226 PWS 1.2.32 e 31 Would the Government consider finishing out the POs with LMCO rather than novating POs to new prime?
What happens if vendors do not agree to novations? Can the Government compel them to?
If the new prime is allowed to replace the existing PO with its own, what happens if vendors do not agree to new prime’s terms?
Can the Government confirm that the current prime will not inhibit novation or transfer of POs?
In the case of novation, how will the new prime be protected from risk of late delivery or non-delivery?
What if pricing on outstanding POs was not fair and reasonable?
Will the Government’s system indicate and the audit determine if pre-payments or progress payments were made to avoid double billing/double payments?
At what point does ownership of part transition from supplier to CBP? When it is loaded onto delivery vehicle at point of origin? When it is offloaded at CBP premises?
There will no longer be a requirement for novation. CBP is re working the PWS to identify the requirements for the successor contractor to continue repair, accept delivery of any purchases that will continue beyond the expiration date of the existing P3 contract. The PWS will be finalized in a subsequent amendment
227 General Material Management Is the contractor allowed use Canadian / International sub-contractors and suppliers? The contractor shall propose in accordance with the terms and conditions of the RFP
228 General Information Technology Can the document management system (CARMAC) be accessed outside of the US? The document management system (CARMAC) can be accessed outside of the US under the stipulation that this must only be conducted through a GFE and that inputting/processing/storing/outputting CBP information cannot be performed on non-GFE devices.
229 PWS C.1.2.16 Page 19 The Contractor shall provide maintenance, logistics and depot support to OGA’s and foreign government-owned aircraft at the direction of the Contracting Officer or the COR. Such activities entails ground handling and servicing, and will be performed with the existing workforce, and not-to-interfere with operational requirements.
US Government-owned aircraft can be supported using an ITAR exemption if the appropriate clause is included in the contract. Is the Contracting Officer willing to include an ITAR exemption export authorization clause in the contract to enable exports and imports of hardware to and from the US without a license? Are you able to identify the foreign governments so that we can evaluate which export authorizations may be required to support work on their aircraft?
No exemption clauses will be added to the RFP. The Contractor shall comply with all applicable laws and regulations regarding export-controlled items, including, but not limited to, the requirement for contractors to register with the Department of State in accordance with the ITAR.
Contractors are required to flow down this requirement to their subcontractors.
We are not able to identify foreign governments at this time

Under Proposal Timeline, the Amendment 1 RFP instructions state, "Offerors’ Notification of Intent to participate in oral presentations due > 5 business days after CBP’s response to offerors’ questions are posted on FBO."
Given the inconsistencies remaining between Amendment 1 and the PWS (such as the Key Personnel requirement changed in RFP Section L but not the PWS), we ask the Government to resolve those inconsistencies in Amendment 2, and make the determination that the 5-day period begins at the time the Government posts answers to Questions 225-229 and to clarifying questions as Amendment 2.
There will be no change to the deadline for notification of participating in oral presentations
E.1; C.1.2.7
RFP 23; PWS 12 81, 158
The RFP Amendment 1 (E.1 52-252-2) states QA will comply with at a minimum AS9100C, while the Amendment 1 PWS (C.1.2.7) says, "The Contractor’s Quality Management System shall be certified AS9100 Rev D". Answers to questions 81 and 158 also appear to conflict.
Which certification is required? AS9100D is required. Clause E.6 52.246-11 has been updated.
PWS C.1.1.4, Q&A #80
8 In the answer to Question 80, the Government states, "Depot personnel are required to have repairman certificate in their area of expertise."
This conflicts with the FAA directive as follows: 14 CFR Part 145 certificated processes and procedures to deliver safe, quality aircraft maintenance depot services allows for a combination of FAA Licensed, Repairman Certificated and experienced maintenance personnel. FAA mandated oversight of all work and process ensures that all relevant quality and continued airworthiness requirements are met.
Will the Government please revise the requirement to cite compliance with the FAA directive.
The response to the Questions was related to a FAA Repair station. CBP does not require a Repairman certification at the Depot.
245 PWS In the answer to Question 225, the Government states, "The PWS has been revised to remove "COMPETITION SENSITIVE FOUO" from the footer.", however; the PWS still reflects COMPETITION SENSITIVE FOUO in the footer.
Will the Governemnt revise the PWS in another amendment? PWS was updated. Reposted with Amendment A0002
246 RFP H.3

MD 11055 is cited in both the RFP and PWS and establishes security procedures for the program, however, it is not available on the dhs.gov website. A copy of MD 11055 is requested.
Upon further review MD 11055 is no longer valid and has been removed from the Security Procedures clause and the PWS. H.3 SECURITY PROCEDURES (OCT 2009) is hereby replaced with H.3 SECURITY PROCEDURES (APR 2019). The PWS has been revised in accordance with H.3 dated Apr 2019
