About this file

This document is a modification to an existing solicitation. The purpose of this amendment is to answer contractor questions and provide the site visit attendance roster. Key details include:

The solicitation is for the Vail-Tortolita Double-Circuit 230-kV Transmission Line Rebuild project, issued by the Department of Energy Western Area Power Administration (DOE/WAPA). The amendment provides responses to questions on topics such as bonding, disadvantaged business enterprise requirements, proprietary items, controlled unclassified information, past performance submittal requirements, and geotechnical data. It also attaches the site visit attendance roster. The solicitation has an unrestricted status with no DBE requirement, but there are DOE small business subcontracting goals. Past performance questionnaires are due by May 2, 2024. The amendment does not contain a Performance Work Statement or detailed objectives, but rather focuses on clarifying solicitation requirements.

Amendment 0002

The purpose of this amendment is to answer contractor questions and add the site visit attendance roster.

A. Contractor questions and answers are provided as follows:

Question 1: Will the Owner Furnished material $ need to be included in the bonding?

Answer 1: The owner furnished material will not be included in the bonding. The bonding for this solicitation will be the penal amount of the performance bond at 100% of the original contract price and 100% of any contract price increases.

Question 2: It is our understanding that this project is completely "Unrestricted", does that mean that there will be no requirement for % to be completed by DBE?

Disadvantage business enterprise

Answer 2: Yes, this solicitation was issued as “Unrestricted.” We believe your referring to the Disadvantaged Business Enterprise (DBE) program. This is a program the U.S.

Department of Transportation offers. This program does not apply to this solicitation.

The Department of Energy (DOE) does have subcontracting goals for the participation of small business, small disadvantaged business and small women owned business. Please review Attachment Q – Current Subcontracting Plan Template for percentages.

Question 3: Per the Solicitation doc. the only item we can see that needs to be submitted prior to the RFP due date is the Past Performance Questionnaire. Are there any other requirements or submittals that are required?

Answer 3: The Past Performance Questionnaire is the only document that is due prior to the RFP due date.

Question 4: We have sent out (3) questionnaires to previous customers is that sufficient.

Answer 4: The Past Performance Questionnaire is optional and there is no requirement to the number of questionnaires needed for this solicitation.

Question 5: Please identify which items are required from a proprietary manufacturer or specific model on this project. If there are any, please provide the Justification and Approval documentation for this and identify three viable manufacturers for each of the identified proprietary items for the contractors to contact to receive competitive quotations.

Answer 5: Contractor-furnished material requirements are specified in the Project Specifications, Project Drawings, and Construction Standards located at the website shown in Division 1 of the Project Specifications:

https://www.wapa.gov/DoingBusiness/SellingToWestern/Pages/what-western-buys.aspx

Question 6: Please confirm that there is no “Controlled Unclassified Information” (CUI) within the plans and specifications for this solicitation.

Answer 6: There is no “Controlled Unclassified Information (CUI)” within the plans and specifications for this solicitation.

Question 7: Attachment A – Section L, bottom of page 3 states, “The Department of Energy (DOE), Western Area Power Administration (WAPA), and Desert Southwest (DSW) may also use the Contract Performance Assessment Reporting System (CPARS) to determine the offeror’s past performance.” Can contractors use a completed CPARS evaluation or a previously filled out PPQ, which includes all the relevant information required on the Attachment S PPQ form, in lieu of submitting the attached Past Performance Questionnaire?

Answer 7: It’s not necessary to submit a completed CPARS evaluation as WAPA already has access to the system to retrieve the evaluations. Previous filled out PPQ’s will not be accepted as those questionnaires are not specific to this requirement.

Question 8: On Attachment R, Past Performance Cover Letter, we see that it states, “Past Performance Questionnaires MUST be received by May 2, 2024.” We don’t see this instruction in the RFP. Can you confirm the correct date that PPQs are due?

Answer 8: The date in Attachment R - Paster Performance Cover Letter is correct. All Past Performance Questionnaires must be received by May 2, 2024.

Question 9: Is WAPA able to provide typical foundation drawings?

Answer 9: Foundation details are provided in the Project Specifications and Project Drawings as well as the Standard Drawings located at the website shown in Division 1 of the Project Specifications:

https://www.wapa.gov/DoingBusiness/SellingToWestern/Pages/what-western-buys.aspx.

Question 10: Is WAPA able to provide staking sheets that list the foundation types, diameters, and depths?

Answer 10: Foundation details are provided in the Project Specifications and Project Drawings.

Question 11: May WAPA provide a PNP file that lists the structure types and locations of existing structures?

Answer 11: Existing structure types and location maps are provided in the Project Specifications and Project Drawings.

Question 12: May WAPA provide comprehensive soil borings that show soil strata and type over the course of the project route in addition to the current document that is based on a towed seismic array and sledgehammer and metal plate soundings and readings from the seismic microphones?

Answer 12: Geotech reports obtained by WAPA are provided in Attachment I and Attachment J. WAPA will not obtain additional geotechnical data.

Question 13: Can WAPA clarify who would be responsible for the relocation/mitigation of the following plant species in the instance they impede construction activities?

Project Specifications Division 13 Section A.5.b.(6)

“Contractor shall avoid impacts to paniculate agaves (Agave palmeri, A. parryi, and A.

chrysantha), and saguaros (Carnegiea gigantea) within work areas. If the presence of paniculate agaves or saguaros impedes construction activities, the Contractor shall notify the COR and seek approval before continuing work.”

Project Specifications Division 13 Section A.5.b.(7)

“The Contractor shall not impact Pima pineapple cactus (Coryphantha scheeri var.

robustispina) during construction activities. If the presence of Pima pineapple cactus impedes construction activities, the Contractor shall notify the COR and seek approval before continuing work.”

Answer 13: WAPA and TEP are working to mitigate the known occurrences and impacts to special status plant species in advance of construction. TEP is addressing saguaro conflict activities in advance of construction. In the unlikely event there is a variance during construction and a special status species impedes construction activities, WAPA and TEP will be responsible for relocation/mitigation.

Question 14: Can WAPA provide the breeding season dates referenced within the specification text below?

Project Specifications Division 13 Section A.6.h.(3) “Clearing, grubbing, blading, and access road improvements occurring within identified sensitive areas would be conducted outside the breeding season for most desert-nesting migratory birds.”

Answer 14: Bird nesting season is February 15 to September 1.

Question 15: Can WAPA provide additional detail regarding the type of activities that are not permitted, the locations of the sensitive areas, and the timeline dates referenced in the section paragraph below?

Project Specifications Division 13 Section A.2.(5) “The Contractor shall coordinate with Agency’s monitors on planned or ongoing Project activities and any specific pre-activity surveys or monitoring requirements for each activity in those areas. Contractor shall ensure that construction activities do not occur within environmentally sensitive areas during timelines when construction is not permitted. Agency’s monitors will flag environmentally sensitive areas and the Contractor shall coordinate activities with Agency’s monitors to ensure flagging occurs prior to construction activities throughout the Project.”

Answer 15: All ground-disturbing activities. Locations of sensitive areas will be provided post-award. Timeline dates may be resource/location specific, but in general the primary constraint is the S AZ breeding bird season (2/15 to 9/1). Sensitive biological resources will be flagged by WAPA and TEP’s monitors prior to construction. For example, pre-construction surveys for sensitive species and nesting birds will be conducted no more than 7 days prior to the start of activity in any particular area. Pre-construction surveys for burrowing owls and desert tortoise will be conducted no less than 7 days prior to activity in any area.

Question 16: Has WAPA knowledge of any historic or known raptor nests sites, including golden eagle or bald eagle nesting locations, in proximity to the Project? If yes, can nest site location information be provided?

Answer 16: There are no historic or known raptor or eagle nest sites in proximity to the Project. There is no AGFD Heritage Data Management System records of bald or golden eagles within 2 miles of the Project area.

Question 17: Can WAPA provide a copy of the plans referenced below? Can WAPA also specify which aspects of the plans will fall under Contractor scope?

Project Specifications Division 13 Section A.2.a.(1) “The Contractor shall implement and adhere to Agency provided Environmental Protection Measure Plans: Biological Monitoring Plan, Plant and Wildlife Species Conservation Measures Plan, Noxious Weed Management Plan, Reclamation and Vegetation Monitoring Plan, Stream Wetland Well and Spring Protection Plan, Worker Environmental Awareness Program, Paleontological Monitoring Plan, Monitoring and Discovery Plan, WAPA’s Avian Protection Plan.”

Answer 17: These plans will be implemented by WAPA and TEP. The plans will be provided post-award due to sensitive resource locations. The plans were developed to meet specific mitigation requirements of the project’s Environmental Impact Statement (DOE/EIS-0474). See EIS table 2-8 for reference, available at https://www.energy.gov/nepa/articles/eis-0474-final-environmental-impact-statement.

Question 18: Does the project have any project-specific seeding methodology or seed mix requirements?

Answer 18: If re-vegetation is required, use seed mixtures as recommended by Natural Resources Conservation Service or other land managing agency as appropriate. Proposed Certified Weed Free Native Seed mixtures shall be submitted for approval.

Question 19: Project Specifications Division 13 Section A.4 provides information pertaining to mitigated construction requirements within cultural or historic regions of the project. Can WAPA provide additional information as to the extent of these areas on the project? If WAPA is unable to share location information, can WAPA provide the number of structure/road locations that may be impacted by these restrictions?

Answer 19: Sensitive resource information will not be provided until after contract award.

Question 20: Attachment R – Past Performance Cover Letter

The past performance cover letter provides a due date of May 2, 2024. As the Contractor does not have control over the timeliness of the Client’s response, will WAPA extend the Past Performance Questionnaire (PPQ) due date to align with the proposal due date?

Answer 20: WAPA will not extend the Past Performance Questionnaire (PPQ) due date.

But will consider questionnaires up until the proposal due date.

B. The site visit attendance roster is attached to this amendment.
