This document contains the Mandatory Minimum Requirements for a Request for Proposals issued by the Utah State Board of Education (USBE) for Utah Driver Education Online Scheduling Software, Solicitation # USBE-SD26147-RFP. The RFP seeks qualified offerors to provide cooperative contracts for driver education online scheduling software that enables customers to register for classes, sign custom contracts, make payments, schedule drive times, receive text message reminders, and access teacher feedback. The solicitation is anticipated to result in multiple contract awards for compliant solutions. The RFP is issued in accordance with the Utah Procurement Code and applicable Utah Administrative Code provisions, with the USBE serving as both the issuing and conducting procurement unit.

The nine mandatory minimum requirements that offerors must meet include: responding to all questions; providing a working driver education online scheduling software platform at contract start; guaranteeing all customer data storage, processing, and backup within United States physical borders; ensuring customers retain full ownership and control of their data; providing a mechanism for customers to retrieve data in standard format upon request; protecting student-level data in compliance with USBE standards, FERPA requirements, and the USBE Employee Non-Disclosure Agreement; ensuring all deliverables comply with Sections 504 and 508 of the Rehabilitation Act and WCAG 2.2 AA standards; submitting three signed letters of recommendation from existing clients with contact information; and addressing End User Agreement requirements or providing documentation confirming none will be required. Any proposal failing to meet these non-negotiable, objective criteria will be deemed non-responsive and disqualified.

MANDATORY MINIMUM REQUIREMENTS

USBE - Utah Driver Education Software

Solicitation # USBE-SD26147-RFP

Instructions:

The mandatory minimum requirements are non-negotiable, objective criteria that must be met for a proposal to be considered responsive. If at any time it is determined that a proposal does not meet these requirements, the proposal will be deemed non-responsive and disqualified.

Offerors must demonstrate the ability to meet or exceed the mandatory minimum requirements by providing a response to each requirement.

Offerors MUST submit a document indicating your intent to comply with each of these mandatory minimum requirements and include any documentation or narratives requested within the mandatory minimum requirements. Only include additional narratives or documents that are requested or help clarify your answers.

Preferred format: Your document should include the Mandatory Minimum Requirement number and question with your response. Additional narrative or additional documentation being attached should be noted clearly as to what Requirement number it refers to.

Example Response: “MMR #1: Offeror MUST respond to all questions, unless marked optional. Do you understand and agree to comply with this requirement?” then answer “yes” or “no” as well as any other narrative, if requested. If attaching other documentation, if requested, indicate with “See attached document titled “name of document” for additional information on MMR #1.”

Mandatory Minimum Requirements (MMR):

1. Offeror MUST respond to all questions, unless marked optional. Do you understand and agree to comply with this requirement?

2. Offeror MUST be able to provide a working driver education online scheduling software platform at the start of the contract, if awarded. Do you understand and agree to comply with this requirement?

3. Offeror MUST guarantee that all customer data, including but not limited to user information, transactional data, and configuration data, will be stored, processed, and backed up solely within the physical borders of the United States at all times. See the Scope of Work: Data and Privacy section for additional information. Do you understand and agree to comply with this requirement?

4. Offeror MUST ensure the customer retains full ownership and control over all data stored in the SaaS platform. The Offeror must not use or access the customer's data for any purpose other than to provide the agreed-upon services. Do you understand and agree to comply with this requirement?

5. Offeror MUST provide a mechanism to allow the customer to retrieve all data in a standard format upon request, whether at the termination of the contract or during the lifecycle of the agreement. Do you understand and agree to comply with this requirement?

6. The successful Offeror MUST protect all student-level data in a manner approved by USBE and consistent with USBE's Standard Terms and Conditions, which are attached to this RFP in the Files section. You must also comply with all applicable FERPA requirements and must complete and sign a USBE Employee Non-Disclosure Agreement if awarded a contract. Do you understand and agree to comply with these requirements?

7. All deliverables and work completed under the contract resulting from this RFP that may be distributed to LEAs, schools, the public, or posted on the USBE website, must be compliant with Sections 504 and 508 of the Rehabilitation Act, as amended for the Workforce Investment Act of 1998 and WCAG 2.2 AA. Do you understand and agree to comply with this requirement?

8. Offeror MUST provide three signed letters of recommendation from clients who have implemented your proposed solution. Letters should be detailed enough to provide the evaluation committee with concrete information regarding the client’s experience with your company and solution and demonstrate your ability to deliver your proposed solution. You must also include contact information for each client. USBE reserves the right to contact clients for additional information. Do you understand and agree to comply with this requirement?

9. This solicitation will result in one or more Co-Operative contracts. The USBE Standard Cooperative Terms and Conditions includes a section for Cooperative Terms/End User Agreements. If Eligible Users, as defined in the terms and conditions document, will be required by an awarded Offeror to sign an End User Agreement before participating in the resulting contract, then a copy of the End User Agreement that will be used must be uploaded in Section

4.1 under Requested Information. If no End User Agreement will be required, the Offeror must upload a document indicating there will be no End User Agreement required by Eligible Users to participate in the resulting contract. Offeror must ensure the End User Agreement adheres to the requirements and terms and conditions listed in this RFP. Any language included in an End User Agreement that conflicts with a resulting contract awarded to the Offeror shall be null and void. Do you understand and agree to comply with this requirement?
