About this file
This is a Questions and Answers document from the Draft RFP for DHS Customs and Border Protection Medical Support Services (Solicitation 70B06C26R00000017). The Q&A clarifies key requirements and contract terms for the comprehensive medical support services procurement supporting both the National Programs Division (NPD) for employee services and the CBP Hiring Center for pre-employment services.
The contract is structured as a Firm Fixed Unit Price IDIQ with a 60-month period of performance. Critical clarifications include: the 90-day transition-in period applies to the entire Medical Support Services program; cancellation and rescheduling fees for Independent Medical Examinations are incorporated into IME pricing with no charges to CBP, while no-shows are separately billable; two separate monthly invoices are required for NPD (one for drug testing and one for medical services including psychiatric consultations); and contractors must notify the Contracting Officer Representative within 2 hours of an employee's failure to appear for drug testing. The document confirms that no overseas FFDEs have been conducted in the past five years, contractors must provide their own equipment and supplies at their expense with no Government Furnished Equipment provided, and IME specialty pricing should be standardized nationwide rather than varying by state. Additional guidance addresses laboratory director key personnel commitment preferences (exclusive commitment preferred), the use of current Federal CCF formats, vaccination documentation requirements (to follow current federal guidance only), font specifications for proposals, and clarification that the Past Performance Questionnaire (Attachment 5) should be submitted as the sole component of Volume II with no supplementary materials.

Transition Process
The Draft SOW states, “CBP’s mandatory drug testing of employees and candidates is a continuous process. In addition, CBP continually orders medical examinations, consultations, and fitness tests without long breaks in ordering; as such, it is imperative that the Contractor be able to perform all requirements in this SOW within ninety (90) business days of contract award.”
Please clarify if the transition-in period of 90 business days is for the transition-in of the entire CBP Medical Support Services program or just for drug testing and medical evaluations?
90 days is for the entire Medical Support Services Program.

2.2.3.5
Independent Medical Examination (Non-psych)
Can the government remove cancellation and rescheduling fees and create separate CLINs from the price of an IME? This would be similar to what is noted for No-Shows (2.2.3.7) and a no-show fee.
Cancelation fees and Rescheduling Fees are incorporated in the cost of all IMEs. CBP will not be charged for cancelation or rescheduling of IMEs, but will be charged for No-shows.

Non-US
Can the government provide the types and volumes of medical exams requirements for all non-US locations?
No FFDEs have been conducted in overseas locations during the past 5 years.
DRAFT RFP
5 & 45
I.4 & II.79
II.4 Contract Type & II.79 Contract Type (OCT 2008)
Draft RFP Section II.4 states that the contract type is a “Firm Fixed Price IDIQ” whereas Section II.79 states “This is a Firm Fixed Unit Price IDIQ Contract. Order will be placed against the IDIQ on a Firm Fixed Unit Price basis.”
Please clarify the contract type. A fixed unit price IDIQ contract is structured to provide the Government with flexibility to order supplies or services over time using pre-established fixed unit prices for defined contract line items (CLINs). The contract establishes a minimum and maximum ordering threshold, while specific requirements are fulfilled through the issuance of task or delivery orders.
Funding is not obligated at the basic contract level beyond any stated minimum; rather, funds are obligated at the order level based on the Government’s needs at the time of award. Orders may include any combination of fixed-price CLINs, depending on the scope and requirements of the individual order. The total obligated amount will therefore vary based on the quantities and mix of CLINs ordered, consistent with the terms and pricing structure established in the contract.

2.6.4.1.2 and 2.6.4.1.3
Scheduling Employees for Random Drug Testing Programs
The draft SOW states “2.6.4.1.2 The Contractor shall be prepared upon request, to provide a collection team consisting of at least one (1) male and one (1) female collector.
2.6.4.1.3 The Contractor may be asked to provide up to six collectors (three (3) males and three (3) females) depending on the number of employees selected for testing.
To confirm, when a collection team consisting of at least one (1) male and one (1) female collector is requested, should staffing be based on a ratio of one (1) collector per forty (40) collections (assuming male/female coordinator or supervisor to observe if needed?
The ratio may vary. The COR/DPC will notify the Contractor how many collectors are needed.

2.6.4.3.3
Scheduling Employees for Random Drug Testing Programs
The Draft SOW states, “If an employee fails to appear at the assigned time for a drug test, the Contractor shall report the incident to the COR within two (2) hours after the scheduled time via phone and follow-up with an e-mail message via secure electronic transmission.”
Given varying time zones of the collection sites, would it be acceptable to revise the requirement to notification to the COR within twenty-four (24) hours, or alternatively, immediately upon notification from the collection site?
No, based on the safety sensitive nature of the position, the COR must be notified within 2 hours.

2.6.5.2.2
Site Requirement
The draft SOW states, “The Specimen Collector shall follow each step of the collection process as listed in the collection manual and on the back of the employee copy of the CCF.” However, the current Federal CCF no longer includes collection instructions on the back of Copy 5 and instead provides a link for donor review.
Please confirm that the current Federal CCF format and collection manual meets this requirement.
Please disregard the previous reference to the back of the CCF. This has been updated.

9.3.4
Key Personnel
Given that large HHS/SAMHSA-certified laboratories and their leadership typically support multiple contractors in competitive procurements, for the Laboratory Director key personnel can the Government clarify whether letter of commitment (LOC) are required to be exclusive to a single offeror, or whether the same Laboratory Directors may provide LOC’s to multiple offerors, with commitment finalized upon award?
We would prefer the Laboratory Director be exclusive to CBP.

Pre-Employment Medical Examination Historical Trend
Can the Government provide the approximate volume or percentage of ‘hard-to-reach’ examinations relative to total exams requested for FY2023 and FY2024?
Historical trends for pre-employment services can be found in Section 1 Background, and tables 1, 2, 3, and 4 for pre-employment. The difference in exams requested versus exams completed accounts for candidates who are deemed hard to reach, no shows, or fallouts at other points in the hiring process and do not complete the requested exams.

Volume II – Past Performance Questionnaire
The Draft RFP states, “In Volume II - Past Performance Questionnaire submission, the offeror shall submit a minimum of two and a maximum of three records (combined into one Volume) that address the instructions and questions listed in Attachment 5 and address the following elements”

Volume II – Past Performance Questionnaire
Page Limit The Draft RFP states on page 72 that, “In Volume II - Past Performance Questionnaire submission, the offeror shall submit a minimum of two and a maximum of three records (combined into one Volume) that address the instructions and questions listed in Attachment 5 and address the following elements” and on page 73 further states “Volume II – There is no page limit for Volume II, Responses shall only be submitted in the provided Past Performance Questionnaire.”
Should Attachment 5 (Past Performance Questionnaire) be incorporated directly into an offeror’s Volume II submission, or is Attachment 5 intended to be submitted as a stand‑alone document separate from Volume II?
Because Volume II may only be submitted using the provided Past Performance Questionnaire, should offerors refrain from including a Table of Contents and Acronyms/Glossary in this volume, or should these elements be submitted as separate documents? The Offeror is expected to submit only the completed Attachment 5 Past Performance Questionnaires (2–3 records), combined into a single electronic file as Volume II. No additional materials, such as a Table of Contents or glossary, are required or expected. The questionnaires must be fully completed, address all required elements, and be relevant and recent.

EMPLOYEE MEDICAL SERVICES – Examinations and Consultations, Fitness for Duty Evaluations
Can the Government please provide historical volumes for FFDE examinations by IME specialty type? Additionally, it would be helpful if you can also provide which states the IMEs were performed as the cost of specialty IMEs vary widely state by state? The price of the IME specialties do not vary by state at this time. The contractor should incorporate variance into the pricing of IMEs to create a standard price for all IME.
