This document is a set of Requests for Information (RFIs) and responses regarding a Job Order Contract (JOC) Multi-Award Indefinite Delivery Indefinite Quantity (IDIQ) solicitation, AOCACB24R0002, issued by the Architect of the Capitol.
The JOC IDIQ will be a multiple-award contract for a variety of maintenance, repair, alteration, mechanical, electrical, HVAC, demolition, painting, paving, earthwork, and historical preservation/restoration projects within the United States Capitol Complex and other outlying facilities. The work may involve design-build projects as well as new construction. Offerors must submit technical proposals and pricing for a sample project, which will not be awarded. Job Order Contract (JOC) Multi-Award IDIQ Solicitation AOCACB24R0002 Requests for Information & AOC Responses
No. Drawing No. / Spec Section Reference Question AOC Response
Will there be a site visit scheduled for the JOC Multi-Award IDIQ solicitation? The AOC does not anticipate conducting site visits for the JOC IDIQ.
Will there be a pre-bid site visit or PPC? See RFI # 01.
Do you anticipate a pre-proposal conference for this effort? And if so, do you have a date in mind? I do not see any mention of that in the existing documents and/or SAM.gov notice, so wanted to clarify and make sure we are present if you have one.
A pre-proposal conference is not planned for this IDIQ Solicitation.
Will there be a pre-proposal conference and/or site visit? I did not see a date for either mentioned in the documents.
See RFI # 01 & RFI # 03.
We were wondering if there is a list of acceptable third-party assessors for the Information Technology security listed in 4.3.4? Also, if an entity is in the process of FedRAMP certification, would that be satisfactory?
SOW.1.10 "Information Security" has been revised and shall read as follows:
“Contractor shall implement protection measures to protect AOC’s data, for example, encryption levels, segmented data, limited access monitored, etc. that comply with FISMA /NIST SP800-53 (“Recommended Security Controls for Federal Information Systems and Organizations”) Security controls or another generally accepted auditor standard for protecting IT data.”
Sections L.4.3.4 has been revised and shall read as follows:
“AOC must have confidence that an organization can hold its data safely and it will not be compromised by sending to employees without a need-to-know or in transmission between different parts of an Offeror’s organization or subcontractor. Provide an overview of information technology security processes, with a focus on protection measures that would be used to protect AOC’s data, for example, encryption levels, segmented data, limited access monitored, etc. Provide information on how these processes comply with FISMA / NIST SP800-53 (“Recommended Security Controls for Federal Information Systems and Organizations”) Security controls or another generally accepted auditor standard for protecting IT data.”
"Attach 13 - Order 7-4 Information Technology Security" is now being provided for reference only. The contractor will neither be granted direct connection to the AOC system/network nor hosting an information system on behalf of the AOC under this IDIQ.
On Page 1, #13b of the solicitation it states a Bid bond is not required but on page 14b of the of the solicitation it states a Bid bond is required. But there is no way to request a bid bond if there is not a sample project to price, on sam.gov there is a Word document titled “sample project” but it is blank.
IAW Attachment 2 para 4.6.2 the sample project is for pricing purposes only and will not be awarded. An offeror guarantee (bid bond) is not required.
When future task order RFPs are issued if a bid guarantee is required it will be annotated accordingly at the task order level.
7 Will there be a pre-proposal conference for this solicitation? See RFI # 03.

It places a large burden on our clients to ask for repeated PPQ’s when a project has previous similar forms completed. Even though it is a requirement for CPARS to be completed for all projects, that requirement is not always upheld. Some projects do not have CPARS issued on them for a variety of reasons from COR reassignments mid project, security features of the work complete or facility completed in or plain and simple that the client never got around to completing it and we don’t want to nag them to do so. May the gov’t please consider allowing for previously completed Past performance Questionnaires to be provided?
See RFI # 36.
May climate control facility projects count or must it be a climate control book storage facility? Submitted past performance projects shall meet the SOW.1.4 Scope.
The current page count is 35 pages for Factor 1 – 4 is 35 pages total. The RFP requests 3 projects write ups;
6 resumes; a Management Approach that includes over 3 topics and 28 sub-topics which includes a Corporate Quality Control Plan and a Safety Program with full Safety Questionnaire and safety performance records along with the Corporate Health and Safety Program. This page limitations will place restrictions against offerors ability to properly describe project experience, the project management systems, key personnel qualifications and experience and quality control, safety and risk management. May the government please consider expanding the page count to 60 pages or considering removing the page
An increase in page count will not be made. Please reference RFI # 93 response.

AOC52.215-2, (a) states “Any prospective offeror desiring an explanation or interpretation of the solicitation, drawings, specifications, etc., must request it in writing no later than 14 calendar days prior to the date established for receipt of offers”, which indicates that should be submitted in writing no later than March 26, 2024. AOC52.215-2, (b) states “Prospective offerors shall request the Contracting Officer, in writing, interpret or correct any ambiguity, inconsistency or error in the contract documents which may be discovered, or which should have been discovered, by a reasonably prudent offeror. Such requests or objections to materials or methods of construction shown or specified shall be directed to the attention of the Contracting Officer at least 15 calendar days prior to the date specified for receipt of proposals”, which indicates that Requests for Information should be submitted in writing no later than March 25, 2024. Section L, 2.2. states “The cut-off date and time for Requests for Information (RFI) is 5:00PM (EST) on March 11, 2024.” Please clarify the final due date for Requests for Information.
Ref Attachment 2 Para 2.2.
Will the Government allow an additional RFI period of at least two days post-RFI responses to allow time for Contractors to ask any resulting follow-on questions?
An extensive list of RFIs have been submitted and responses provided. A modification to the IDIQ SOW to incorporate D/B will be accomplished and a period to allow for RFIs specific to the D/B scope may be allowed for when the amendment incorporating the D/B scope is posted.
Section L.4.6.2 states the Construction Documents (CDs) for the Sample Project will be provided to the offeror upon signing the enclosed AOC’ s “Non-Disclosure Agreement for Contract Employees (Sensitive but Unclassified Info)”. Will the AOC please direct offerors to the location of the NDA or otherwise provide the document needed to obtain the documents?
Please refer to the “Description” section within the notice on SAM.gov and ref Attachment 2 para 4.6.2.
Attachment 2, Section L, 4.6.2 states “The Construction Documents (CDs) for the Sample Project will be provided to the offeror upon signing the enclosed AOC’s “Non-Disclosure Agreement for Contract Employees (Sensitive but Unclassified Info)”, but it does not appear that this NDA has been provided, and Attachment 5, Sample Project is intentionally blank. If the final due date for Requests for Information is March 11, 2024, would the Government consider extending that due date to allow time for questions regarding the Sample Project?
See RFI # 112 & # 113.
Regarding the signing of AOC’ s “Non-Disclosure Agreement for Contract Employees (Sensitive but Unclassified Info)”, is it acceptable for an officer of the company to sign on behalf of all company employees?
Yes as long as they are authorized to sign on the company's behalf.
SF1442, 13.b indicates that an Offer Guarantee is not required, but page 14 of 71 AOC52.228-1, (a) indicates that an Offer Guarantee is required. Please clarify if an Offer Guarantee is required in the proposal submission.
See RFI # 06.
SF1442, 13.a indicates states “sealed offers in original and 1 copy to perform the work required are due at the place specified in item 8 by 17:00 ET local time 04/09/2024”, which infers a hard copy submission.
Attachment 2, Section L, 2.1 states that “Proposals shall be emailed to the Administrative Contracting Officer, Laurie Harvey at laurie.harvey@aoc.gov and the Contract Specialist, Renko Hardison at renko.hardison@aoc.gov” and “Hard copy proposals mailed to or dropped off at the AOC will not be accepted or reviewed.” Please confirm that proposals are to be submitted electronically via email to the Contracting Officer and Contract Specialist noted above.

Attachment 2, Section L, 4.3.6.2. Scheduling Methodology states that “The AOC’s scheduling software tool is Primavera (P6).” Attachment 4, Division 01 JOC Specs, 1.05 Baseline Schedule, C states “The Baseline schedule shall be generated using Critical Path Methodology (“CPM”) using the latest version of Primavera scheduling software (P6 or better).” Will the Government accept schedules made using Microsoft Project in lieu of P6 if they are generated using Critical Path Methodology?
No. RFP requirements to remain unchanged.
Factor 4 – Safety Program, 4.4.2. also states “The Offeror shall submit a copy of their Corporate Health and Safety Plan. The plan shall include Corporate Safety Personnel and Safety and Health Program and demonstrate compliance with Sections 1.11 and 1.16.6 of the SOW.” Attachment 6, Safety Program Performance Questionnaire #6 asks Contractors who have a written occupational safety and health program to provide a copy of their health and safety program. If a Contractor’s written occupational safety and health program is extensive (660+ pages) and therefore a very large-sized file, will the Government accept an excerpt of fewer pages that provides an overview of the program instead of submitting the entire large file, provided that the full manual be available upon request?
No. Please Ref Attachment 2 para 2.1 for how to submit files in excess of the restriction.
Past Performance, 4.5.3. states “In lieu of relevant and recent CPARS information, the enclosed ‘Safety Program Performance Questionnaire’ shall be provided to each of the companies/agencies submitted by the Offeror in response to Factor 1 of this solicitation. The questionnaire(s) must be e-mailed by the companies/agencies to the attention of Renko Hardison at renko.hardison@aoc.gov by the date established for receipt of offers in order to be considered in the evaluation process. Past Performance Questionnaires included in the proposal or submitted directly by the Offeror will not be accepted nor evaluated. Past Performance Questions shall be submitted directly by the individual completing the Questionnaire. Offerors shall state they have no relevant and recent CPARS records when Past Performance Questionnaires are submitted. Please confirm that Past Performance Questionnaires satisfy Factor 5 – Past Performance, requirement 4.5.3. and that the Safety Program Performance Questionnaire is not required for this factor.

The Statement of Work, page 6 of 8, 1.16.6 requires that the proposed Safety Officer has “completed EM 385-1-1 Construction Safety Hazard Awareness Course for Constructors and USACE Quality Management for Contractors certifications. A certificate is considered current for 5 years from the date of training completion.” As an EM 385-1-1 Training Certificate issued by OSHA does not expire, please confirm that a Safety Officer who has completed this training more than 5 years ago meets this requirement provided that they have completed at least 8 hours of refresher training each year since they obtained their certification.
RFP requirements to remain unchanged. The paragraph refrences OSHA Competent person training that shall be maintained through at least 8 hours of documented safety & health related coursework every year. Also, see specification 013000 CONSTRUCTION SAFETY

The Statement of Work, page 6 of 8, 1.16.6 requires that the proposed Safety Officer has completed EM 385- 1-1 Construction Safety Hazard Awareness Course for Constructors. Will the Government accept a proposed Safety Officer who has not yet completed EM 385-1-1 training before proposal submission provided that they complete EM 385-1-1 training before contract award?

Factor 2 – Key Personnel, 4.2.2. and the Statement of Work, 1.16 Key Personnel state that copies of required certifications for the Quality Control Manager, Alternate Quality Control Manager, and Safety Officer be included in the proposal submission. Will copies of these certifications be counted towards the 35-page limit of Volume I – Technical?
Attachment 2 para 3.1 has been updated. Submitted certifications are excluded from page count.
In the solicitation document, paragraph B.1 Pricing Instructions and Information Overview states, “The Schedule (Items 0001 through 7002) requires submission of the Contractor’s overhead rate and profit rate attributable to the performance of this contract for the entirety of the contract (one, one-year base contract and seven, one-year options) including the *6-Month optional period as detailed in Contract Clause 52.217-
8. The inclusion of the 6-month option is for evaluation purposes only and shall not be construed as a guarantee the 6-month option will be exercised.” Items 0001 through 7002 do not appear to include the six-month option period. Please clarify how offerors are to price the 6-month option.
The 6-Month optional period will be based on the pricing from Option Year 7.
52.216-1 states, “The Government contemplates award of a Firm Fixed Price/ Time and Materials contract resulting from this solicitation.” However, it is our understanding that offerors are not providing hourly labor rates at this time. Please clarify what the basis of a time and materials task order award would be.
Task orders issued under the IDIQ will allow for Firm Fixed Price and Time and Material.
Ref SOW para 1.5.
52.216-1 states, “The Government contemplates award of a Firm Fixed Price/ Time and Materials contract resulting from this solicitation.” Under what circumstances does the government anticipate making a time and materials task order award rather than a firm fixed-price award.
When task order RFPs are issued the contract type will be identifed at the task order level and proposals provided accordingly. The majority of the awards will be Firm Fixed Price.
Section L clearly states that the sample project “is for pricing purposes only and will not be awarded.” Page 14 of the solicitation references the award of the seed project. Please confirm that the sample project will not b d d
Confirmed.
Section M paragraph 2.9.1.1 states in part, “The overhead rate proposed in the Section B Price Schedule shall include all field and home office and Key Personnel overhead rates. For an example of allowable overhead elements, see contract clause AOC52.243-1 Changes Supplement (July 2022), para. (d).” This indicates that personnel – which could vary significantly depending on the size, scope, complexity, security, location, etc. of a task order – are to be included in the fixed maximum overhead rate.
