II. THE FOLLOWING ANSWERS TO QUESTIONS/PRE-PROPOSAL INQUIRIES
ARE PROVIDED:
32. The upland portion of the project site includes excavation to install utilities and foundations. Work activities would incur additional time and effort if rock is encountered.
1. Please advise if the discovery of rock during subsurface installation activities would warrant a differing site condition; and/or
2. Please provide a recommended quantity (volume or linear feet) of excavation that should be considered for bidding purposes to standardize cost proposals for subsurface installations that encounter rock.
Note that on the recent USCGA Steam project solicitation, the response to a similar PPI identified this scenario as a differing site condition and modified the bid form to provide a line item price for rock removal.
Answer: Assume hard shale rock is present 12” below grade surface for upland excavation to install utilities and foundations. Verify using test pits during the design phase when routing and depth are known, prior to construction mobilization.
52. Page 2-22 of the approved Environmental Assessment states "The USCG would construct a new pile-supported 270-foot by 65-foot WLB pier that would be accessed by a 50-foot by 175-foot approach pier. Together the WLB pier and the approach pier would be supported by including 105 30-inch concrete structure piles and 54 13-inch plastic piles. A 18-foot by 20-foot FRC floating dock (supported by 10 30-inch concrete piles) would be attached to the new WLB pier and accessed from the WLB pier via a 5-foot by 75-foot gangway. Additionally, a new mooring dolphin (including three 30-inch concrete piles) would be construction.
Question #1: Is the use of 30-inch concrete piles and 13-inch plastic piles and the stated quantities a prescriptive contract requirement? Note that 01800 Paragraph 1.8 discusses steel pipe piles.
Question #2: If not, will the Government update the EA and resubmit to the approving agencies after design-builder has completed pile design for the project? If so, what is the required timeline for EA re-approval?
Answer: The RFP 01800 specification for steel pipe piles is prescriptive. Concrete piles will not be allowed on this project. RFP 1800 18.2 states “The Contractor shall be responsible for identifying all required permits, approvals, notifications, utility permits…” For updates/ modifications/ changes to permits initiated or completed by the Government, the Contractor shall consider their construction methods, the design, number of piles, pile materials, and any factor that may necessitate a change to permitting documents. Based on the Contractor’s analysis and in compliance with RFP requirements, the Contractor is to obtain, expand, modify, or start over the permitting permit process to ensure the correct permits are held and environmental compliance is maintained throughout the project. The permitting process must be completed prior to construction for each feature of work. The Contractor shall provide all labor, materials, correct level of personnel expertise, permitting fees, and permitting timelines.
For updates to the Environmental Assessment (EA), if the significance of the proposed change is equivalent to resulting significance concluded in the draft EA, the Government can initiate a Memorandum For Record to document changes. If proposed changes exceed the significance documented in the draft EA, the Contractor is responsible for completing a supplemental EA and ensuring its final approval through the NEPA process.
53. The RFP drawings include 134 piles for the approach trestle, fixed dock, and FRC float.
This does not include the mooring dolphin. The RFP drawings require a max pile spacing of 8.5'.
The Environmental Assessment states 105 piles will be used to construct the WLB pier and approach pier. Please confirm that using more than 105 pile is acceptable for this project.
Answer: See response to PPI #52.
56. Although the Final EA for the project states on page 1-10 that the Endangered Species Act (ESA) consultation will be completed by the end of 2024, the RFP does not specify that the NMFS Biological Opinion (completion of the ESA consultation) was issued. Would this Biological Opinion become a contract document?
Answer: See the enclosed document to this amendment: "NMFS Biological Opinion – USCG Sitka 2024." This document is incorporated into the solicitation and any resultant contract.
57. Marine mammal monitoring distances specified in IHA (application provided in RFP and published on the Federal Register) and EA are based on installation of concrete and plastic piles.
Monitoring distances for other pile and installation methods will likely be larger. Does the Government intend to revise the EA and IHA?
Answer: See response to PPI #52.
72. Section requires Type K copper be used for above ground piping. On other USCG projects, Type L copper has been allowed. Can Type L copper use used for above ground piping?
Answer: Type L copper is not permitted. See revised RFP Section 01800 1.11.2.4 in this amendment.
90. Sequence of work to allow small boats access at all times - Currently the project calls for small vessel access to be open at all times from the existing floating dock. At some point the access to the small boats will be blocked. If option 3 is not awarded will a temporary floating dock be required to dock small boats during construction for the wharf?
Answer: A temporary floating dock is not a requirement. The U.S. Coast Guard will temporarily move the small boats offsite during the necessary period of construction if Option Item 3 is not awarded. If Option Item 3 is awarded, follow phasing requirements as specified in the Specifications and Appendix A, sheet WS-12.
91. Appendix J Env Assessment - sub–Appendix D Biological Assessment requires a maximum of 5 taps of impact hammering to proof each pile for concrete piles - what is the requirement for the rfp required steel pipe piles? Impact hammering on steel piles could cause damage to bedrock and piles and potentially un-seat the piles embedded in bedrock.
Answer: If the Contractor is proposing using an alternate pile driving method than what is stated in the environmental documentation, the Contractor can initiate a change to the documentation as stated in PPI #52. All proposed changes to environmental documentation must meet the requirements stated in the RFP Specifications, Drawings, and Appendices.
See response to PPI #52.
92. Appendix J Env Assessment - sub–Appendix D Biological Assessment requires "The plastic fender piles would be installed using an impact hammer and would require approximately 27 days to install (i.e., two piles/day)." Will a Vibration pile installation method be accepted if we can determine the refusal criteria, we can meet with the vibration method and meet that during installation.
Answer: The Biological Assessment states under In-Water Construction BMPs (page 16-
18) that “the use of vibratory hammer for pile driving would be used to the maximum extent possible,” implying that “vibratory hammering” is a preferred method to traditional pile driving. If the Contractor is proposing to use an alternate pile driving method than what is stated in the environmental documentation, the Contractor can initiate a change to the documentation as stated in PPI #52. All proposed changes to environmental documentation must meet the requirements stated in the RFP Specifications, Drawings, and Appendices. See response to PPI #52.
93. Appendix J Env Assessment Table 4.1 and 4.2 and sub–Appendix D Biological Assessment describes concrete pile installation throughout the document. The RFP specifications and Geotech report discuss the requirement of Steel Pipe Piles. There seems to be a difference between the Environmental Assessment and the Specifications, which has precedence?
Answer: See response to PPI #52.
94. Appendix J Env Assessment Table 4.1 and 4.2 limits concrete pile installation to 2 ea piles per day. Does this requirement of drilling and setting 2 ea concrete piles per day take precedence over the RFP and Specification requirement of steel pipe pile installation?
Answer: See response to PPI #52.
99. Both Appendix C and Appendix R refer to work performed by a Mammal Observer and a Protected Species Observer (PSO). Please confirm if the Contractor is required to provide a Mammal Observer or PSO for this project. If so, please provide the preconstruction requirements, construction activities that an Observer would be required, location of the observer, and reporting requirements for the observer.
Answer: The Contractor is responsible for providing all required Marine Mammal Observers, Protected Species Observers, and any other personnel required by environmental documentation. Pre-construction requirements, construction activities that ab Observer is required to conduct, location of the Observer, and reporting requirements for the observer are responsibilities of the Contractor to determine in order to be in full compliance of all environmental permits, authorizations, and consultations.
104. 1.1.1 notes that the WLB wharf is 250' long, but also notes the required mooring length for the WLB is 275'. To achieve the 275' mooring length, it is depicted that the mooring dolphin be used. Drawings C1 denotes the mooring as part of Base Bid. However, 1.1.1 under Bid Option 3 notes the mooring dolphin is part of Bid Option 3. Please confirm the mooring dolphin is part of Bid Option 3 and that the overall mooring length of 275' does not apply to the Base Bid.
Answer: See response to PPI #3 in Amendment 04.
105. Due to the extensive costs and lengthy permit acquisition timelines, please advise if it is acceptable for, at the Contractor's risk, the Contractor's geotechnical engineer to utilize the geotechnical report provided in the RFP for design of the in-water structures.
Answer: See response to PPI #50 in Amendment 03.
133. Section 01802 2.1.3.2 Duration of reviews indicates the Government has 14 calendar days to review the 35% design. However Appendix J1, Memorandum of Agreement Section V Submittals, A. ii. indicates "Upon receipts of the 35% design, the signatories and concurring parties shall have 30 days to review and provide comments to the USCG." Please confirm that Section 01802 which identifies a 14 calendar day review will govern.
Answer: Per Section 01802, the Government will have 14 calendar days to review the Contractor’s 35% design. Per Appendix J1, Section V, the U.S. Coast Guard and the Contractor “will consider signatory and concurring party comments on 35% design, to the extent possible” prior to final design.
146. Paragraph section 01800 1.16.10.3 details emergency power requirements for telecommunication equipment areas. Will a standby power source be required for the boat bay building or just the manual transfer switch indicated in paragraph 01800 1.13.4?
Answer: The boat bay building is not required to have emergency power, thus a manual transfer switch is adequate. See revised Section 01800 1.16.10.3 in this amendment.
147. Paragraph section 01800 1.16.10.3.3. Will a rack mounted UPS be required in the Boat Bay Building as indicated?
Answer: The rack mounted UPS is a requirement.
151. Note #1 on Drawing E3 references "USCG BESEP", please provide copy of this document or confirm that is not required.
Answer: USCG BESEP is not a requirement of this project.
165. Are there any Existing Security Systems to be integrated into? If so what is the brand of systems?
Answer: There are no existing functional security systems at the site.
174. Are there any classified spaces to be protected, such as areas that are subject to TEMPEST standards?
Answer: There are no classified spaces to be protected.
175. 1.14.2.1 specifies CCD sensor cameras, are CMOS sensors also acceptable?
Answer: See revised Section 01800 1.14.2.1 in this amendment.
176. Is continuous recording required, or is an analytic and motion base recording trigger acceptable? Would a lowered framerate on non/event recording be acceptable for continuous record requirements.
Answer: Continuous recording is a requirement. A lowered framerate on non/event recording is not permitted.
177. 48 hours DVR record time is a short record time. Is 30 days record time acceptable as a basis of design?
Answer: See revised Section 01800 1.14.2.3 in this amendment.
178. Is there existing Rackspace and power for CCTV equipment?
Answer: The Contractor is to determine the best arrangement of CCTV equipment and connectivity. Assume power is available for CCTV in existing USCG office building.
181. The RFP Specification Does not include requirements for a Site Safety and Health Officer (SSHO). Please confirm that a SSHO is in fact required, but may be a role shared/filled by other key personnel positions (QAM, Supt, or PM).
Answer: The Contractor is responsible for managing, staffing, and implementing their site safety plan. Please note Section 01450 1.1.3, for the requirements of the QAM.
182. Please confirm the Site Superintendent is to be an employee of the Prime Contractor.
Answer: The site superintendent is to be an employee of the Prime Contractor.
191. The RFP specification does not provide requirements for DB Contractor preparation, submission and approval for an Environmental Management Plan (EMP) or Excavation Dewatering Plan. The RFP does require an EPP which appears to be a comprehensive plan/submittal only for USCG review/approval and does not require its approval by ADEC.
Given this site's proximity to other previously or currently contaminated sites, an ADEC approved EMP and an Excavation Dewatering Authorization could be required by ADEC. Please advise if these EMP / EDP plans/approvals will be provided and obtained by the USCG, or if these are the Contractors responsibility
Answer: The EPP is provided by the DB Contractor to the U.S. Coast Guard for its internal use. The Contractor is expected to comply with the approved EPP plan over the duration of the project. In accordance with RFP Sections 01800 1.18.2, 1.18.2.1, and 1.18.3, it is the Contractor’s responsibility to determine all environmental permitting requirements and prepare all applications and/or submittals to regulatory agencies with oversight of this project on behalf of the U.S. Coast Guard (the owner). This includes an EMP and Excavation Dewatering Authorization that are required in order to complete the project. For reference, an EMP and Excavation Dewatering Authorization have been required at multiple Alaska Coast Guard sites and has required approval from ADEC and
EPA.
192. Please provide anticipated submittal requirements for the Environmental Management Plan (EMP) and Excavation Dewatering Authorization, if required.
Answer: See response to PPI #191.
193. Confirm no NOI to ADEC is required, as the area of disturbance is under an acre and ADEC prefers to not have NOIs for sites under an acre
Answer: In accordance with RFP Sections 01800 1.18.2, 1.18.2.1, and 1.18.3, it is the Contractor’s responsibility to determine all environmental permitting requirements and prepare all applications and/or submittals to regulatory agencies with oversight of this project on behalf of the U.S. Coast Guard. It is a requirement for the Contractor to confirm whether an NOI to ADEC is required and if required, the Contractor will prepare in accordance with RFP Sections 01800 1.18.2, 1.18.2.1 and 1.18.3.
195. As identified in prior questions, the description of pier design/construction as represented in the Environmental Assessment (EA) conflicts with the RFP's stated technical requirements steel pipe piles, etc. Assuming the EA will require revision (either by USCG or DB Contractor), please confirm that USCG will allow the contractor to simultaneously pursue other related permitting requirements in parallel with revised EA approval, and that USCG will NOT require the an approved EA as prerequisite to related permitting such as the Incidental Harassment Authorization (IHA) and/or the Incidental Take Regulation (ITR).
Answer: See response to PPI #52. The U.S. Coast Guard does not require an approved EA as a prerequisite to the IHA and ITR.
196. Please confirm the Contractor is not responsible for changes to the Period of Performance relating to the potential need for revision and reapproval of the Environmental Assessment (EA).
Answer: The Contractor is encouraged to prepare permit applications early in the design-build process to minimize delays to the start of construction. It is the Contractor’s responsibility to develop a schedule that accounts for time to revise and obtain the necessary permits and completion of NEPA within the period of performance.
The USCG cannot make a recommended timeframe for updates to the Environmental Assessment since the USCG does not have all the information available that the successful Contractor would propose to make. If a supplemental EA is required, the Contractor shall follow the NEPA process according to applicable laws, regulations, and best practices.
For updates to Government initiated or Government completed permits, assume 9 months for regulatory approval from the time revised permits are accepted by the regulatory agent as “complete” to the relevant agency’s requirements. Preparing permit applications that contain all required permit information is the responsibility of the Contractor and the Contractor shall not consider the regulatory agency to begin their review until a completed application is provided to them.
See PPI #52 in this amendment for additional information.
200. Please provide standard referenced in 1.16.1.10: Coast Guard C5I Shore Tie Cable Standards
Answer: The shore tie standards are enclosed as an attachment to this amendment.
204. Please confirm that USCG is the AHJ and that the DB Contractor is NOT required to procure a City and Borough of Sitka Building Permit.
Answer: Confirmed, U.S. Coast Guard is the AHJ. The Federal government is not required to obtain local construction building permits.
205. Appendix J1 MOA between USCG & SHPO states that "Work pursuant to this MOA will be performed by or under the direct supervision of a person or persons with appropriate professional qualifications. The archaeologist and historian employed to implement the stipulations of this agreement shall meet the professional qualifications set forth in the Secretary of Interior’s Professional Qualification Standards (36 C.F.R. Part 61, Appendix A), and be familiar with local Sitka history and community." Please confirm the Archaeologist and Historian Supervision referenced in this MOA will be provided by the USCG.
Answer: The U.S. Coast Guard will not provide archaeologists or historians. The qualified Archeologist and all required MOA supervision shall be provided by the Contractor for the purpose of ensuring the MOA and its stipulations are complied with, met, and successfully executed. For additional guidance on the MOA, see RFP Specification Sections 01800 – 1.18.4.1.17, 1.18.6, and 1.18.7.
