About this file
This is Addendum #08 to Request for Proposal 484-26 issued by the State of New Hampshire Division of Procurement and Support Services for Energy Performance Contracting Services. The addendum, dated April 8, 2026, modifies the vendor question response deadline from April 8, 2026, to April 10, 2026. The bid closing remains scheduled for April 16, 2026, at 12:00 PM. The addendum provides clarifications and requested changes to three key contract sections: Contract Price/Price Limitation/Payment, Limited Warranty & Disclaimer, and Force Majeure provisions. All changes noted in this addendum supersede previously submitted documents and must be included with bid submissions, while all other specifications remain unchanged and valid.
The addendum addresses critical contractual terms regarding liability limitations, warranty disclaimers, and force majeure protections. Specifically, it modifies language to clarify that neither party shall be liable for consequential, exemplary, special, incidental, reliance, or punitive damages, with liability capped at total fees paid, and establishes that the contractor's warranty obligation extends for one year following the completion date with the state's sole remedy being a refund for deficient work. The force majeure clause exempts the contractor from performance delays or failures resulting from acts of God, natural catastrophes, labor disputes, governmental acts, utility service interruptions, equipment failures from manufacturing defects, and other causes beyond reasonable contractor control. Respondents must acknowledge receipt of all addendums with their bids and consult the complete RFP documentation for comprehensive details on evaluation criteria, technical requirements, and financial parameters.
