This Amendment is to:
1. RESCIND Amendment 0008, Dated 2/25/2025 in its entirety.
1. Remove the requirement of a Project Labor Agreements.

1. Due to a Court Of Federal Claims (COFC) Ruling, on January 19, 2025, the COFC issued an opinion and order in MVL USA, Inc., et al. v. The United States. In the decision the court concluded requiring the use of project labor agreements (“PLAs”) on large-scale federal construction projects valued more than 35 million, violated the Competition in Contracting Act (CICA). The court summarized as follows: “the PLA mandate precludes full and open competition by effectively excluding [a non-PLA] offeror from winning an award—both in the function of the mandatory rule itself and in the apparent policy to deny exceptions even when the agency itself commissions data indicating an exception should be made.”[footnoteRef:1] In addition, COFC found that no exceptions to CICA apply to the PLA mandate. The court found that the “government’s argument the PLA mandate is “authorized by law” falls short of the express statutory authorization mandated by Congress in § 3301(a) of CICA.”[footnoteRef:2] [1: COFC, MVL USA, Inc., et al. v. 1. Due to the COFC conclusions, the Contracting Officer will not require a PLA for the Amarillo EHRM Infrastructure Upgrades Construction Project at the Amarillo, VA Medical Center (VAMC), TX.
1. Extend the Due date of proposals to 3/14/2024.
1. All offers must follow all the submission instructions as included in the original solicitation as amended.
1. Acknowledgement of this and ALL Amendments is required.
