NOTE: The portions of this statement of work addressing HVAC and pneumatics are dependent on the the results of various studies that are currently unavailable. The results of the studies will be provided to the awardee when available to the Government and will be incorporated into the contract via modification.

1 Introduction This Statement of Work (SOW) describes the Government’s requirement for services related to refurbishment of the United States Merchant Marine Academy’s (USMMA’s) Fulton-Gibbs, which consists of complex two, conjoined academic buildings, Gibbs Hall and Fulton Hall.

2 Background The USMMA, located in Kings Point, NY, is operated by the Maritime Administration (MARAD), U.S. Department of Transportation. The existing structure of USMMA’s science and engineering Fulton-Gibbs complex, consisting of Fulton Hall constructed in 1943 and Gibbs Hall constructed in 1980, is in need of refurbishment.

Asbestos An asbestos survey of the USMMA campus was performed in March 2021. The survey covered common areas and mechanical rooms of the Fulton-Gibbs complex that were easily accessed.

Results indicated asbestos in the Fulton-Gibbs flooring materials and laboratory tabletops. There is no indication that the piping or ductwork in either Fulton Hall or Gibbs Hall was tested, but given the ages of the buildings, there is a high possibility that the insulation contains asbestos.

There has been no abatement effort to date to address the results of the 2021 asbestos survey.

Lead A survey for the presence of lead has not been performed on the USMMA campus. Given the ages of the buildings, there is a possibility that lead is present.

3 Project Description The purpose of this SOW is to refurbish the existing structure of the Fulton-Gibbs complex to meet anticipated minimum operating capability for the next seven to ten years. This includes, but is not limited to:

• Roof replacement

• Ensuring asbestos in the flooring has been abated;

• Installing new flooring;

• Lighting upgrades

• Emergency Shower updates

• Fume hood upgrades

• Facility painting

• Window repairs

• Installing exhaust systems in the welding and diesel labs (a mechanical study and design will be performed to direct this effort); and

3.1 Project Type

This is a Repair/Alteration project

3.2 Pre-Bid Site Visits

A pre-bid conference and site visit will be conducted for the purposes of briefing on the bid requirements and answering questions regarding this solicitation. Interested contractors are highly encouraged to attend.

3.3 Notice to Proceed (NTP)

A. The Contracting Officer is the only individual from the Government that can give the Contractor an NTP.

B. Before any work within the scope of the contract is started, the Contractor shall confer with the COR and agree on a sequence of procedures, a means of facility access, delivery of materials

3.4 Project Delivery Approach

This project will follow a design build method using a design build contractor who shall carry sole responsibility for the fulfillment of the entire design build contract. The Design- Build Contractor will be responsible for all construction services.

3.5 Standards & Criteria Documents

All items within the project’s scope of work must be designed in accordance with General Services Administration PBS P-100, Facilities Standards for the Public Building Services, including all applicable Standards, Criteria, and Guides listed therein. In the event of a conflict with P-100 and this SOW the Contractor shall confer with the COR for resolution.

3.6 Project Progress Meetings

A. Contractor shall host weekly project progress meetings, and/or presentations, with the

MARAD and primary tenant group heads as required to keep all parties apprised of the progress/status and impending activities.

B. Contractor shall prepare and distribute an agenda for each Contractor hosted project meeting, in advance of the meeting date.

C. Contractor shall provide minutes of all Contractor hosted project meetings and presentations to all attendees identifying new and unresolved old action items and associated responsible parties. Minutes must be provided within three calendar days after each meeting.

3.7 Historic Preservation

The USMMA is listed on the National Register of Historic Places. Therefore, all work shall be consistent with the Secretary of the Interior's Standards for the Treatment of Historic Properties (36 CFR part 68)

Plans for any alterations that will result in adverse effects on historic property will require consultation with the State Historic Preservation Officer (SHPO), the Advisory Council on Historic Preservation, at its discretion, and interested parties.

3.8 General Requirements

The requirements set forth in this section apply to all stages and phases of the project as described in the Scope of Services section below:

A. The Contractor must provide all necessary labor, materials, equipment, transportation, and supervision for the successful performance of all tasks in this SOW.

B. The Contractor must be qualified, licensed, and insured to perform the work required under this SOW.

C. All site access, surveys, and testing must be coordinated with the COR.

D. The Contractor must coordinate with USMMA in the creation of a project schedule.

The schedule must be sequenced so as not to impact USMMA’s academic schedule and must be coordinated with other disciplines/vendors concurrently performing work to ensure the efficient and orderly installation of each part of the work. The Contractor must submit a fully coordinated proposed schedule for review and approval by USMMA and MARAD at least ten (10) business days before commencing work.

E. The Contractor must submit all material specifications for USMMA’s and MARAD’s approval prior to commencing the work. Material specifications must include for each component the type of material, manufacturer, color selection (if applicable), and lifecycle of the proposed materials.

F. The Contractor must submit plans for removal and disposal of waste and debris to USMMA and MARAD for approval prior to commencement of the work. The Contractor must ensure all waste and debris is disposed of in accordance with all environmental rules and regulations and all local and state ordinances.

G. The Contractor must clean and secure all work areas at the end of each day.

H. All damage to existing facilities or appurtenances must be repaired or replaced, in kind, by the Contractor at no additional cost to the Government.

I. The Contractor must provide a signed warranty against damage and defective material per the manufacturer’s warranty and a minimum 2-year workmanship warranty on all work performed under this contract. All warranties must commence from the date of Substantial Completion.

J. The Contractor must ensure that all work conforms to current federal, state, and local codes, rules, and regulations.

K. The USMMA is in operation 365 days a year, 24 hours a day and must continue to be in operation during all phases of work performed under this SOW.

L. Unless notified otherwise, the contractor must assure that all invoices itemize and separately bill against separate lines of accounting work conducted solely in or on Gibbs Hall and work conducted either solely in or on Fulton Hall. In the event work cannot be reasonably differentiated as being in or on either Gibbs Hall or Fulton Hall, the work shall be assigned against Fulton Hall.

3.9 Quality Control

The Contractor must provide the Government with high quality work, assume full responsibility for quality control of all work performed by the Contractor’s team, and thoroughly review the Contractor’s written evaluations, reports, and recommendations to ensure the professional quality of the final product.

3.10 Inspections and Studies

In conjunction with the overall scope of the Fulton-Gibbs Complex Refurbishment project the USMMA will conduct three (3) separate building studies to review the overall conditions of the complex. The surveys shall be a comprehensive review of the electrical, mechanical, and structural components of the facilities. The deliverables of the studies shall be a detailed inspection report of all deficiencies along with the recommended course of action to address them. The inspection report will include photographs of the identified deficiencies and be stamped by a licensed Engineer. Finalized copies of the reports will be provided upon completion.

3.11 Swing Spaces

To support the efforts outlined in this SOW the USMMA will provide modular classrooms and existing Academy facilities as temporary office/classroom environment to allow for phasing of the project. USMMA will procure services to ready spaces for renovation (moving of furniture and equipment).

4 Statement of Work

4.1 Roofing – Fulton-Gibbs Complex

4.1.1 Design-Build Roof Replacement

A. Design The Contractor must survey the work site, determine the scope of work needed, and provide plans/methods and material options for the USMMA and MARAD to consider and approve prior to commencement of the work. The Contractor must design and build the roof such that no item on or adjacent to the roof needs to be moved or destroyed to repair and reroof the structure. The contractor shall design to allow for phasing of roof replacement.

B. Demolition and Examination The Contractor must remove the existing roof system down to the substrate and examine substrates, areas, and conditions.

C. Installation The Contractor must install the new roofing system in accordance with the government-approved plans/methods and material specifications. Installation may not begin until the substrates are dry and any and all unsatisfactory conditions have been corrected.

Roof Construction Requirements:

1. All roof decks must be properly sloped to provide for positive drainage to the drains or scuppers.

2. Drains must be sumped a minimum of 1.5 inches below the finished roof surface.

3. All curbs, pipes, and penetrations must be built to allow for a minimum base flashing height of 8 inches above the finished foam roof surface including the cricket.

4. All curbs, pipes, and penetrations must have a minimum of 18 inches separation between each other, walls, and valleys.

5. All crickets must have a minimum 2:1 length-to-width ratio and must have a slope equal to or greater than the slope of the roof.

6. All construction details must comply with PBS P-100, National Roofing Contractors Association (NRCA) and Sheet Metal and Air Conditioning Contractors’ National Association (SMACNA) construction details.

7. No water lines, conduits, or gas lines are permitted to be buried within a roof system.

8. The roof must be insulated with mechanically fastened polyisocyanurate insulation.

9. The roof must be a single-ply membrane, PIB, 100 mils, fully adhered roof.

10. The Contractor must provide roof edging and flashing around HVAC curbs and parapet walls.

4.1.2 Deliverables

4.1.3 Roof Sections

4.2 Flooring – Fulton-Gibbs Complex

4.2.1 Design-Build Floor Replacement

A. Design The Contractor must survey the work site, determine the scope of work needed, and provide plans/methods and material options for the USMMA and MARAD to consider and approve prior to commencement of the work. The Contractor must design and build the floors such that no permanently installed items need to be moved or destroyed to perform the work.

B. Asbestos Encapsulation

a. The Contractor must review the 2021 asbestos report for types of materials and locations and submit an abatement plan for review and approval by USMMA and MARAD. The Contractor must perform and coordinate all asbestos abatement activities with USMMA.

b. The Contractor must perform all necessary floor preparations, to include:

i. Necessary abatement of tile and mastic (loose and coming up) and disposal of asbestos containing materials in compliance with all applicable federal, state, and local laws, rules, and regulations governing asbestos work or the hauling and disposal of asbestos waste material, including but not limited to EPA and OSHA 3096 standards.

ii. Encapsulating remaining existing floor tile utilizing an approved method of encapsulation.

C. Flooring Installation Level all floors prior to installation of final finish. Underlayment shall be a cement based self-leveling underlayment. The underlayment shall be applied to a thickness to ensure ASTM standards are met for applied floor finish. Three types of floor finishes shall be installed. The floor types will be dependent on space type identified by the USSMA and shall be either heavy-duty epoxy applied at a minimum of ¼” thick, VCT or carpet tile.

4.2.2 Deliverables

4.3 Windows – Fulton-Gibbs Complex

4.3.1 Design-Build Window Replacement

A. The Contractor must survey the work site, determine the scope of work needed, and provide plans/methods and material options for the USMMA and MARAD to consider and approve prior to commencement of the work. The Contractor must design and build the windows such that no permanently installed items need to be moved or destroyed to perform the work.

B. Non-functioning shades shall be repaired.

C. All windows shall be cleaned internally and externally. Seals shall be replaced to prevent intrusion of dirt and bugs.

D. The Contractor must evaluate multiple alternatives for addressing the window systems applying the following hierarchy:

1. Repair the existing windows using original materials and any measures that may increase the energy efficiency of the existing windows without substantial visual change (sealing windows/window film);

2. Repair the existing windows using similar materials that will provide a similar outward appearance;

3. Replace the existing windows with new materials that will address the project needs but will remain visually similar to the existing windows;

4. Replace the existing windows with new windows.

Each option must be evaluated to determine the degree to which it meets the need for energy efficiency, the degree to which it retains the original windows and maintains the visual character of the existing windows, and the cost.

4.3.2 Deliverables

4.4 Lighting – Fulton-Gibbs Complex

4.4.1 Design-Build LED Lighting Upgrade

A. The Contractor must survey the work site, determine the scope of work needed (to include interior emergency lighting), and provide plans/methods and material options for the USMMA and MARAD to consider and approve prior to commencement of the work.

The Contractor must design and build the lighting so that no permanently installed items need to be moved or destroyed to perform the work.

B. The Contractor must provide a Lighting System Plan that includes, at a minimum, the Contractor’s methodology, inspection plans, and test and inspection procedures.

C. The Contractor must:

1. Demolish and dispose of any material removed as part of a replacement or retrofit.

2. Ensure the compatibility, safety, and applicability of the proposed lighting fixture, retrofit, or lamp with the electrical system and mounting surface.

3. Ensure all fixtures and retrofit kits are mounted securely to the mounted surfaces.

Refer to the manufacturer’s installation instructions for mounting details.

4. Ensure all electrical connections and low voltage signals are wired appropriately.

5. Ensure fixtures that are not specified to have new integrated controls, or to be connected to new automated controls, are connected to the existing lighting controls.

6. Remove all parts of old fixtures no longer in use.

7. Provide a detailed and itemized report, which includes manufacturer and model number and clearly states the quantity of each type of fixture installed.

D. The Contractor is responsible for confirming that the selected LED fixtures or lamps are eligible for utility incentives and are ENERGY STAR®-certified.

4.4.2 Deliverables

4.5 Emergency Shower/Eyewash Stations Fulton-Gibbs Complex

4.5.1 Design-Build Emergency Shower/Eyewash Stations Replacement

A. The Contractor must survey the work site, determine the scope of work needed, and provide plans/methods and material options for the USMMA and MARAD to consider and approve prior to commencement of the work.

B. The Contractor must remove and replace the existing Emergency Shower/Eyewash Stations in kind. The new stations must:

1. Be purchased and installed to comply with the latest ANSI Z358.1 American National Standard for Emergency Eyewash and Shower Equipment.

2. Be identified with a highly visible sign positioned so that it is visible within the area served by the emergency equipment.

3. Remain “on” once activated without requiring further use of the operator’s hands until intentionally closed.

4. Deliver tepid flushing fluid (moderately warm or lukewarm potable water supply). Temperatures must not exceed 100o F and must not be lower than 60o F.

5. Be made to prevent an unauthorized shutoff if shutoff valves are installed in the supply line.

6. (Eye wash stations) Provide enough room to allow the eyelids to be held open with the hands while the eyes are in the flushing fluid stream.

4.5.2 Deliverables

4.6 Ceiling Repair/Replacement Fulton-Gibbs Complex

4.6.1 Design-Build Ceiling Repair or Replacement

A. Design The Contractor must survey the work site, determine the scope of work needed, and provide plans/methods and material options for the USMMA and MARAD to consider and approve prior to commencement of the work. The Contractor must design and build the floors such that no permanently installed items need to be moved or destroyed to perform the work.

B. Asbestos Encapsulation

c. The Contractor must review the 2021 asbestos report for types of materials and locations and submit an abatement plan for review and approval by USMMA and MARAD. The Contractor must perform and coordinate all asbestos abatement activities with USMMA.

d. The Contractor must perform all necessary preparations, to include:

i. Necessary abatement of friable tile and mastic and disposal of asbestos containing materials in compliance with all applicable federal, state, and local laws, rules, and regulations governing asbestos work or the hauling and disposal of asbestos waste material, including but not limited to EPA and OSHA 3096 standards.

ii. Encapsulating remaining ceiling tile mastic.

C. Hallway Ceiling Installation

The Contractor shall remove and dispose of the 3-1/4” linear ceiling pans. The suspension system is to remain and fitted with 7-1/4” Paraline III pans. 3-1/4” pans in matching color may be installed to meet dimensional requirements.

D. Classroom Laboratory Ceilings Bare concrete ceiling shall be prepped and painting in accordance with 4.10 Painting of this SOW. Tectum ceilings shall be repaired/concealed per prescribed methods defined in 4.9.1(A) Design. Classrooms with 2’x4’ suspended ceiling systems shall be retrofitted to accept 2’x2’ Acoustical Ceiling Tiles. Office spaces with 1’x1’ ceiling shall have any loose or damaged ceiling tiles replace in-kind and painted per section 4.10.

4.7 Painting – Fulton-Gibbs Complex

4.7.1 Design-Build Painting

A. The Contractor must survey the work site, determine the scope of work needed, and provide plans/methods and material options for the USMMA and MARAD to consider and approve prior to commencement of the work.

B. Painting Requirements

1. All previously painted areas must be repainted. All articles affixed to buildings, such as hardware and light fixtures, that are removed for painting must be immediately replaced by the Contractor once painting of that area is completed. All electrical device plates must be removed prior to painting, stored carefully, and replaced by the Contractor after paint has dried. It is the responsibility of the Contractor to record areas identified during the project walk-through as NOT TO BE PAINTED. The Contractor is responsible for moving and replacing furniture if needed to access areas for painting.

2. The Contractor must:

a. Prepare all surfaces (e.g., ceilings, walls, trim) to receive paint in all hallway corridors, doors and frames, classrooms, lobbies, and offices.

b. Check all walls and ceilings for loose paint or caulking.

c. Clean walls and ceilings by wire brush or sandpaper.

d. Spot prime surfaces to be painted with block filler, if necessary.

e. Caulk all open mortar joints, expansion joints, and doorframes.

f. Repair all defects in surfaces.

g. Add scaling putty when missing.

h. Sand all metal and wood trim with 180 grit-free sandpaper by 3M Company before applying primer.

i. Strain all paint material from original containers and restrain all material left over from previous day.

j. Paint all walls per product specifications with one (1) finish coat or until properly covered. If there is a change in color, always use two (2) coats.

3. Primer must be the same color as the paint to be used and must match the texture of the existing area.

4. The Contractor must at all times maintain all staging, scaffolds, ladders, etc., in a manner that meets OSHA Safety Requirements and that does not pose a hazard to workers, USMMA personnel or attendees, or the general public. The Contractor must maintain adequate exits from all buildings and in all areas to meet Fire Marshal regulations.

5. The Contractor must protect all non-painted areas, such as scrubs, floors, glass, etc.

Upon completion of the work, the Contractor must remove all splattering and remove all paint-related rubbish from the premises. The Contractor will be held responsible for any related damages.

6. The Contractor must supply to USMMA for future use two (2) 5-gallon buckets of paint in new unopened containers identifying the brand, color, and formula. The Contractor must also supply USMMA with Closeout Documents listing all paint colors (including formulas), paint manufacturer’s warranty, MSDS (Material Safety Data Sheets), and product specification for all products used.

4.7.2 Deliverables

A. Removal/disposal plan B. Project schedule C. Plans/methods, and material options for approval by USMMA D. Closeout Documents listing all paint colors E. MSDS and product specifications for each product used F. 10 gallons of each paint color for USMMA future use G. Required warranties

4.8 Door Replacement and Repairs Fulton-Gibbs Complex

4.8.1 Design-Build Door Replacement and Repairs

A. The Contractor must survey the work site, determine the scope of work needed, and provide plans/methods and material options for the USMMA and MARAD to consider and approve prior to commencement of the work.

B. The Contractor must provide USMMA with a Door Schedule with open direction, door dimensions, and proposed hardware for all doors and frames.

C. For door replacements, the Contractor must supply and install all required jambs and doors complete with all required hardware, including but not limited to locks, self-closers, stops, sweeps, etc.

D. For door repairs, the Contractor must ensure that all doors are installed plumb and operate smoothly. The Contractor must supply and install all required hardware, including but not limited to locks, self-closers, stops, sweeps, etc.

E. The Contractor must ensure that all locks are keyed per USMMA needs.

4.8.2 Deliverables

4.9 Fume Hoods – Fulton-Gibbs Complex

4.9.1 Design-Build Fume Hoods

A. The Contractor must survey the work site, determine the scope of work needed, and provide plans/methods and material options for the USMMA and MARAD to consider and approve prior to commencement of the work.

B. The Contractor must remove, dispose of, and replace existing fume hoods identified by the Contractor (and approved by USMMA) as needing replacement with new fume hoods of equal or better quality, including fixtures and necessary ductwork.

C. The Contractor must repair existing fume hoods identified by the Contractor (and approved by USMMA) as needing repair.

4.9.2 Deliverables

4.10 Ventilation Systems – Fulton Hall – Welding & Steam/Diesel Labs

4.10.1 Design-Build Ventilation Systems

A. The Contractor must survey the work site, determine the scope of work needed, and provide plans/methods and material options for the USMMA and MARAD to consider and approve prior to commencement of the work.

B. The Contractor must design, build, and install new or replacement ventilations systems for the Fulton-Gibbs Diesel Lab and welding booths per the specifications in the Mechanical Inspection Report to be provided by USMMA.
