About this file

This is a GRAMA Business Confidentiality Claim form issued by the Utah State Archives Office of the Government Records Ombudsman for use by contractors and private providers submitting information to governmental entities. The form allows claimants to identify records or information they believe qualify for protected classification under Utah Code 63G-2-305 and 63G-2-309, specifically trade secrets and commercial financial information that could result in unfair competitive injury if disclosed. The Utah State Board of Education issued this document in connection with Solicitation # USBE-SD26147-RFP for Utah Driver Education Online Scheduling Software, which seeks qualified offerors to provide software solutions enabling customers to register for driver education classes, sign custom contracts, make payments, schedule drive times, receive text message reminders, and access teacher feedback. The RFP is designed to result in multiple contract awards for solutions complying with the stated requirements, with the software to be made available to Utah local education agencies and charter schools.

The confidentiality claim form requires submitting companies to provide detailed claimant information, including company name, address, representative contact details, and a concise statement of reasons supporting the confidentiality claim. Claimants must specify which pages and paragraphs of submitted records require protection and indicate whether a public redacted copy is being provided. The form clarifies that making a confidentiality claim does not guarantee protected classification status if the governmental entity receives a subsequent public records request under GRAMA. This protective mechanism allows bidders to submit sensitive business information, trade secrets, and competitive financial data with the understanding that such material may receive statutory protection from public disclosure.

Business Request for GRAMA Business Confidentiality Claim use by contractors or private providers to identify protected records or information

Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected.
