About this file

This is a Payment Bond Form for the County of Sacramento's electronic waste processing contract. The bond form establishes the contractual obligations between the Principal (contractor), the Surety (bonding company), and the Obligee (County of Sacramento). The bond guarantees performance of work under the e-waste contract and ensures payment to all laborers, subcontractors, and applicable state agencies, including compliance with California Civil Code Sections 9550-9566 and the Unemployment Insurance Code. The bond amount, execution date, and signatory information require completion prior to contract execution. The form requires original signatures from both the Principal and the Surety's Attorney-in-Fact, with the latter requiring notarization and accompanied by a current power of attorney document. The County requires submission of one hardcopy bond bearing original signatures.

The bond amount must equal one hundred percent of the agreement value plus early termination fees, as referenced in the related RFP for collection, recycling, and reporting of covered electronic waste (CEW), uncovered waste electronic devices (UWED), recyclable electric equipment materials (REEM), and universal waste (UWASTE). The performance bond is a mandatory contractual requirement for the selected contractor and provides protection to all parties named in California Civil Code Section 9554 who perform labor or provide materials for the project. The Surety waives notice of any changes, extensions, alterations, or additions to contract terms, specifications, or work scope and waives provisions of California Civil Code Sections 2819 and 2845.
