ATTENTION ALL BIDDERS:

Please be advised Questions are to be submitted by March 24, 2025 2:00pm Local Time via eMMA. Any questions received after this date are not guaranteed to be answered.

The following questions have been received in regard to this solicitation:

Q1. Column A on your bid form states "required item." Does this mean we're required to bid every line?

A1. Bidders are to provide the information requested on Appendix 1 – Bid Form for the products they are able to provide per the specifications. The Appendix has been updated to

Appendix 1 – Bid Form REVISED 3/21/25.

Q2. If we are not utilizing subcontractors, is this form still necessary to submit

(Attachment P)?

A2. Attachment P is required per the State’s reporting requirements. Should subcontractors not be utilized, indicate as such on the Attachment.

Q3. I found BPO 001B4600021 and BPO 001B4600021(sic) via Google search. Are these the current agreements? I noticed that they expired 12/31/2024.

A3. BPO 001B4600021 has been extended through June 30, 2025; BPO 001B4600027 has neem extended through August 1, 2025.

Q4. Due to recent tariffs, we would like to file an exception and add the attached language. Please note: If a tariff is imposed during the term of this agreement, the affected party shall have the right to adjust the prices of goods or services accordingly to reflect the impact of such tariff. The Seller shall provide the necessary documentation to substantiate these changes and shall collaborate with the purchaser to negotiate a fair and equitable price adjustment.

A4. Pricing adjustments shall adhere to the provision stipulated under Exhibit 1 – Commodity

Supplemental, Paragraph 3. Price Escalation.

Q5. Could you please confirm that the pricing submitted must be firm for the contract period (three years) and that there is no option for adjusting it at any point?

A5. Please refer to the IFB, Sections 2. Contract Requirements: Scope of Work, 2.1 Summary

Statement and Exhibit 1 – Commodity Supplemental, Paragraph 3. Price Escalation.

Q6. In the instructions of the Bid Form, it is required to fill out the Bidder Information

Tab, however, No such tab exists. Please clarify this requirement.

A6. This has been updated. Attachment F – Bidder Information Sheet shall be completed with bid submission.

Q7. The links in the ITB for required attachments don’t seem to be working. I found most of them on the state website, but attachments L, M & N (reference checks, list of state contracts & legal action summary) aren’t on the site. Can you please assist?

A7. The links are currently working.

Attachment L: https://procurement.maryland.gov/wp-content/uploads/sites/12/2024/07/Attachment-L.-Reference-Checks.pdf

Attachment M: https://procurement.maryland.gov/wp-content/uploads/sites/12/2024/07/Attachment-M.-List-of-Current-or-Prior-State-

Contracts.pdf

Attachment N: https://procurement.maryland.gov/wp-content/uploads/sites/12/2024/07/Attachment-N.-Legal-Action-Summary.pdf

Q8. I need to know how to deal with alternate container sizes. For example, if the product

I am bidding does not come in 5-gallon pails as you are requesting, but does come in an alternate container size such as a 2.5-gal jug, or other container, where can this information be provided on the Appendix 1 Bid Form? Thank you.

A8. Appendix 1 – Bid Form has been updated. Should the Unit of Measurement (UOM) requested not be available, provide the closest UOM to the requested product in Column J

– Alternate UOM. Be sure to use Appendix 1 – Bid Form REVISED 3/21/25.

Q9. Does The State of Maryland accept the full bid by choosing the bid which all products are added up by the price x 100 units and find the lowest bidder inclusive of all products? Or, pick and choose products by different bidders and give to those lowest bidders?

A9. This is a multiple award IFB. Please refer to section 2. Contractor Requirements: Scope of

Work, 2.1.2 and Section 4.21 Bid Evaluation Criteria and Award Basis.

Q10. Is the 3 year base period, with two one year option periods, meaning first year completed fully and the last two years are optional? Or, 3 years must be accepted if bid and possible 2 year extensions after the completion of 3 years?

A10. The contract is a three (3) year base period with two (2) 1-year options. Please refer to the

Key Information Summary Sheet.

Q11. Is there the ability to put in an addendum that if there are industry price increases over a certain % the bidder can provide accurate information reflecting the increases and raise the price to The State of Maryland by that % to complete the bid term. If not exactly in this manner, what is acceptable?

A11. Please refer to Sections 2. Contract Requirements: Scope of Work, 2.1 Summary
