Section L – Instructions, Conditions and Notices to Offerors
1. Overview
1.1. This solicitation is for an Indefinite Quantity/Indefinite Delivery (IDIQ) Multiple Award Contract for Various Construction (MACC) Services for the Architect of the Capitol (AOC), Washington, D.C. with a total contract value not expected to exceed a maximum value of $250,000,000.00. This solicitation is being issued under a Two-Step Request for Proposal (RFP) format.
1.2. The Government intends to award a contract without discussions with offerors (except clarifications as described in AOC Order 34-1, Section 9.1.11). Therefore, the offeror's initial proposal should be clear and complete and contain the offeror's best terms from a price standpoint. The Government reserves the right to conduct discussions if later deemed necessary. The Government further reserves the right to reject any or all offers if such action is in the Government's best interest.
1.3. In Step 1 of the selection procedure, interested firms (referred to as “Offerors”) shall submit relevant Specialized Construction Management Experience, Key Personnel, and Past Performance demonstrating their capability to successfully execute the requirements of the proposed contract. The AOC will evaluate the qualifications in accordance with the criteria described in Section M and will short-list the most competitive Step 1 Offerors to compete for contract award in Step 2.
1.4. The short-listed Offerors will be notified by the Contracting Officer (CO), John Lingamfelter or designee.
1.5. In Step 2 of the selection procedure, short listed firms shall submit their Management Plan, Project
Controls approach, Corporate Safety Plan and Quality Control Plan and Pricing Information for evaluation.
The AOC will evaluate the submissions to determine whether they meet the requirements and standards established by the AOC.
1.6. Offerors shall send all correspondence to Contract Specialist, Matthew Hutcherson, at matthew.hutcherson@aoc.gov, and copy Contracting Officer, John Lingamfelter, at john.lingamfelter@aoc.gov.
1.7. See Attachment 8 - Original MACC RFP RFIs and Answers, for answers to offerors’ questions from the original MACC IDIQ RFP.
1.8. On the SF1442, Section B, the Contract Line Item Numbers (CLINs) begin with 0005 (Option 4), because this is an RFP for onboarding of contractors to an existing MACC IDIQ, which is as of 12/2/2024 in Option Year 3, which ends on 2/28/2025, contractors will be onboarded within Option Year 4, there are 7 Option Years within the existing MACC IDIQ.
2. General Instructions to Offerors for Step 1 and 2
2.1. Proposals shall be submitted electronically to Matthew Hutcherson at matthew.hutcherson@aoc.gov.
2.2. A virtual Pre-Proposal conference will be held Wednesday, December 11 at 10:00AM (EST) utilizing Microsoft Teams software. Offerors should RSVP to matthew.hutcherson@aoc.gov with your interest in attending the virtual Pre-Proposal conference. The RSVP must include the email addresses of those attending the conference. The attendee limit per firm is two (2)
2.3. The cut-off date and time for Step 1 Requests for Information (RFI) is 4:00PM (EST) on December 13, 2024. Final Step 1 amendments will be posted no later than (NLT) December 20, 2024.
2.4. Step 1 proposals are due NLT 5:00PM (EST) on January 9, 2025.
2.5. The Step 2 Solicitation will be issued to the shortlisted Offerors on or about March 20, 2025.

2.6. Step 2 proposals are due May 1, 2025 by 5:00PM (EST). The cut-off date and time for Step 2 Requests for Information is 5:00PM (EST) on April 3, 2025.
3. Proposal Format for Step 1 and 2
3.1. Proposals shall be submitted electrically in PDF format. Proposals shall be read-only format, using searchable PDF files, and each factor and attachment shall be bookmarked. A list of bookmarked factors and attachments required in each proposal is below.

3.2. Proposals shall have a cover page with the following:
3.2.1. Solicitation number,
3.2.2. “Step One” or “Step Two” (whichever is applicable),
3.2.3. Solicitation Title,
3.2.4. Prime Contractor Name,
3.2.5. Address,
3.2.6. Phone Number,
3.2.7. Unique Entity Identifier (UEI) & CAGE Code,
3.2.8. Point of Contact authorized to sign on behalf of the company,
3.2.9. Phone Number, and
3.2.10. Email Address of POC authorized to sign on behalf of the company.
3.3. The proposals will be 8 1/2” x 11” paper, except for fold-outs used for charts, tables, or diagrams, which may not exceed 11” x 17”. All tables, charts, graphs, figures, etc., must be legible.
3.4. A page is defined as one face of a sheet of paper containing information.
3.5. Typing shall not be less than 10 point font with 1/2 inch margins
3.6. Each page of the offeror’s proposal should contain the following legend at the bottom of each sheet:

4. Step One (1) Evaluation Criteria and Procedures
4.1. Factors 1-3 are of equal importance and weight. Factors 1 through 2 together shall not exceed 15 (fifteen) single sided pages of text exclusive of the cover page, tabs, title page, and table of contents.
4.2. Factor 1 - Specialized Construction Management Experience:
4.2.1 Offeror’s shall demonstrate their company’s ability to best serve the needs of the AOC, provide the following information on a minimum of three (3) completed projects your company led in, on or around occupied historic buildings and/or historical sites within the last ten (10) years with a project value of $5,000,000.00 or greater; at least one of these projects shall be Design/Build.
4.2.2 Projects submitted for consideration may be either commercial or Governmental and must have been for the management of multi-project/multi-discipline construction efforts.
4.2.3 Offerors are to submit only projects in which they were the prime contractor leading a multi-discipline construction and/or design team.
4.2.4 The offeror shall include the following information with each project.
4.2.4.1. Contract Number
4.2.4.2. Total Dollar Value (Original Awarded Amount and Final Amount)
4.2.4.3. Procuring Agency/Entity or Contractor
4.2.4.4. Title of Contract (i.e. Firm Fixed Price, Time & Material)
4.2.4.5. Name, address, and current telephone of contract administrator or contracting officer
4.2.4.6. Description of Project (including discussion as to its relevancy to this acquisition and list those types of work from 4.2.5.1 through 4.2.5.14 below and in the Statement of Work, which were performed as part of the contract.)
4.2.4.7. Period of Performance
4.2.5. The Statement of Work and the following list is representative of the type of work which may be included as part of this contract:
4.2.5.1. Energy Savings
4.2.5.2. Sustainable/LEED Construction
4.2.5.3. Waterproofing/Structural Repair of Foundations
4.2.5.4. Selective Demolition
4.2.5.5. Rehabilitation of Parking Garages
4.2.5.6. Code Compliance
4.2.5.7. Rehabilitation, Restoration, and Preservation of Historic Structures
4.2.5.8. Rehabilitation: defined as the process of making a compatible use for a heritage asset through repair, alterations, and additions while preserving those portions or features which convey its historical, cultural, or architectural values.
Rehabilitation acknowledges the need to alter or add to a historic property to meet continuing or changing uses while retaining the property’s historic integrity.
4.2.5.9. Restoration: defined as the process of accurately depicting the form, features and character of a heritage asset as it appeared at a particular period of time by means of the removal of features from other periods in its history and reconstruction of missing features from the restoration period. The limited and sensitive upgrading of mechanical, electrical and plumbing systems and other code required work to make properties functional is appropriate within a restoration project.
4.2.5.10. Fire Alarm and Fire Sprinkler/Systems Upgrades
4.2.5.11. Protection Systems for facilities and grounds to support security mission
4.2.5.12. Roof Replacement
4.2.5.13. Temporary Facilities
4.2.5.14. Emergency Power/Electrical Upgrades
4.3. Factor 2 - Key Personnel:
4.3.1. Provide resumes for the following key personnel positions:
4.3.1.1. Project Executive
4.3.1.2. Project Manager
4.3.1.3. Lead Site Superintendent
4.3.1.4. Quality Control Manager
4.3.1.5. Safety Manager
4.3.2. Resumes shall include the proposed key personnel's background, education and experience.
The following details the experience each key personnel must possess:
4.3.2.1. The Project Executive shall have at least 20 years’ experience working in, on or around occupied historic government and/or institutional buildings or sites with construction and design management experience in areas referenced in Section 1.4.1 of the SOW.
4.3.2.2. The Project Manager and Superintendents shall have at least 15 years of experience or 10 years of experience with a four-year (4) degree in engineering or construction management in areas referenced in Section 1.4.1 of the SOW.
4.3.2.3. The Quality Control Manager shall have at least 7 years of experience in areas referenced in
Section 1.4.1 of the SOW.
4.3.2.4. The Safety Manager shall have at least 5 years of experience in areas referenced in Section
1.4.1 of the SOW.
4.4. Factor 3 - Past Performance:
4.4.1. Although the Government reserves the right to use any source of information available on the Offeror's past performance to either evaluate past performance or verify information provided by the Offeror, the Offeror shall provide information that demonstrates the offeror's past performance. Offeror’s are highly encouraged to submit PPI for the Factor 1 projects to demonstrate recent and relevant past performance.
4.4.2. The attached AOC PAST PERFORMANCE QUESTIONNAIRE shall be provided to each of the companies/agencies submitted by the offeror in response to Factor 1 of this solicitation. The questionnaire(s) must be e-mailed by the companies/agencies to the attention of John Lingamfelter at john.lingamfelter@aoc.gov (and copy Matthew Hutcherson at matthew.hutcherson@aoc.gov) by the date established for receipt of offers in order to be considered in the evaluation process. In lieu of a Questionnaire, final CPARS evaluations for projects submitted in response to Factor 1 may be submitted in Factor 3. If Offerors elect to submit final CPARS evaluations in lieu of questionnaires, Offerors shall submit a copy of the final CPARS rating in their proposal.
4.4.3. A neutral rating shall be applied for those projects/contracts for which a questionnaire is not received.
5. Step Two (2) Evaluation Criteria and Procedures
5.1. Factors 1-4 are of equal importance and weight and significantly more important than Factor 5. However, as the difference in technical merit between the proposals becomes less significant, the relative importance of the price will increase. Factors 1 through 4 together shall not exceed twenty-five (25) single sided pages of text exclusive of the cover page, tabs, title page, table of contents, Corporate Quality Control Program, Safety and Environment Program Performance Questionnaire and Corporate Health and Safety Program. Separate tabs must be created for each factor and each Factor shall be bookmarked in PDF. Corporate Quality Control Program and Environment Program Performance Questionnaire with Corporate Safety Program will each be submitted as attachments to the Step 2 Proposal. Factor 5 - Pricing information shall be submitted in a separate PDF from the Factor 1-4 PDF submission. No pricing information shall be included in the Factors 1-4 PDF. There is no page limit for Factor 5 - Pricing Information.
5.2. Factor 1 - Management Approach: This factor shall illustrate the offeror’s ability to manage multiple projects at the same time without significant difficulty. Provide the following information in support of Factor 1.
5.2.1. The offeror’s contract management approach. The plan should reflect key management and mailto:john.lingamfelter@aoc.gov subcontractor management procedures including innovative management approaches and policies in place to ensure exceptional project management and client service.
5.2.2. Offeror shall describe the proposed IDIQ Team to address historic building façade restoration, commercial and industrial MEP, structural concrete, landscape, and design tasks which can be anticipated under this contract.
5.2.3. Offeror shall provide a plan to accomplish multiple task orders simultaneously and within compressed time schedules. Describe the plan to comply with and respond to unplanned/unscheduled Government operational requirements, to include emergencies.
5.2.4. AOC needs to have reasonable belief that an organization can hold its data safely and it will not be compromised by sending to employees without a need-to-know or in transmission between different parts of a firm’s organization or subcontractors. Provide an overview of information technology security processes, with a focus on protection measures that would be used to protect AOC’s data, for example, encryption levels, segmented data, limited access monitored, etc. Provide information on how these processes comply with FISMA / NIST SP800-53 (“Recommended Security Controls for Federal Information Systems and Organizations”) Security controls or another generally accepted auditor standard for protecting IT data.
5.2.5. Describe your company’s capabilities to meet the specific Computer Aided Design (CAD) requirements for contract deliverables as described in AOC’s A/E Design Manual.
5.3. Factor 2 - Quality Control Program: Provide your company's Quality Control (QC) program and a discussion of demonstrated experience with U.S. Army Corps of Engineers (USACE) Construction Quality Management (CQM) program. Provide evidence that Key Personnel proposed with responsibility for Quality Control have successfully completed the U.S. Army Corps of Engineers and Naval Facility Engineering Command Construction Quality Management for Contractors Training Course within the last 5 years and affirmation that individuals will maintain this certification for the life of the contract.
5.4. Factor 3 - Safety Program: This factor shall illustrate your company’s ability to comply with health and safety requirements. Offerors are to complete a questionnaire outlining their program components, incident history and training programs for the previous three (3) years.
5.4.1. The attached SAFETY AND ENVIRONMENT PROGRAM PERFORMANCE QUESTIONAIRE shall be submitted by Offeror in response to this solicitation. Note that the AOC may not accept Offerors that have incident statistics or workers’ compensation experience modification rates exceeding industry average for the Offeror's industry without written explanation acceptable to the government.
5.4.2. The Offeror shall submit a copy of its CORPORATE HEALTH AND SAFETY PLAN.
5.5. Factor 4 - Project Controls: Provide your company's processes and procedures for effective administration and management of a construction contracts’ schedule, scope, cost, and risk. Describe your company’s approach to proactively determine when a project is out of tolerance and the action(s) you would use in bringing a project back into tolerance. Include a description of your company’s methodology for risk analysis, assessment and mitigation.
5.5.1. Sub-factor 4a – E-Builder: The AOC has acquired and deployed Internet web based project management communications tool, E-Builder ASP software, to standardize construction project management processes (submittal reviews, drawing/specification reviews, RFIs, daily reports..) Describe your company's level of experience with E-Builder and ability to utilize this software on AOC projects.
5.5.2. Sub-factor 4b – Scheduling Methodology: The AOC’s scheduling software tool is Primavera (P6). Describe your experience in providing a construction progress schedule in digital CPM format, using the most current Primavera software (P6), cost-loaded and resource-loaded schedule with a related narrative and cash flow project curves. Describe your company's scheduling technique and project planning methodology to develop a logical and realistic progress schedule at pre-bid and post award. Explain how scheduling resources will be available to support the project. Describe your capabilities to schedule the complete project to ensure the work is completed within the contract duration and your experience in incorporating modifications to the contract schedule while maintaining the project end date.
Explain you utilization of the schedule as a proactive management tool throughout the duration of the project and your ability to respond in a timely manner to proposals that require Time Impact Analysis (TIA).
5.5.3. Sub-factor 4c – Building Information Modeling (BIM): Describe your company’s capabilities and experience that include citing specific examples of projects using Building Information Modeling (BIM) and Construction Operations Information Exchange (COBie).
Include specific examples of projects which included providing or supporting BIM to Facility Management (FM) efforts.
5.6. Factor 5 - Pricing Information: Rates proposed in Section B shall be submitted with Step Two proposals.
The PDF form in Section B shall be submitted in the proposal. In addition, the Offeror shall identify the individual cost elements included in the proposed Overhead rates.
