Summary of AS26-68 Walk-In Building Supplies - NASPO ValuePoint RFP

This Scope of Work document pertains to a Request for Proposals issued by the State of Utah in collaboration with the NASPO ValuePoint cooperative purchasing program for the re-solicitation of the Walk-In Building Supplies portfolio. The RFP seeks qualified vendors to provide building supplies through retail locations on a national cooperative contract basis, with the resultant Master Agreement(s) serving as convenience purchase agreements for participating entities including states, cities, counties, and municipalities. The contract term is five years, with vendors required to guarantee their minimum percentage discount for the entire contract duration. While national coverage is preferred, state-by-state offerors offering coverage in specific states will be considered for award on an individual state basis. Proposals must be submitted through the U3P Platform (Bonfire), and the RFP may result in multiple awards based on a methodology where any offeror achieving a total of 600 points or higher after passing technical criteria threshold requirements receives an award.

Pricing terms require vendors to maintain guaranteed minimum percentage discounts throughout the contract period, with the discount provided to purchasing entities at the time of purchase. The current Walk-In Building Supplies agreement is set to expire on July 31, 2027. This is a cooperative purchasing initiative designed to provide procurement flexibility and cost savings to a broad range of public sector entities across the nation. Additional evaluation criteria and detailed requirements are contained in Attachment C, the RFP Evaluation Plan.

SCOPE OF WORK

This Scope of Work describes the Deliverables being sought through this RFP and the scope of what Contractors will be expected to offer through a Master Agreement resulting from this RFP. The Scope of Work is intended to provide potential Offerors with sufficient basic information to submit a proposal. It is not intended to limit a proposal's content or exclude any relevant or essential data.

1. OVERVIEW

The purpose of this Master Agreement is to provide building supplies on a walk-in basis for all Participating Entities. This Contract is for convenience purchases at retail locations and the Contract discount will be provided to the Purchasing Entity at the time of purchase. This is a national cooperative contract that many Participating Entities such as states, cities, counties, and municipalities may use.

2. DEFINITIONS

A. Contract means a Master Agreement, resulting from this RFP, that is executed by and between a successful Offeror and the Lead State, acting in collaboration with NASPO ValuePoint.

B. Contractor means an awarded Offeror with whom the Lead State executes a Master Agreement for Walk-In Building Supplies.

C. Level III Reporting means, in addition to tax amounts and customer codes (Level 2 data), Level 3 data includes item information such as product, code, item quantity, description, unit of measure, unit cost, and more. Level III transactions require the following data fields: Ship-from ZIP/postal code. Ship-to/destination ZIP code.

D. NASPO ValuePoint means the cooperative contracting division of NASPO.

E. Participating Addendum (PA) means a contract, referencing a Master Agreement, that is executed by and between a Contractor and a Participating Entity and may include Participating Entity-specific requirements and terms.

F. Purchasing Entity means a state, or another entity, authorized to use a Participating Addendum, that issues an Order under a Master Agreement resulting from this RFP through a Participating Entity’s Participating Addendum.

G. Participating Entity means a state, or another entity authorized to enter into a Participating Addendum, that executes a Participating Addendum with a Contractor.

H. PCI means Payment Card Industry.

I. SOC2 means the cybersecurity compliance framework developed by the American Institute of Certified Public Accountants (AICPA).

3. PRICING

The pricing will be a minimum percentage discount off the current retail price at the time of purchase for all items in the Contractor’s store. If the item purchased is on sale or under another promotional term, the Purchasing Entity will expect to receive the lower of the current retail sale price/promotional price or the retail price with the contractual minimum percentage discount at the time of purchase. The minimum percentage off will remain firm for the entire duration of the Contract. Sales tax or other fees shall be determined by the Participating State or Participating Entity in their Participating Addendum (PA). It is understood that even though the Contract is for a minimum percentage discount off retail pricing, deeper discounts may be applied.

4. INVOICING

When paying with a Purchase Order (PO), invoicing terms and conditions will be addressed in the Participating Entity’s PA.

5. INVENTORY

The purpose of this Master Agreement is to establish a minimum percentage discount on all inventory offered within the Contractor’s stores.

6. PURCHASES

Purchases resulting from this Contract will be initiated by the Purchasing Entity with the Contractor. The Contractor must generate an invoice with the correct retail price and the appropriate percentage off amount listed.

The Contractor must be willing to accept the various credit cards and purchasing cards from the Participating Entities as payment without extra charges or fees. Many Participating Entities do not allow credit card or purchasing card information to be stored with a third party. The Contractor shall not require the Purchasing Entity to store the Purchasing Entity’s credit card or purchasing card information in the Contractor’s system. The Contractor shall not require the Purchasing Entity to obtain a store credit card specific to the Contractor or a similar line of credit for purchases. The Purchasing Entity may also choose account billing with the Contractor. These details may be negotiated with the Participating Entity in their PA.

7. ORDERING

If the Purchasing Entity is in the store and an item is not available, they may order it from the Contractor while in store and pay at the time of ordering using the agreed upon method described in their PA.

8. TRAINING

The Contractor shall train all in-store staff on this Contract and discounts. The Contractor must also ensure ongoing training for new staff and Contract updates. At the request of the Purchasing Entity, the Contractor shall train the Purchasing Entity’s buyers on using the Contract.

9. DATA SECURITY

The Contractor must have data security in place for the duration of the Contract. Contractor must meet or exceed the level of PCI compliance required based on the Contractor’s total number of transactions annually. Contractor must also meet SOC2 requirements if the Contractor stores the Customer’s personal information.

Any Purchasing Entity’s data shall not be stored, accessed, transmitted, or otherwise accessed outside of the United States.

10. REPORTING

Participating Entities may request regular or Ad Hoc reporting at any time. For billing purposes, Level III reporting is preferred.

11. RETURNS

The Contractor shall allow returns for at least 90 days from the purchase date.
