected species and to determine whether suitable habitat for protected species occurs in the project limits. The survey will be limited to the improvements to the canoe launch road, the trail leading to the west side of the swimming area, and the grassy slope adjacent to the spring and will not exceed 2.0 acres in size. If gopher tortoise burrows are found during the general protected species survey, the location of the burrows will be recorded with submeter global positioning system (GPS) equipment. Information collected during the field survey will be used for the ERP permit application as needed.

3.2 Wetland Delineation

The CONSULTANT will flag/stake wetland jurisdictional limits in the field within the project area in accordance with the State of Florida’s wetland delineation methodology contained in Chapter 62-330.201 of the Florida Statutes (FS). Wetland delineation boundary flag locations will be recorded using submeter accurate GPS equipment. The wetland limits will be added to the final design plans. The wetland boundary will be used to minimize/avoid wetland impact in the project design.

Deliverables

• PDF aerial of wetland limits (if present) or email notice of “no wetlands present” findings.

• Documentation of existence (or non-existence) of possible protected species at the project site.

Assumptions:

1. Protected species permitting and special purpose protected species surveys such as a 100 percent Gopher tortoise survey and surveys for crested caracara, Florida scrub-jay, Florida bonneted bat, or federally protected skinks are not included in this scope of services.

2. Endangered Species Act formal Section 7 consultation with the U.S. Fish and Wildlife Service is not included in this scope of services.

3. If it is determined that special purpose protected species surveys, formal consultation, or protected species permitting are required, this will be provided under a separate agreement and is currently not included in this scope of services.

4. Wetland boundary flag locations will be recorded using sub-meter accurate global positioning system equipment.

5. If survey services are required for recording of wetland delineation, this will be provided under a separate agreement. Survey services to record wetland flags are not included in this scope of services.

6. Coordination with the State Historic Preservation Office is not included in this scope of services.

Subtask 3 Fee:

Company Classification Rate Hours Cost

MBI Project Manager $238.84 0 $0.00

MBI Sr. Env. Scientist $172.27 3 $516.81

MBI Environmental Scientist $106.81 24 $2,563.44

Totals (Subtask 3) 27 $3,080.25

Subtask 4: SJRWMD and USACE Permitting

The CONSULTANT will prepare the permit applications and coordinate with two (2) regulatory agencies that have jurisdiction over the project, specifically SJRWMD and USACE.

4.1 – SJRWMD Environmental Resource Permit (ERP) Application

SJRWMD Pre-application Meeting

The CONSULTANT will coordinate, schedule, and attend a pre-application meeting with SJRWMD. A representative of the CLIENT will be invited to attend the meeting. SJRWMD pre-application meeting materials, supporting documentation and graphics for the meeting will be prepared by the Consultant.

Meeting minutes will be developed to record and summarize the details of the meeting.

SJRWMD Environmental Resource Permit (ERP) Application Preparation

The CONSULTANT will prepare either a Request for Verification of Exemption from ERP or a General ERP application. This will be based on direction from the SJRWMD received during the pre-application process.

This will include the design plans and permit drawings/dredge and fill sketches as well as additional graphics as required by the permit application. The application will include an environmental narrative that will provide the justification for the proposed improvements and describe the avoidance and minimization efforts and the environmental impacts. If necessary, the CONSULTANT will prepare the

Uniform Mitigation Assessment Method (UMAM) worksheets for the project impacts.

SJRWMD Wetland Limits Field Verification Meeting

The SJRWMD Wetland Limits Field Verification meeting will be scheduled after the ERP application is submitted. SJRWMD personnel will be contacted to arrange an on-site field meeting to review the jurisdictional lines.

SJRWMD RAI Responses

The CONSULTANT will respond to SJRWMD Requests for Additional Information for issues related to our scope of services. If SJRWMD requires additional services or tasks to obtain the permit which are not included in our scope of services, then an amendment to our contract will be required.

4.2 – U.S. Army Corps of Engineers (USACE) Section 404 Permit Application

USACE Section 404 Permit Application Preparation

The CONSULTANT will prepare USACE Form 4345 Application for Department of the Army Permit. The

CONSULTANT will submit the application to USACE with necessary supporting documentation such as the permit drawings depicting the dredge and fill impacts, a location map, and an environmental narrative addressing 404 permit requirements.

USACE RAI Responses

The CONSULTANT will respond to USACE Requests for Additional Information for issues related to our scope of services. If the USACE requires additional services or tasks to obtain the permit which are not included in our scope of services, then an amendment to our contract will be required.

Deliverables

• SJRWMD and USACE Permit applications will be provided to the CLIENT in PDF for approval/signature prior to submittal to the agencies.

Assumptions:

1. If it is determined that Orange County permitting is required, this will be provided under a separate agreement and is not included in this scope of services.

2. The project is located in an area that is retained for Section 404 jurisdiction by the USACE.

3. The project either qualifies for an ERP General Permit or is exempt from ERP permitting. If it is determined that an individual ERP Permit is required that will be provided under a separate agreement and is currently not included in this scope of services.

4. The project qualifies for a USACE Section 404 Nationwide Permit.

5. If wetland mitigation is required, this requirement will be met by the ClIENT by purchase of mitigation credits from a SJRWMD and USACE approved wetland mitigation bank.

6. Mitigation credits are available from a mitigation bank with a service area that includes the area of the project. Identification of possible mitigation banks will not be the responsibility of the Consultant and is not included in this scope of services.

7. Purchase price of any required wetland mitigation bank credits would be paid for by the CLIENT.

8. If development of a wetland mitigation plan is required, this will be provided under a separate agreement and is not included in this scope of services.
