About this file
This is a Technical Questions and Responses Tracking Sheet for Solicitation 36C77626B0002, the Brooklyn EHRM Infrastructure Upgrades Construction project for the Department of Veterans Affairs. The document contains 90 contractor questions and corresponding VA responses addressing contract terms, project requirements, and technical specifications.
Key contractual terms clarified include: the requirement remains a firm-fixed-price contract with a 90-calendar-day price-hold period; no Economic Price Adjustment (EPA) clause will be included; and the project is a 100% Service-Disabled Veteran-Owned Small Business (SDVOSB) set-aside requiring the prime contractor to be certified in the SBA database or comply with joint venture certification requirements in 13 CFR 128.402. A Project Labor Agreement is required and must be submitted after contract award per FAR 52.222-33 and 52.222-34. The VA expects to issue a Notice to Proceed within 90 days of award. For tax treatment, contractors must reference FAR 52.229-3 regarding Federal, State, and Local Taxes; tariff increases not anticipated at award may qualify for price adjustments if properly documented. The Buy American Act applies per FAR 52.225-11 and 52.225-12, with deviations requiring specific justification. Design team members are precluded from participating in construction as prime contractors, subcontractors, or Mentor-Protégé partners.
Project-specific requirements include: ICRA (Infection Control Risk Assessment) requirements in medium and high-risk areas with likely ICRA III and IV classifications; VAReview periods of 21 calendar days for submittals and RFIs; VA PIV badging mandatory for all on-site personnel; contractor responsibility for utilities locate and markout services via private companies (GPRS) for duct bank installations; and phasing plans required for parking lot work. The VA will provide active electronics (switches, routers, firewalls) and relocate existing equipment to new racks; contractors must provide security device cabling and conduit (Division 28 responsibility), camera licenses (minimum 1-year), access control device licenses, and hardware storage arrays for video surveillance. Fire alarm modifications must be compatible with the existing Notifier system; Continental access control components are required with card readers selected from VA's approved product list; and Pelco cameras are recommended but compatible alternatives are acceptable. The project involves fiber optic and inside wiring installation, termination, and testing in occupied buildings with existing functionality maintenance required until cutover completion.

TECHNICAL QUESTIONS AND SOLICITATION #: 36C77626B0002
RESPONSES TRACKING SHEET PROJECT TITLE: Brooklyn EHRM Infrastructure Upgrades Construction
# CONTRACTOR QUESTION VA RESPONSE
1 Due to the instability in our current economy such as price escalations, procurement issues, and vendors unable to reasonably hold prices for more than 30 days, please change the contract type to a fixed-price contract with economic price adjustment pursuant to FAR 16.203.
In accordance with FAR 16.202 and 52.216-1, this requirement will remain a firm-fixed-price contract.
2 Due to the instability in our current economy such as price escalations, procurement issues, and vendors unable to reasonably hold prices for more than 30 days, please reduce the price-hold period to 30 days.
The Government standard concerning price-hold period is 90 calendar days and will not be altered.
3 The solicitation does not currently include an economic price adjustment clause such as FAR 52.216-4. In today’s market, significant volatility in both labor rates and material costs presents a challenge for bidders to estimate pricing accurately without including broad contingency allowances. This may result in higher bids and reduced competitiveness.
The inclusion of an EPA clause would allow for fair price adjustments tied to actual cost changes, improving pricing accuracy for the government.
Will the Contracting Officer consider including FAR 52.216-4 Economic Price Adjustment – Labor and Material in the contract to mitigate risk related to market fluctuations and reduce the need for contingency-based pricing?
FAR 52.216-4 will not be included.
4 Is this project tax exempt and will the government/VA provide a tax exemption certificate?
See Special Note regarding FAR 52.229-3 Federal, State, and Local Taxes in the solicitation.
5 We would like to respectfully request clarification regarding the applicability of FAR 52.229-3 – Federal, State, and Local Taxes in the context of potential material price escalations arising from pending tariffs.
Specifically, we are seeking to understand whether this clause would afford any contractual relief or price adjustment mechanisms in the event that new or increased tariffs are imposed on imported materials after contract award, thereby affecting the cost basis for materials included in our pricing proposal. Our intent is to ensure that any potential risk from such government-imposed cost changes is addressed appropriately under the contract terms, or whether alternative provisions (e.g., economic price adjustment clauses or contract modifications) may be more applicable for consideration. Please confirm if FAR 52.229-3 is intended to apply to increases in material costs due to tariff changes?
If after the contract is awarded, the contractor becomes liable for an increase (or receives a reduction) in a federal excise tax or duty “which was not otherwise anticipated,” the contract price may be adjusted accordingly.
To recover under FAR 52.229-3, the contractor generally must show:
The tariff was not in effect or anticipated at the time of award;
The tariff is a federal duty or tax covered by the clause;
The tariff directly increased the contractor’s cost of performance;
The contractor timely notifies the contracting officer of the change; and The contractor can substantiate the increased costs attributable to the tariff.
6 Will the VA allow deviations to Buy American Act if the noted products are not available?
The process of requesting exceptions to the Buy American Act is detailed in the provision at FAR 52.225-12, Notice of Buy American Requirement—Construction Materials Under Trade Agreements, and the clause at FAR 52.225-11 Buy American—Construction Materials under Trade Agreements, in the solicitation. Any items not compliant must be specifically listed in the offer.
7 The solicitation states this project is “set aside for Service-Disabled Veteran Owned Small Business” – does this mean that general contractors cannot bid the project unless they meet that requirement?
Yes, this project is a 100% set-aside for SDVOSBs. The prime contractor submitting the offer must be certified as such in the SBA certification database or comply with the joint venture certification requirements in 13 CFR 128.402.
8 Please clarify that a joint venture offeror is not required to be listed as “certified” in the SBA’s certification database since the SBA no longer certifies SDVOSB joint ventures. Only the SDVOSB managing member of the JV offeror is required to be listed as “certified” in the database.
Correct. A joint venture may be considered eligible as an SDVOSB if the joint venture complies with the requirements in 13 CFR 128.402.
9 During the walkthrough conference call, Kara mentioned that a joint venture is acceptable. Could you please clarify if a teaming agreement would be acceptable as well?
An offeror using a teaming arrangement can bid on this project if they are a certified SDVOSB and comply with the limitations on subcontracting detailed in VAAR clause 852.219-75.
10 We would like to bid the Brooklyn EHRM Infrastructure Upgrades @ VA Medical Center, however there is a SDVOSB goal of 100% which may exclude us because we are not a SDVOSB Contractor. Is being SDVOSB Contractor a requirement to bid the project?
Yes. We will only accept bids from general contractors that are certified SDVOSBs for this solicitation. However, the awarded GC will coordinate their own subcontractors. As long as the GC complies with the limitations on subcontracting detailed in VAAR clause 852.219-75, they can hire non-SDVOSB subcontractors for the project.
11 We are a national low-voltage contractor specializing in Division 27 and 28, with a strong W-2 team, competitive rates, and a quick estimate turnaround. Please let me know if you’re accepting bids and how we can proceed.
This construction contract will be awarded in whole to a prime contractor who will coordinate their own subs. We do not issue separate solicitations for different portions of the work, and we will not consider offers for individual products or services.
12 I wanted to express interest in supporting the security-related aspects of this project. Our team specializes in physical security services and solutions for healthcare, government, and critical infrastructure facilities.
If appropriate, I would appreciate guidance on the best way to engage during the solicitation process, including any opportunities for site visits, bid coordination, or subcontractor participation related to the physical security scope.

The question deadline will not be extended. The VA will try to answer any late or follow-up questions received but cannot guarantee responses will be provided.
20 Due to the size of the project, would the VA consider extending the due date if additional question are submitted?
The due date will not be extended at this time. The VA will consider extending the due date if it is deemed necessary.
21 Can we extend the solicitation due date for an additional month? No.
22 For planning the preliminary project schedule, please provide an anticipated award date.
Since the solicitation has not closed yet and we do not know the bid results, we cannot determine a specific award date. We intend to award as soon as we can after bid opening.
23 What is the approximate duration between issuing the award and issuing the NTP?
The VA expects to issue the notice to proceed within 90 days after award. However, the government does not guarantee that timeline.
24 When is the anticipated Notice to Proceed date? A specific date for the notice to proceed cannot be estimated at this time. See response to question 23.
25 Please provide the latest wage determination for this project’s county. Wage determinations have been provided and will be checked regularly during the solicitation period and updated as needed.
https://www.va.gov/oal/business/pps/deviations.asp
26 Please confirm if the current prevailing wages will be consistent for the life of the project with no escalation?
Any requests for adjustments to contract price as a result of changes in wage rate determinations will be made IAW FAR and FAR supplement requirements.
27 What is the policy if conditions not clearly identified within the contract documents are encountered during construction? Will the VA consider this a differing site condition and issue a contract modification for the additional work required?
See spec section 01 00 00, 1.7 Alterations. The contractor must exercise due diligence in the preparation of their bid to reasonably account for all work the contract identifies or establishes. Any discrepancies with existing conditions must be brought to the attention of the COR and CO. If the Government determines any work necessary to be performed is not already a requirement of the contract, an appropriate modification will be issued IAW FAR 52.236-2, Differing Site Conditions, and FAR 52.243-4, Changes. No modification will be issued for work determined to be within the contract requirements.
28 Due to the work timeline, construction materials will need to be procured prior to installation and stored for an extended amount of time. Will the VA pay the contractor for procured and/or stored materials?
In accordance with contract terms and conditions, contractors should not submit an offer assuming the Government will approve monthly progress payments for material and/or equipment procured by the contractor and stored on the construction site, as space is available, or at a local approved location off the site. Payment of stored materials and/or equipment is at the Contracting Officer’s discretion and will be handled on a case-by-case basis during the contract and under such terms and conditions as the Contracting Officer approves. Routine construction materials are not likely to be approved for stored material payments (wood, metals, fiber cables, wires, piping, etc.). Items that are unusually long lead that must be procured far in advance to ensure their availability during construction and custom fabricated major components may be considered, however that decision will remain with the Contracting Officer. Stored material payments are not a method to finance the contract; contractors shall be financially fit enough to perform the contract’s requirements.
29 How many calendar days should be included in the critical-path method schedule for owner and A/E submittal review? For the owner and A/E to review and respond to RFIs?
