SUBJECT: Fair Opportunity Proposal Request (FOPR), Solicitation FA469020R0005, MACC Seed Project, Construct Wash Rack
NOTICE TO OFFERORS: This FOPR pertains to the Seed Project, to construct a wash rack. It is for informational purposes only. It contains information to consider when preparing your offer.
Nothing in this document is meant to be submitted with your proposal under solicitation FA469020R0005, Ellsworth MACC, that is not already included in Section L, Instructions to Offerors. This FOPR is representative of the process of awarding construction projects under the Ellsworth MACC IDIQ. The Air Force intends to award the seed project covered by this FOPR, based on availability of funds, to the successful MACC contractor that offers the Lowest Price for the Seed Project. You have to be awarded a MACC IDIQ before you can be awarded the seed project. The seed project may be awarded anytime during the acceptance period offered in Block 17 of the SF 1442. The Air Force requests offerors provide a minimum of 180 days acceptance period after the date offers are due.
1. Proposal Submission Instructions.
1.1 This is a FOPR for subject project to be awarded on a fair opportunity basis pursuant to Federal Acquisition Regulation (FAR) 16.505 ordering procedures, the terms and conditions of the Ellsworth AFB MACC 5.0 solicitation and resulting contracts, and the specific requirements outlined in this request with attachments.
1.2. All proposals must be received by the 28th Contracting Squadron in response to solicitation FA469020R0005 by date and time specified in block 13.a. of the SF1442.
1.3. For this FOPR, we will use the cover letter identified in Section L and the proposal acceptance period you identify in block 17. The rest of this paragraph is for informational purposes only and is representative of a FOPR that will be used to solicit and evaluate individual task orders under the MACC IDIQ. Your proposal must include a cover letter stating a proposal acceptance period of at least the minimum amount required in block 13.d of the SF1442. Proposals offering less than the minimum calendar days required will be deemed unacceptable. The cover letter shall be submitted on company letter head that includes the company name, address, and a specific point of contact (POC). The cover letter shall also acknowledge all amendments to the FOPR.
2. Solicitation and Project Specific Information.

2.1. A site visit is scheduled for 28 Sep 2020 at 0900 and 29 Sep 2020 at 0900. A request to attend the site visit must be sent to Lt Olson at maxwell.olson.1@us.af.mil no later than 1500 on 23 Sep 20 and must include a preferred day (28 or 29 Sep). Late requests will not be accepted. The request shall include number of people you are requesting to attend, name, address, driver license number and issuing state, and date of birth of each attendee. Due to COVID restrictions, offerors are requested to limit attendees to essential personnel only, NTE 4 per offeror. The request does not guarantee a reservation for the preferred date, or number of attendees. A confirmation email will be sent to confirm date and attendees. All personnel at the site visit must comply with base policy by wearing a face covering.
2.2. Questions and Answers: Contractors are cautioned that all communications are to be channeled through the Contracting Officer. Any questions whether technical or contractual in nature shall be submitted in writing. Questions may be submitted in writing to the Contract Specialist (CS) at maxwell.olson.1@us.af.mil AND Contracting Officer (CO) at roger.morris.7@us.af.mil by 3:00 PM (Mountain Standard Time), (Friday 16 October 2020). Questions will be consolidated and responses will be forwarded to all Contractors. No further questions will be addressed on this project after this date.
2.3. All personnel requesting access to Ellsworth Air Force Base must possess a valid state or Government picture identification card. Furthermore, individuals presenting identification cards from a state that is non-compliant with the REAL ID Act will require additional documentation to gain unescorted base access. Additional documentation include a valid U.S. or foreign government issued passport, an employment authorization document that contains a photograph, or identification cards issued by federal state or local government agencies that include a photo and biographic information. 2.4. This FOPR is not authorization to begin performance, and in no way obligates the Government for any costs incurred by the offeror associated with developing a proposal. The Government reserves the right not to award an order in response to this FOPR. Prior to commencement of any activities associated with performance of this requirement, the Government will issue a written directive or contractual document signed by the Contracting Officer with appropriate consideration established.
2.5. Period of Performance for construction is 180 calendar days.
2.6. Funds are presently not available for this effort. No award will be made under this FOPR until funds are available. The Government reserves the right to cancel this FOPR either before or after the closing date. In the event the Government cancels this FOPR, the Government has no obligation to reimburse an offeror for any costs.
2.7. Magnitude of Construction is between $500,000.00 and $1,000,000.00.
2.8. Performance and payment bonds are required and will be submitted prior to issuing a Notice to Proceed or commencement of work. Bid bonds are not required.
2.9. Liquidated Damages in the amount of $293.23 per calendar day are applicable to this project.
2.10. Contractors shall use Wage Determination SD 2020027 Building Meade. Performance under the resulting task order will require compliance with this wage decision.
2.11. The following clauses, in addition to the IDIQ clauses, will be included in this order: none.
3. Evaluation Factors.
3.1. The selection methodology for award of this task order will be made to the Awardee proposal that is the lowest priced technically acceptable as defined in Attachment 2 paragraph 4.1 and pursuant to the proposal evaluation criteria as outlined in Section M-900. The Government intends to award a single Firm Fixed Price task order for the subject project.
