About this file
This is Amendment A0002 to Request for Proposals (RFP) 70B06C26R00000017 for comprehensive Medical Support Services issued by the U.S. Department of Homeland Security, Customs and Border Protection (CBP), National Programs Division and Hiring Center. The amendment, effective April 29, 2026, modifies proposal submission requirements and clarifies government responses to vendor questions without revising the Statement of Work.
The primary amendment changes include: (1) removal of the requirement to submit individual training certifications for non-key Specimen Collector staff and Specimen Collection Clinics, replaced by a signed attestation confirming all personnel will meet Mandatory Guidelines for Federal Workplace Drug Testing Programs (42 CFR Chapter 1) and applicable HHS/DOT requirements prior to performing work; (2) clarification that orthopedic/musculoskeletal clinical evaluations are required components of standard pre-employment medical examinations, not specialized services; (3) updates to the Price Proposal Template including transition pricing definitions, corrected total extended value cell references for ordering periods 2-5, and deletion of duplicate CLIN X081; (4) updated RFP and Q&A documents with changes highlighted in blue and previous amendment (A0001) changes in yellow; and (5) provision of three new attachments (#22-#24). The proposal due date remains unchanged. This is a single-award Indefinite Delivery/Indefinite Quantity (IDIQ) Firm Fixed Unit Price contract with a 60-month period of performance (five 12-month ordering periods commencing August 1, 2026), supporting nationwide medical services including fitness-for-duty evaluations, return-to-work reviews, pre-employment medical examinations, fitness testing, drug testing specimen collection, laboratory analysis, and Medical Review Officer services for annual volumes exceeding 40,000 medical exams, 50,000 fitness tests, and 45,000 drug tests.

70B06C26R00000017 A0002 – Amendment Summary
DESCRIPTION OF AMENDMENT/MODIFICATION:
The purpose of this amendment is to revise the proposal submission requirements regarding training certifications for NON- KEY Specimen Collector staff and Specimen Collection Clinics, and to clarify the Government’s response to vendor Question 88 regarding the orthopedic/musculoskeletal evaluation in the pre-employment medical exam. This amendment applies to the RFP and proposal instructions only; the Statement of Work (SOW) is not being revised.

STANDARD FORM 30 (REV. 11/2016)
The requirement to submit individual training certifications for NON-KEY Specimen Collector staff and Specimen Collection Clinics with the proposal is hereby removed from the RFP and all proposal instructions.
2. Attestation Requirement Substituted:
Offerors must instead submit a signed attestation with their proposal stating:
o All personnel and clinics performing services under this contract will meet all training and certification requirements as defined in the most current version of the Mandatory Guidelines for Federal Workplace Drug Testing Programs (42 CFR Chapter 1) and any applicable HHS/DOT requirements prior to performing any work.
o The offeror will maintain documentation of such certifications and make them available to the Government upon request at any time during contract performance or post-award.
Sample Attestation Language for Offerors:
Attestation of Compliance with HHS/DOT Training and Certification Requirements The Offeror attests that all Specimen Collector staff and Specimen Collection Clinics performing services under this contract will meet all training and certification requirements as defined in the most current version of the Mandatory Guidelines for Federal Workplace Drug Testing Programs (42 CFR Chapter 1) and any applicable HHS/DOT requirements prior to performing any work. The Offeror will maintain documentation of such certifications and make them available to the Government upon request at any time during contract performance or post-award.
3. Clarification Regarding Orthopedic/Musculoskeletal Evaluation (Q88):
The Government clarifies, in response to vendor Question 88, that the orthopedic/musculoskeletal clinical evaluation—including documentation of range of motion, pain, strength, tenderness, and other body-region-specific assessments as outlined in Attachment 9 (Candidate Medical Exam)—is a required component of the standard pre-employment medical examination. This evaluation is to be completed by the examining physician, nurse practitioner, or physician assistant as part of the base Pre- Employment Medical Exam CLIN. No specialized orthopedic training or separate specialist is required.
Any test or evaluation beyond what is outlined in Attachment 9 (e.g., advanced imaging, specialist consults, or functional capacity evaluations) is considered “specialized” and should be billed under the appropriate “Additional Medical Tests” or “Miscellaneous IME Tests” CLINs in the pricing template.
4. Proposal Instructions Updated:
Section III.15(j)(4), all proposal instructions, and any other references to Appendix AA or proposal submission of NON-KEY training certifications are superseded by this amendment.
5. The Price Proposal Template is updated. Instructions include transition pricing and definitions of “Lot” and “Hour” are provided. The TECV formulas for Ordering Periods 2–5 now reference the correct total extended value cells. Highlighting updated on CLIN X011. Also, Transition is now included for $500,000. CLIN X081 is deleted as it was a duplicate.
Miscellaneous IME Tests (NTE) is updated to remove the “(NTE)”.
6. The RFP and Q&As are updated, changes highlighted blue. A0001 changes are still highlighted yellow.
7. No Extension to Proposal Due Date: This amendment is intended to reduce proposal burden and clarify requirements.
The proposal due date remains unchanged.
8. Highlighting of Changes:
All changes made by this amendment (A0002) are highlighted in blue in the RFP for ease of reference. Changes made by the previous amendment (A0001) remain highlighted in yellow.
9. Attachments #22-#23-#24 are now provided.

SECTION II CONTRACT CLAUSES
EXECUTIVE ORDERS:
In compliance with Executive Order 14173, Ending Illegal Discrimination and Restoring Merit-Based Opportunity, dated January 21, 2025, the Contractor agrees that its compliance in all respects with applicable Federal anti-discrimination laws is material to the Government’s payment decisions for purposes of section 3729(b)(4) of title 31, United States Code; and, by virtue of submitting a offer, the Contractor certifies that it does not operate any programs promoting DEI that violate any applicable Federal anti-discrimination laws.
No requirement in this contract should conflict or contravene Executive Order 14154 “Unleashing American Energy” dated January 20, 2025. To the extent any requirement may conflict or contravene that Executive Order, the requirement is deemed inapplicable to this contract. The Contractor should consult with the CO on any such requirement they determine is inconsistent with the Executive Order, and work on proposed modifications to comply with the EO and statutory requirements.
Pursuant to Executive Order 14275, Restoring Common Sense to Federal Procurement, signed April 15, 2025, certain DHS FAR DEVIATIONS for the Revolutionary FAR Overhaul (RFO) are now in effect. See FAR Overhaul - FAR Part DEVIATION Guidance | Acquisition.GOV. Any subsequent citations to the FAR will be in accordance with the RFO. As such, Offerors should become familiar with those DEVIATIONS prior to entering into this contract. Any clauses contained in this contract that have already been, or are later, updated in the RFO and adopted by DHS shall be considered to be amended to mirror the most up to date FAR RFO language.
Acceptance of this contract is acceptance of unilateral modifications by the Government to incorporate any RFO deviation.
Further, system updates may lag policy updates. The System for Award Management (SAM) may continue to require entities to complete representations based on provisions that are not included in agency solicitations. Contracting Officers will rely on representations from quotes based on provisions in the solicitation. Entities are not required to, nor are they able to, update their entity registration to remove these representations in SAM.
II.1 52.252-2 CLAUSES INCORPORATED BY REFERENCE (FEB 1998)
This contract incorporates one or more clauses by reference, with the same force and effect as if they were given in full text. Upon request, the Contracting Officer will make their full text available. Also, the full text of a clause may be accessed electronically at this/these address(es): www.acquisition.gov .

(b) The use in this solicitation or contract of any Department of Homeland Security Acquisition Regulation (HSAR) (48 CFR 30) clause with an authorized deviation is indicated by the addition of “(DEVIATION)” after the name of the regulation.

II.42 52.227-17 RIGHTS IN DATA-SPECIAL WORKS (DEC 2007)
(a) Definitions. As used in this clause- Data means recorded information, regardless of form or the media on which it may be recorded. The term includes technical data and computer software. The term does not include information incidental to contract administration, such as financial, administrative, cost or pricing, or management information.
Unlimited rights means the rights of the Government to use, disclose, reproduce, prepare derivative works, distribute copies to the public, and perform publicly and display publicly, in any manner and for any purpose, and to have or permit others to do so.
(b) Allocation of Rights. (1) The Government shall have-
(i) Unlimited rights in all data delivered under this contract, and in all data first produced in the performance of this contract, except as provided in paragraph (c) of this clause.
(ii) The right to limit assertion of copyright in data first produced in the performance of this contract, and to obtain assignment of copyright in that data, in accordance with paragraph (c)(1) of this clause.
(iii) The right to limit the release and use of certain data in accordance with paragraph (d) of this clause.
(2) The Contractor shall have, to the extent permission is granted in accordance with paragraph (c)(1) of this clause, the right to assert claim to copyright subsisting in data first produced in the performance of this contract.
(c) Copyright- (1) Data first produced in the performance of this contract. (i) The Contractor shall not assert or authorize others to assert any claim to copyright subsisting in any data first produced in the performance of this contract without prior written permission of the Contracting Officer. When copyright is asserted, the Contractor shall affix the appropriate copyright notice of 17 U.S.C. 401 or 402 and acknowledgment of Government sponsorship (including contract number) to the data when delivered to the Government, as well as when the data are published or deposited for registration as a published work in the U.S. Copyright Office. The Contractor grants to the Government, and others acting on its behalf, a paid-up, nonexclusive, irrevocable, worldwide license for all delivered data to reproduce, prepare derivative works, distribute copies to the public, and perform publicly and display publicly, by or on behalf of the Government.
(ii) If the Government desires to obtain copyright in data first produced in the performance of this contract and permission has not been granted as set forth in paragraph (c)(1)(i) of this clause, the Contracting Officer shall direct the Contractor to assign (with or without registration), or obtain the assignment of, the copyright to the Government or its designated assignee.

The Contractor shall not, without prior written permission of the Contracting Officer, incorporate in data delivered under this contract any data not first produced in the performance of this contract and that contain the copyright notice of 17 U.S.C. 401 or 402, unless the Contractor identifies such data and grants to the Government, or acquires on its behalf, a license of the same scope as set forth in paragraph (c)(1) of this clause.

Except as otherwise specifically provided for in this contract, the Contractor shall not use, release, reproduce, distribute, or publish any data first produced in the performance of this contract, nor authorize others to do so, without written permission of the Contracting Officer.

The provisions of this paragraph do not apply unless the Government provides notice to the Contractor as soon as practicable of any claim or suit, affords the Contractor an opportunity under applicable laws, rules, or regulations to participate in the defense of the claim or suit, and obtains the Contractor’s consent to the settlement of any claim or suit other than as required by final decree of a court of competent jurisdiction; and these provisions do not apply to material furnished to the Contractor by the Government and incorporated in data to which this clause applies.
(End of clause)
II.43 52.233-1 DISPUTES (AUG 2025) (DEVIATION 25-25), ALTERNATE I
(a) Definitions. As used in this clause-
Claim means a written demand or written assertion by one of the contracting parties seeking, as a matter of right, the payment of money in a sum certain, the adjustment or interpretation of contract terms, or other relief arising under or relating to this contract.
However, a written demand or written assertion by the Contractor seeking the payment of money exceeding $100,000 is not a claim under 41 U.S.C. chapter 71 until certified. A voucher, invoice, or other routine request for payment that is not in dispute when submitted is not a claim under 41 U.S.C. chapter 71. The submission may be converted to a claim under 41 U.S.C. chapter 71, by complying with the submission and certification requirements of this clause, if it is disputed either as to liability or amount or is not acted upon in a reasonable time.
Defective certification means a certification that alters or otherwise deviates from the language in paragraph (d)(2)(iii) of this clause or which is not executed by a person authorized to bind the contractor with respect to the claim. Failure to certify must not be deemed to be a defective certification.
(b) This contract is subject to 41 U.S.C. chapter 71, Contract Disputes.
(c) Except as provided in 41 U.S.C. chapter 71, all disputes arising under or relating to this contract must be resolved under this clause.
(d)(1) A claim by the Contractor must be made in writing and, unless otherwise stated in this contract, submitted within 6 years after accrual of the claim to the Contracting Officer for a written decision. A claim by the Government against the Contractor must be subject to a written decision by the Contracting Officer.
(2)(i) The Contractor must provide the certification specified in paragraph (d)(2)(iii) of this clause when submitting any claim exceeding $100,000.
(ii) The certification requirement does not apply to issues in controversy that have not been submitted as all or part of a claim.
(iii) The certification must state as follows: “I certify that the claim is made in good faith; that the supporting data are accurate and complete to the best of my knowledge and belief; that the amount requested accurately reflects the contract adjustment for which the Contractor believes the Government is liable; and that I am authorized to certify the claim on behalf of the Contractor.”
(3) The certification may be executed by any person authorized to bind the Contractor with respect to the claim.
(e) For Contractor claims of $100,000 or less, the Contracting Officer must, if requested in writing by the Contractor, render a decision within 60 days of the request. For Contractor-certified claims over $100,000, the Contracting Officer must, within 60 days, decide the claim or notify the Contractor of the date by which the decision will be made.
(f) The Contracting Officer's decision must be final unless the Contractor appeals or files a suit as provided in 41 U.S.C. chapter 71.
(g) If the claim by the Contractor is submitted to the Contracting Officer or a claim by the Government is presented to the Contractor, the parties, by mutual consent, may agree to use alternative dispute resolution (ADR). If the Contractor refuses an offer for ADR, the Contractor must inform the Contracting Officer, in writing, of the Contractor's specific reasons for rejecting the offer.
(h)(1) The Government must pay interest on the amount found due and unpaid from the date that-
(i)The Contracting Officer receives the claim (certified, if required); or
(ii) Payment otherwise would be due, if that date is later, until the date of payment.
(2) For claims having defective certifications, interest must be paid from the date that the Contracting Officer initially receives the claim. Simple interest on claims must be paid at the rate, fixed by the Secretary of the Treasury as provided in the Act, which applies to the period during which the Contracting Officer receives the claim and then at the rate that applies for each 6-month period as fixed by the Treasury Secretary while the claim is pending.
(i) The Contractor must proceed diligently with performance of this contract, pending final resolution of any request for relief, claim, appeal, or action arising under or relating to the contract, and comply with any decision of the Contracting Officer.
II.44 52.216-18 ORDERING (AUG 2020)
(a) Any supplies and services to be furnished under this contract shall be ordered by issuance of delivery orders or task orders by the individuals or activities designated in the Schedule. Such orders may be issued at any point during the 60-month period of performance (the tentative period of performance is projected to commence on 8/01/2026 and conclude on 7/31/2031).
(b) All delivery orders or task orders are subject to the terms and conditions of this contract. In the event of conflict between a delivery order or task order and this contract, the contract shall control.
(c) A delivery order or task order is considered ‘‘issued’’ when –
(1) If sent by mail (includes transmittal by U.S. mail or private delivery service), the Government deposits the order in the mail;
(2) If sent by fax, the Government transmits the order to the Contractor’s fax number; or
(3) If sent electronically, the Government either --
(i) Posts a copy of the delivery order or task order to a Government document access system, and notice is sent to the Contractor; or
(ii) Distributes the delivery order or task order via email to the Contractor’s email address.
(d) Orders may be issued by methods other than those enumerated in this clause only if authorized in the contract.
II.45 52.216-19 ORDER LIMITATIONS (OCT 1995)
(a) Minimum order. When the Government requires supplies or services covered by this contract in an amount of less than $2,000.00, the Government is not obligated to purchase, nor is the Contractor obligated to furnish, those supplies or services under the contract.
(b) Maximum order. The Contractor is not obligated to honor--
(1) Any order for a single item in excess of $100,000.00;
(2) Any order for a combination of items in excess of $66,000,000.00; or
(3) A series of orders from the same ordering office within 3 days that together call for quantities exceeding the limitation in paragraph (b)(1) or (2) of this section.
(c) If this is a requirements contract (i.e., includes the Requirements clause at subsection 52.216-21 of the Federal Acquisition
Regulation (FAR)), the Government is not required to order a part of any one requirement from the Contractor if that requirement exceeds the maximum-order limitations in paragraph (b) of this section.
(d) Notwithstanding paragraphs (b) and (c) of this section, the Contractor shall honor any order exceeding the maximum order limitations in paragraph (b), unless that order (or orders) is returned to the ordering office within 3 days after issuance, with written notice stating the Contractor's intent not to ship the item (or items) called for and the reasons. Upon receiving this notice, the Government may acquire the supplies or services from another source.
II.46 52.216-22 INDEFINITE QUANTITY (OCT 2025)(DEVIATION 26-04)
(a) This is an indefinite-quantity contract for the supplies or services specified, and effective for the period stated, in the Schedule. The quantities of supplies and services specified in the Schedule are estimates only and are not purchased by this contract.
(b) Delivery or performance shall be made only as authorized by orders issued in accordance with the Ordering clause. The Contractor shall furnish to the Government, when and if ordered, the supplies or services specified in the Schedule up to and including the quantity designated in the Schedule as the "maximum." The Government shall order at least the quantity of supplies or services designated in the Schedule as the "minimum."
(c) Except for any limitations on quantities in the Order Limitations clause or in the Schedule, there is no limit on the number of orders that may be issued. The Government may issue orders requiring delivery to multiple destinations or performance at multiple locations.
(d) Any order issued during the effective period of this contract and not completed within that period shall be completed by the
Contractor within the time specified in the order. The contract shall govern the Contractor’s and Government’s rights and obligations with respect to that order to the same extent as if the order were completed during the contract’s effective period;
provided, that the Contractor shall not be required to make any deliveries under this contract after July 31, 2032.
II.47 52.217-7 OPTION FOR INCREASED QUANTITY-SEPARATELY PRICED LINE ITEM (MAR 1989)
The Government may require the delivery of the numbered line item, identified in the Schedule as an option item, in the quantity and at the price stated in the Schedule. The Contracting Officer may exercise the option by written notice to the Contractor within the ordering period of the contract. For services, this shall be no less than 10 calendar days before services commence. For supplies, delivery of added items shall continue at the same rate that like items are called for under the contract, unless the parties otherwise agree.
Performance of added services shall comply with the requirements identified in the Schedule.
II.48 52.217-8 OPTION TO EXTEND SERVICES (NOV 1999)
The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 10 days of contract expiration.
II.49 52.237-7 INDEMNIFICATION AND MEDICAL LIABILITY INSURANCE (OCT 2025) (DEVIATION 26-02
(a) It is expressly agreed and understood that this is a nonpersonal services contract, under which the professional services rendered by the Contractor are rendered in its capacity as an independent contractor. The Government may evaluate the quality of professional and administrative services provided, but retains no control over professional aspects of the services rendered, including by example, the Contractor's professional medical judgment, diagnosis, or specific medical treatments. The Contractor shall be solely liable for and expressly agrees to indemnify the Government with respect to any liability producing acts or omissions by it or by its employees or agents. The Contractor shall maintain during the term of this contract liability insurance issued by a responsible insurance carrier of not less than the following amount(s) per specialty per occurrence: $500,000.00.
(b) An apparently successful offeror, upon request by the Contracting Officer, shall furnish prior to contract award evidence of its insurability concerning the medical liability insurance required by paragraph (a) of this clause.
(c) Liability insurance may be on either an occurrences basis or on a claims-made basis. If the policy is on a claims-made basis, an extended reporting endorsement (tail) for a period of not less than 3 years after the end of the contract term must also be provided.
(d) Evidence of insurance documenting the required coverage for each health care provider who will perform under this contract shall be provided to the Contracting Officer prior to the commencement of services under this contract. If the insurance is on a claims-made basis and evidence of an extended reporting endorsement is not provided prior to the commencement of services, evidence of such endorsement shall be provided to the Contracting Officer prior to the expiration of this contract. Final payment under this contract shall be withheld until evidence of the extended reporting endorsement is provided to the Contracting Officer.
(e) The policies evidencing required insurance shall also contain an endorsement to the effect that any cancellation or material change adversely affecting the Government's interest shall not be effective until 30 days after the insurer or the Contractor gives written notice to the Contracting Officer. If during the performance period of the contract the Contractor changes insurance providers, the Contractor must provide evidence that the Government will be indemnified to the limits specified in paragraph (a) of this clause, for the entire period of the contract, either under the new policy, or a combination of old and new policies.
(f) The Contractor shall insert the substance of this clause, including this paragraph (f), in all subcontracts under this contract for health care services and shall require such subcontractors to provide evidence of and maintain insurance in accordance with paragraph (a) of this clause. At least 5 days before the commencement of work by any subcontractor, the Contractor shall furnish to the Contracting Officer evidence of such insurance.
II.50 52.243-1 CHANGES - FIXED-PRICE, ALTERNATE I (JUNE 2025)(DEVIATION 25-09)
(a)(1) At any time, the Contracting Officer may issue a written order to make changes within the scope of this contract in the services to be performed.
(2) If there are any sureties, the Contracting Officer does not need to notify them of a written order.
(b) Whether or not changed by the order, if any of the changes cause an increase or decrease in the cost of, or the time required for, performance of the work under this contract, the Contracting Officer shall make an equitable adjustment in the contract price, the delivery schedule, or both, and shall modify the contract.
(c) The Contractor must assert its right to an adjustment under this clause within 30 days from the date of receipt of the written order.
However, if the Contracting Officer decides that the facts justify it, the Contracting Officer may receive and act upon a proposal submitted before final payment of the contract.
(d) If the Contractor's proposal includes the cost of property made obsolete or has become excess by the change, the Contracting Officer shall have the right to prescribe the manner of the disposition of the property.
(e) Failure to agree to any adjustment shall be a dispute under the Disputes clause. However, nothing in this clause shall excuse the Contractor from proceeding with the contract as changed.
(f) No services for which an additional cost or fee will be charged by the Contractor shall be furnished without the prior written authorization of the Contracting Officer.
