DEPARTMENT OF THE NAVY
IN REPLY REFER TO:
JUSTIFICATION AND APPROVAL FOR USE OF OTHER THAN
FULL AND OPEN COMPETITION, BRAND NAME SOURCE
1. Contracting Activity.
The contracting activity is CPG (COMFRC Procurement Group), Patuxent River, MD. The requiring activity is the Fleet Readiness Center Southwest (FRCSW), North Island, CA.
2. Description of the Action Being Approved.
The Justification and Approval (J&A) authorizes and approves the issuance of a Firm Fixed Price contract action on a brand name source for the technical requirement that the chiller units are Carrier Corporation models. The Original Equipment Manufacturer (OEM) of the existing Air-Cooled Liquid Chillers that support the AECTS and AVTRON test stands at FRCSW are Carrier units.
3. Description of Supplies/Services.
This justification and approval authorizes, on a brand name source basis, that FRCSW will acquire the essential subsystem components in order to create an upgraded Chilled Water System in building 378 on North Island, CA. Currently, the two existing Carrier Chillers cannot support the AECTS and AVTRON test benches at full load. This hindrance impacts fleet readiness and throughput for both the E-2 C/D and F/A-18 programs. The existing split system needs to be upgraded to include two additional 20-ton Carrier Air-Cooled Liquid Chillers, accompanied by a central water storage tank, circulation pumps, and a recirculation pump.
Estimated Dollar Value in Thousands
FY 19 FY 20 FY 21 FY 22 FY 23 Total
CIP $1.420M
Total $1.420M
4. Statutory Authority Permitting Other Than Full and Open Competition.
41 U.S.C. 1903, FAR 13.501(a) Sole Source (including brand name) acquisitions conducted under simplified acquisition procedures are exempt from the requirements in FAR part 6.
J&A
Contracting officers must conduct sole source acquisitions, as defined in FAR 2.101, (including brand name) under FAR part 13.5 only if the need to do so is justified in writing and approved.
5. Rationale Justifying Use of Cited Statutory Authority.
Carrier Corporation is the original Vendor of the existing Air-Cooled Liquid Chillers in Building
378. In order to create a Chilled Water System to support the AVTRON and AECTS test benches at full load, two additional Carrier Air-Cooled Liquid Chillers need to be procured in order to fulfill the requirements of the performance and fabrication specifications, quality, and location-specific requirements (includes accessories, features, and installed options). The Carrier Corporation Air-Cooled Liquid Chillers are able to meet facility design requirements of developing a seamless distribution system since they are compatible with the existing Carrier Corporation chillers.
The internal operating systems for the existing Carrier Corporation chillers are programmed to support the AVTRON and AECTS test benches. Due to their compatibility, the two new Carrier Air-Cooled Liquid Chillers would be programmed the same way. If two new Carrier Corporation Chillers are not procured for this effort, an external operating system would need to be procured to support the four chillers since they are not compatible.
The chilled water buffer tank, circulation pumps, and recirculation pump must meet the requirements of the design of the Chilled Water System; equivalent proposals from competing manufacturers are acceptable, provided that they are compatible with Carrier Corporation’s Air- Cooled Liquid Chillers and all of the other requirements listed in the facility layout design.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
FRCSW had an Industry Day on November 9, 2021 to establish a list of vendors capable of performing the work. Five vendors submitted their capability statements.
7. Determination of Fair and Reasonable Cost.
The Contracting Officer shall ensure that the price negotiated for this acquisition is fair and reasonable, in accordance with FAR 13.106-3(a).
8. Actions to Remove Barriers to Future Competition.
NAVAIR will continue to perform Market Research through the lifecycle of this contract as required by FAR Part 10, including maintaining a market survey, and if another potential source emerges, NAVAIR will assess whether competition for future requirements is feasible.
Additionally, NAVAIR will continue to work to determine whether there are mutually acceptable terms by which NAVAIR could receive sufficient technical data rights to pursue competition.
