If a proposal did not include an OCI plan and the Government identifies an OCI or potential OCI after that proposal was received or if the plan submitted does not mitigate the OCI risk, the Government will notify the offeror about the identified OCI and provide the offeror a reasonable opportunity to respond. If an offeror did not self-identify the OCI and submit an OCI plan with its proposal, it may be required to submit an OCI plan subsequent to submission of its proposal. The OCI plan, if submitted, as well as any other information provided by the offeror regarding OCIs will be evaluated by the Government to assess whether or not those OCI issues have been mitigated as is required for an offeror to be determined a responsible party to receive award of a federal contract. The contracting officer will make the final determination if the OCI issue exists and can be mitigated.”
