RAs, by definition, contain priority resources and are established pursuant to DODM 5200.08 , Security of DoD Installations and Resources. Because priority resources are contained within the RA, a single security system and circulation controls are required and employed.
Access into this area is separately secured from the installation itself.
Access is highly controlled. Coordinate construction activities associated by this contract with existing RA access control and security procedures.
The process and procedures to enter the RA are different than the general requirements to enter the installation boundary. As referenced, the US Army Corps of Engineers (in collaboration with Base Civil Engineering Squadron) will coordinate RA entry with the resource managers of the areas on the installation and with the Base Security Forces Squadron (SFS).
1.8.1 Right to Deny Entry into RA
The Installation Commander or designated representative reserves the right to deny entry to any Contractor whose NAC is unfavorable, and the right to terminate the entry authorization of any Contractor employee upon disclosure of information which indicates the individual's continued entry to the installation and the RA is not in the best interest of national security.
1.8.2 Contractor-Provided Escorts
Provide escorts and/or CAGs as required to fully execute the scope of work defined by this contract in compliance with the security requirements established herein and in the approved SSAMP. This may be accomplished by self-escorting personnel, employing Cleared American Guards (CAGs), and/or a combination of both - as indicated in the approved SSAMP.
Work at the high security facility or communications system inside the RA will require SECRET cleared workers with RA Badges or the contractor provided personel escourt who posess the SECRET clearance and RA authorized escort badges.
Provide escorts under the following constraints:
a. Work within the RA requires Contractor-provided escorts or Cleared American Guard (CAG) oversight as defined herein.
b. Finally, work within the RA perimeter fence serving the RA requires Contractor-provided escorts or CAG oversight as defined herein.
Obtain RA escort badging and/or employ the services of escorts (CAGs) to fully execute the work within the constraints defined herein.
SECTION 01 14 00 Page 11
1.8.2.1 Escort Ratios
Provide escorts and CAGs complying with the most-stringent of the following on each work activity:
a. No more than 10 escortees for every single (1) escort or guard (maximum 10:1 ratio).
b. Direct line-of-sight to all assigned escortees at all times. Certain work activities may require more escorts than the maximum ratio allows.
Clearly communicate plan for Contractor-provided escorts/CAGs in relation to work activities in the SSAMP.
1.8.2.2 Self-Escort Badging
Assume that the Government will issue up to two "escort authorized" badges to the Contractor during the duration of construction under the terms described herein. Each requesting applicant must have a completed National Agency Check (NAC) with 'Tier 1' status. Escorts must also comply with the badging requirements indicated above, attend any required RA escort training, and return their "escort authorized" badge upon completion of activities that necessitate the escort privilege. USACE will sponsor NACs for the two referenced personnel. Background check times vary, but may take up to 90 days. Complete all required forms, fingerprints, and background information as required for the NAC. Blank forms will be provided upon request. USACE will not be held responsible for schedule delays associated with personnel that do not pass the NAC and are unable to be cleared for badging/escort privileges.
1.8.2.3 Cleared American Guards (CAGs)
As an alternative, employ the services of CAGs in order to address escort requirements on the project. Ensure CAGs meet the following requirements:
a. Possess an active SECRET security clearance as verified by DEFENSE INFORMATION SECURITY SYSTEM (DISS) and must be an American citizen.
SECRET clearance must be maintained throughout the entire contract performance period.
b. Able to communicate effectively in both written and oral English.
c. Be active and fit enough to conduct their role on an active construction site. They must provide their own Personal Protective Equipment (PPE) and training appropriate for themselves, in compliance with EM 385-1-1 .
d. Wear uniforms at all times. These uniforms must clearly identify the name of the contractor and the name of the individual performing under this contract. This identification may be accomplished through the use of shoulder patches, silk screening or stitched company emblems, insignias, or logos.
1.8.3 Contractor-Provided Security Expeditor
In addition to any required escorts, provide not less than one part-time security expeditor whose function is to serve as a liaison with SFS and Government security personnel in order to facilitate coordinated execution of all security and access requirements for the entire duration of the
SECTION 01 14 00 Page 12 project. The security expeditor must meet all Cleared American Guard (CAG) requirements listed above. The expeditor's duties include but are not limited to the following:
a. Serve as a primary point of coordination between the Prime Contractor, USACE, SFS, the project SSM, and other project security personnel.
b. Develop and maintain all required EALs (base access, RA access, etc.).
c. Develop, coordinate, maintain, and facilitate execution of the SSAMP during project execution.
d. Facilitate coordinated access from the Base Perimeter Entry Control Point (ECP), the Project ECP, any RA ECP, to the project site(s) and any other work areas defined herein.
1.9 ACCESS AND SECURITY ROLES AND RESPONSIBILITIES
1.9.1 Access to Construction Site
Construct the construction zone fence to the requirements of this contract. After SFS inspects and approves the construction zone fence, the site will be considered outside the RA. Manage access as if it is no longer part of the RA. RA requirements will only apply where those more restrictive conditions occur on the project.
1.9.2 Access Within RA, Outside Construction Zone Fence , no Free Zone
The Government's intent is for minimal work to occur outside of the construction zone fence. Some utility connections and similar activities may necessitate such work. When work inside the RA, but outside of the construction zone fence or a Free Zone is required, comply with the following:
1.9.2.1 Contractor Responsibilities
a. Conduct initial vetting for workers using e-Verify to confirm all workers are US Citizens and present a roster of all workers to the Site Security Manager (SSM, Government) who will verify using birth certificate, passport, or I-9 approved identification. The Government will not allow access to any additional workers added after submission of the initial roster until completion of proper vetting, which may take up to 30 days.
b. After successful validation of US Citizen status, the SSM will add validated construction workers to the access control roster, issue a site access badge, and provide a security briefing. While on site, workers will keep the security badge in their possession while on site and present for access to any secure or controlled area.
c. All construction workers performing work within the RA perimeter will either be SECRET cleared workers or will be escorted (via Contractor-provided escorts or CAGs) at all times. Work within specific buildings, 300, 400, 600, 712, 780, etc. will require an escort, will have to be coordinated with that specific area and the official escort. The contract/contractor will have to provide the cleared escorts.
d. Workers will enter the site through the controlled access point only
SECTION 01 14 00 Page 13 and must be on the controlled access roster provided to the onsite guard.
e. The Government will not authorize Privately Owned Vehicles (POVs) within the RA. Only marked commercial and construction vehicles will be allowed access after validation through the SSM and inspection and checking at the controlled access point. The Government will make POV parking for workers available in the vicinity of the Project site, outside the RA.
f. The SSM or SFS will validate all construction equipment entering the
RA.
g. To perform work outside normal working hours, coordinate the requirement as prescribed in Section 01 30 00.24 OTHER ADMINISTRATIVE
AND SPECIAL REQUIREMENTS.
h. Provide direct oversight and escorting for such work activities, as well as management of the controlled access point managing access to the RA in coordination with SFS and SSM.
1.9.2.2 Government Responsibilities
a. Security oversight and vetting.
b. Re-verification of contractor's vetting of employees as US Citizen status.
c. At the end of each work day the Government will check the construction site to verify all workers have departed, secure the work site, and may perform random checks until the next work day.
d. As required for inspection, the SSM or SFS will randomly select materials from general stock for use in construction.
e. The SSM or SFS will maintain all site access log information (visitors, workers, security events, access control logs, etc).
1.9.3 Work On or Around RA Perimeter Fence
The existing RA fence and associated security and lighting systems must remain operational during the entirety of construction. This project is not anticipated to require any modification, re-alignment and/or re-establishment of the RA fence.
1.9.3.1 Contractor Responsibilities
a. The Government will not authorize Privately Owned Vehicles (POVs) within the RA. Only marked commercial and construction vehicles will be allowed access after validation through the controlled access point. The Government will make POV parking available in the vicinity of the Project site, outside the RA.
b. The Contractor's security specialist will validate all construction equipment entering the RA in coordination with SFS.
c. To perform work outside normal working hours, coordinate the requirement as prescribed in 01 30 00.24 OTHER ADMINISTRATIVE AND
SPECIAL REQUIREMENTS.
SECTION 01 14 00 Page 14
d. Provide direct oversight and escorting for such work activities in coordination with SFS.
e. Do not stockpile materials inside the RA. Stockpile materials outside the RA and bring to the work activity site to prepare and/or install.
Remove materials not installed during the working day outside the RA unless approved by the Contracting Officer.
f. RA entry point and temporary lighting during any work outside of daylight hours.
g. Maintain a clean and organized construction site. Store/park equipment within the project site as directed by the SFS, in compliance with RA requirements. Do not store equipment within 30 feet of any Free Zone or RA perimeter fence(s), unless specifically authorized in writing by
SFS.
1.9.3.2 Government Responsibilities
a. Free Zone and RA security oversight and vetting.
1.9.4 Requesting New Free Zones within RA
The Government may approve additional free work zones when deemed appropriate for the work activity(ies) and when such a perimeter reduces oversight and escort burdens on the Government and/or Contractor.
To establish a new free work zone, provide appropriate documentation as an amendment to the approved SSAMP not less than 30 calendar days prior to the anticipated start date. Do not consider the free zone approved until notified as such by the Contracting Officer.
1.10 INFORMATION ACCESS
Contractor access to classified information is prohibited. When Contractor performance occurs within restricted or controlled areas, or within close physical proximity of classified information, Contractor compliance with various levels of security instructions is required.
1.11 COMMUNICATIONS SECURITY (COMSEC) MONITORING
Contractor personnel are advised that any time they place a call or receive a call from a DoD organization, they are subject to COMSEC procedures, such as monitoring. All communications with DoD organizations are subject to COMSEC review. Telecommunications networks are continually subject to intercept by unfriendly intelligence organizations. The DoD has
SECTION 01 14 00 Page 15 authorized the military departments to conduct COMSEC monitoring and recording of telephone calls originating from or termination of DoD organizations. Ensure all contractor employees are informed of the provisions of this paragraph.
1.12 RECORDING DEVICES
Do not bring cameras, cell phones, computers, radios and any other electronic devices in the construction RA perimeter unless specific approval (with letter) is granted from SFS and SSM. Approval of any electronic devices is at the discretion of the Government.
Request approval for such devices through the US Army Corps of Engineers (USACE) (in collaboration with Base Civil Engineering Squadron and Base Security Forces Squadron), not less than 14 days in advance of required usage. Include approved devices in the approved equipment list.
1.13 RADIOS
Provide professional grade, two-way radios (without recording capability, with charging stations) in a quantity necessary for operation of the project site under the constraints listed herein.
In addition, provide the Government with access to not less than 3 radios for the duration of construction. Provide referenced radios from the time that construction commences on site, through the duration of the project.
1.14 CELLULAR PHONES
The Government will authorize a reasonable, limited quantity of phones for use within the RA perimeter to complete the work and meet all safety, quality, and other contract requirements. Phones or recording devices for every individual entering the RA perimeter will not be allowed; devices will only be allowed for key contractor/subcontractor management, quality, safety, etc. The Government will not permit phones with 5G bandwidth for use within the RA perimeters. Phones may not be equipped with cameras unless the SSM authorizes use of the camera in writing. Phones without Bluetooth capability are preferred. If phones have Bluetooth capability, disable that functionality at all times while in the RA perimeter. Cameras will only be authorized by the SSM in a reasonable limited quantity to complete the work and meet all safety, quality, and other contract requirements. As part of the SSAMP, submit and maintain a list of phones and recording devices that are approved for use and account for each device when entering and exiting the RA perimeter. Submit all devices and obtain approval by the SSM prior to use. Vet any photos recorded by cameras through SSM prior to any use outside the project site or transferring from recording device to other electronic equipment or system.
All devices are subject to SSM inspection at any time while in the restricted area.

1.3 DESIGN-BUILD CONSTRUCTION CONTRACTS (MAR 2019)
(a) Design-Build Contract Order of Precedence. The contract includes the standard contract clauses and schedules current at the time of contract award. It entails (1) the Solicitation in its entirety, including all drawings, cuts, and illustrations, and any amendments, and (2) the successful offeror’s accepted proposal. The contract constitutes and defines the entire agreement between the Contractor and the Government. No documentation shall be omitted which in any way bears upon the terms of that agreement.
(1) In the event of conflict or inconsistency between any portion of this contract, precedence shall be given in the following order:
i. Betterments: Any portions of the accepted proposal which both conform to and exceed the requirements of the Solicitation.
ii. The requirements of the Solicitation. (See also FAR 52.236-21, Specifications and Drawings for Construction)
SECTION 01 30 00.24 Page 3
iii. All other elements of the accepted proposal.
iv. Any design products including, but not limited to, plans, specifications, engineering studies and analyses, shop drawings, equipment installation drawings, etc. These are "deliverables" under the contract and are not part of the contract itself. Design products must conform to all provisions of the contract, in the order of precedence herein.
(b) Personnel, subcontractors, and outside associates or consultants. In connection with this contract, any in-house personnel, subcontractors, and outside associates or consultants will be limited to individuals or firms that were specifically identified in the Contractor's accepted proposal. The Contractor shall obtain the Contracting Officer's written consent before making any substitution for these designated in-house personnel, subcontractors, associates, or consultants. If the Contractor proposes a substitution, it shall submit the same type of information that was submitted in the accepted proposal to the Contracting Officer for evaluation and approval. The level of qualifications and experience submitted in the accepted proposal or that required by the Solicitation, whichever is greater, is the minimum standard for any substitution.
(c) Responsibility of the Contractor for Design. The Contractor shall be responsible for the professional quality, technical accuracy, and the coordination of all designs, drawings, specifications, and other non-construction services furnished by the Contractor under this contract.
The Contractor shall, without additional compensation, correct or revise any errors or deficiency in its designs, drawings, specifications, and other non-construction services and perform any necessary rework or modifications, including any damage to real or personal property, resulting from the design error or omission.
(1) The standard of care for all design services performed under this agreement shall be the care and skill ordinarily used by members of the architectural or engineering professions practicing under similar conditions at the same time and locality. Notwithstanding the above, in the event that the contract specifies that portions of the Work be performed in accordance with a performance standard, the design services shall be performed so as to achieve such standards.
(2) Neither the Government's review, approval or acceptance of, nor payment for, the services required under this contract, shall be construed to operate as a waiver of any rights under this contract or of any cause of action arising out of the performance of this contract. The Contractor shall be and remain liable to the Government in accordance with applicable law for all damages to the Government caused by the Contractor's negligent performance of any of these services furnished under this contract.
(3) The rights and remedies of the Government provided for under this contract are in addition to any other rights and remedies provided by law.
(4) If the Contractor is comprised of more than one legal entity, each entity shall be jointly and severally liable hereunder.
(d) Contractor's Role during the Design Process. The Contractor's
SECTION 01 30 00.24 Page 4 construction management key personnel shall be actively involved during the design process to effectively integrate the design and construction requirements of this contract.
