About this file

This is a Questions and Answers document from a Draft Request for Proposal (DRFP) for Medical Support Services contracted by U.S. Customs and Border Protection (CBP). The Q&A clarifies critical requirements and government positions on service delivery, technical specifications, and pricing for this Firm Fixed Unit Price Indefinite Delivery/Indefinite Quantity (IDIQ) contract.

Key clarifications include: CBP will not provide advance quantity estimates by zip code, as volumes depend on Congressional-approved hiring and funding availability. All medical services must be provided throughout the United States, including Alaska, Hawaii, Puerto Rico, the Virgin Islands, Guam, and Saipan, with facilities established within a 60-mile radius of employee/candidate zip codes (exception for overseas locations). The 60-mile requirement does not apply to services outside the contiguous United States. Attachments 9 and 10A-10 referenced in Sections 3.1.2 and 4.1.2 will be provided upon award. For web-based services, the one-second response time requirement applies only to exam/test request submissions via web service, not to dashboard or report queries. Regarding Disaster Recovery, CBP has not set a fixed DR tier; offerors should propose appropriate solutions to be evaluated as part of best value determination. The government will not provide specific estimated quantities in the Price Proposal Template (Attachment 4); vendors must use the quantities provided. Offerors should amortize transition-related costs into unit prices for the first ordering period rather than request a separate CLIN. The 6% no-show rate referenced applies only to post-employment examinations; pre-employment testing no-shows and cancellations must be incorporated into flat fees. No separate billing applies for no-shows or cancellations except for Independent Medical Examinations. Changes to existing OPM medical standards for existing positions will be provided at no cost impact, but extensions to additional positions will be handled through appropriate procurement channels. Invoice reductions for late deliverables will not apply when delays result from candidate non-responsiveness or unavailability. The contractor is responsible for all independent assessment costs related to IT Security Accreditation (ATO) achievement within six months of award, though costs may be negotiated and included in the contract post-award.

DRFI DocumentDRFP SectionPage NumberComment / Question
General- AttachmentsWill the government consider providing a draft list of quantities for each medical service by zip code in advance of the RFP?

We are unable to provide a draft list of quantities at this time.

The services under this contract are subject to the needs of the Government and to the availability of funds; the volume of tests ordered is contingent upon the number of new hires approved by Congress and specific hiring requirements DSOW 1.5, para 4, 1.8.3, Para 3 & 7.1.2.1 10, 13, 119 Please clarify the services locations anticipated for this program. Section 1.5 para 4 states that During the life of this contract specimen collection supplies and shipping of these supplies "may include locations such as Canada, the Caribbean, Abu Dhabi, UAE, and Dublin Ireland." . 1.8.3, para 3 states that "The contractor, upon request, shall also provide pre-employment medical examination, fitness testing, and drug testing services throughout the seven continents." and section 7.1.2 states that" examining medical fitness and drug collection facilities for employee and /or candidate appointments shall be located within the continental US, and in Alaska, Hawaii, Washington, DC, Puerto Rico, the Virgin Islands, Guam and Saipan." Please clarify if Guam and Saipan are included within scope and what medical services are required Guam and Saipan.

Yes, all parts of the US must be included. All services outlined within the SOW, unless otherwise stated, can occur at any location within the United States.

Additionally, the Contractor shall establish clinics and facilities for conducting medical examination, fitness test, and specimen collection appointments that shall be within a sixty (60) mile radius of the employee and/or candidate’s zip code unless otherwise stated in the SOW.

The sixty (60) mile radius requirement does not apply to services being performed outside the contiguous United States.

DSOW 1.10.1.3, 9.7.1.1 pg 148 The government mentions the use of audio and video for fitness exams. Can the government please define the requirements for the use of audio and video in fitness exams.

An audio or video file may be needed when information is submitted as part of the FFDE request. For example, video or audio files of an employee during conduction of his/her duties that can be used as part of the FFDE process.

For the CBP/HC pre-employment fitness test, the Government will provide the Test Administrator manuals, score sheets, and audio files to administer the tests.

DSOW 3.1.2 57 - 72 Attachments 9 and 10A-10 are referenced throughout section 3.1.2and 4.1.2 but not provided in the DRFP. When will the government provide these attachments?

Attachments will be provided upon award.

DSOW 6.3.2.8 118 The solicitation references a specific brand-name treadmill. To ensure full and open competition in accordance with FAR 11.104 and 11.105, would the Government consider revising the requirement to use a generic description such as ‘commercial‑grade motorized treadmill’ with required performance specifications, instead of a brand-specific model? This would allow multiple responsible vendors to propose equipment that meets the Government’s functional needs while still complying with procurement regulations.”

Could you clarify where a specific brand was named?

DSOW 8.9.5.6 130 We noticed in that the DSOW states the contractor submit a detailed description of their web service using a standard WSDL document and provide an XML schema. Can the Government confirm that this is only technology set?

The government will provide confirmation as to web based services.

DSOW 8.9.5.6 130 The tech req states that the webservice shall execute requests within one second. Can the Govt clarify that this pertains to only single record transactional updates and not to bulk data updates, dashboard queries with complex queries etc.?

This requirement pertains to the submission of exam/test requests via web service. This does not apply to dashboard or report queries.

DSOW 8.12.9.2.3.3.1 134 The DSOW indicates that the DR requirements are based on the system owner's determination of how robust the DR solution must be. Has the CBP determined the DR tier already ? If not, how does the Govt intent to evaluate non-uniform solutions / pricing between offerors? CBP has not set a fixed DR tier. Offerors should propose a DR solution they believe is appropriate for the contract’s requirements. The Government will evaluate each proposal’s technical approach and price for DR as part of the overall best value determination, considering the rationale and adequacy of the proposed solution.

If the Government later clarifies the DR tier or requirements, this will be communicated to all offerors (e.g., by amendment) to ensure a fair and uniform evaluation.

DSOW/DRFPGeneralNAWhat is the Test Menu for Regulated and Non-Regulated Drug Tests?
DSOW/DRFPGeneralNAWhat is the anticipated volume for Standard Urinalysis (non-drug)? The SOW does not specify a volume for standard urinalysis (non-drug).
DSOW/DRFPGeneralNAWhat is the Test Menu for Special Diagnostic Testing? Special diagnostic testing will be determined based on clinical need and as specified by CBP during contract performance. The SOW does not provide a fixed menu.
DSOW/DRFPGeneralNAWhat is the anticipated volume for Clinical Diagnostic Laboratory Testing? No specific volume is provided in the SOW. Volumes are subject to operational needs and may vary.
DRFP Attachment 4Price Proposal Template to be provided by Amendment60To ensure all offerors submit a common Total Evaluated Price (TEP) for a fair competition, will the Government provide specific estimated quantities for every CLIN in Attachment 4 (“to be provided by amendment”), or are offerors expected to derive their own volume estimates from the historical trends provided in the SOW? Attachment 4 is provided with instructions. Vendors should just use the quantities given.
DRFP Attachment 4Price Proposal Template to be provided by Amendment60Will the final RFP include a separate fixed-price CLIN for Transition-In activities or are offerors expected to amortize transition-related costs into the unit prices for the first ordering period? offerors should amortize transition-related costs into their unit prices for the first ordering period.
DPWS1.913The Government states that request volume shall vary widely and that “CBP may send up to several thousand requests in one day” which must be completed within the specified timelines. Given the Firm Fixed Unit Price nature of the contract, is there a defined maximum daily or monthly capacity limit above which the contractor would be entitled to a price adjustment or extended delivery schedule to account for extreme surge events?

There is no defined maximum or monthly capacity at this time.

DPWS 2.3.2 25 The Government indicated that Contractors are not to separately bill for no show and/or canceled appointments, except for Independent Medical Examinations, which will be billable to the Government at a fixed price rate. Does the provision for non-billable no-shows and the anticipated 6% rate apply to Section B Pre-Employment Fitness Tests (Task 3) and Drug Test collections (Task 4)? If so, should offerors apply this 6% assumption when calculating unit prices for all candidate-specific CLINs?

The 6% rate refers to post-employment examination.

For pre-employment testing, no show and cancelled appointment fees will not be billed separately, and are to be incorporated into a flat fee for each service type, unless otherwise noted in the SOW.

DPWS 3.1.2.2.1 57 States that as positions requiring mental health screenings are added throughout the contract, these changes will be provided with 'no cost impact to the contract.' Because the addition of new positions could involve different medical standards, increased administrative coordination, etc., could the Government clarify if this 'no cost impact' provision is limited to updating existing position descriptions, or does it also apply to a net increase in volume or the addition of entirely new screening protocols?

Changes to existing OPM medical standards for existing positions will be provided to the Contractor as amended attachments during the life of the contract. If OPM medical standards are extended to additional CBP positions, and would thereby result in increased volume and potentially new screening protocols, CBP/HC and CBP/NPD will work through appropriate Procurement channels to incorporate the changes with the Contractor.

DPWS 4.1.4.1.10 & 4.2.1.10.1 71 & 73 These sections state that if re-work of a written medical rating or consultation is needed, CBP shall not be billed for the contact or the revision. Will the Government confirm that this provision applies only to corrections of errors where a deliverable fails to meet SOW requirements, and that requests for new analysis or additional opinions based on information not provided in the original request would be considered billable as a new consultation?

Correct - if a deliverable does not meet the SOW requirements and rework or revision is needed, the Government will not be billed for said rework or revision.

If the Government determines an additional request for service or consultation is needed, a new request will be placed and would be billable as such.

DPWS 9.11.2.1.3 157 The Government has proposed an invoice reduction schedule for late deliverables, including a 100% reduction (no payment) for any result provided more than 45 days after the SOW requirement. In instances where a delay is caused by factors outside the Contractor’s control, such as a candidate's failure to respond to scheduling attempts or a third-party clinic's administrative delay, will the Government include a mechanism to waive or adjust these automatic price reductions?

The Prime Contractor is responsible for ensuring compliance with all requirements and timelines outlined in this contract and SOW, and that extends to any subcontractors or third-party facilities the Contractor utilizes under this contract. Instances where a candidate is non-responsive or unavailable to complete appointments within the timelines outlined in the SOW, the Contractor is not penalized and provisions are provided in the appropriate sections to close out requests.

DPWS 8.11 The contractor is required to achieve IT Security Accreditation (ATO) within six months of award. Achieving this accreditation requires an independent third-party validation of security and privacy controls. Will the Government clarify if the contractor is responsible for the full cost of this independent assessment, or will CBP provide the auditing services as part of the agency's security authorization package? The cost of the ATO can be negotiated and included into the contract after award. Contractor Responsibility: The contractor is responsible for preparing all required documentation, implementing controls, supporting independent assessment, and remediating findings.

Independent Assessment: The cost and coordination of independent assessment are typically the contractor’s responsibility, unless otherwise specified.

DHS Oversight: DHS security officials, including the Information System Security Officer (ISSO) and AO, provide oversight and final approval.

No Operation Without ATO: Systems may not process DHS data in production until an ATO (or IATO) is granted.
