About this file
This is Amendment 0001 to solicitation 36C26124R0035 for a Design-Build/Design-Bid-Build Service Disabled Veteran Owned Small Business (SDVOSB) Multiple Award Construction Contract (MACC) issued by the VA Pacific Islands Health Care System. The amendment provides answers to 23 contractor questions about proposal requirements, including clarifications on EMR documentation, past performance submissions, project data sheets, and technical proposal formatting.
Key clarifications include: NCCI documentation is acceptable for EMR ratings; CPARs may be submitted in lieu of PPQs for past performance; Procore is acceptable as the construction management software; the seed project is Design-Bid-Build; contract ceiling remains at $50M per awardee; Project Labor Agreements are not required; and the maximum order limit is corrected to $10M per task order. The amendment also replaces Attachment A with a revised Construction & Design Experience Project Data Sheet and updates VAAR 852.219-75. The proposal due date remains unchanged from the original solicitation date of January 27, 2025.

Priscilla A. Murray Contracting Officer, NCO 21
36C26124R0035 Design-Build/Design-Bid-Build SDVOSB MACC, VISN 21 RFIs as of 20250212
Question 1: Technical Proposal – Factor 1 – Safety: Submittal Requirement (1) states that the offeror is to provide their EMR or verifiable equivalent, from their insurance company or from their state, based off the offeror’s state of incorporation’s EMR requirements. Our state of incorporation is a member of the National Council on Compensation Insurance (NCCI). Can we provide an NCCI document to demonstrate our EMR rating in lieu of a letter from our insurance company?
Government Response: Documentation of an offeror’s EMR from National Council on Compensation Insurance (NCCI) is acceptable.
Question 2: Technical Proposal – Factor 3 – Past Performance states that a completed Past Performance Questionnaire should be emailed directly to VISN 21. There are several projects that we may include that have an official CPAR evaluation. Many times, if a formal CPAR evaluation exists our POC’s will not submit additional past performance information since the CPAR is the “Official Performance Evaluation” for the project. If an official CPAR exists for a project we are submitting for Factor 2 – Recent, Relevant Experience of the Firm can we include it within the Factor 3 – Past Performance portion of our proposal in lieu of having a past performance questionnaire submitted directly to VISN 21?
Government Response: A CPAR may be submitted in lieu of a PPQ. Offer must clearly state/identify the projects submitted for Factor 2 and those for Factor 3.
Question 3: Technical Proposal – Factor 3 – Past Performance states that a completed Past Performance Questionnaire should be emailed directly to VISN 21. If the contractor has an existing Past Performance Questionnaire, on file, that is identical to the one included within the VISN 21 solicitation for a project we are submitting in Factor 2 – Recent, Relevant Experience of the Firm can we include it within the Factor 3 – Past Performance portion of our proposal in lieu of having a past performance questionnaire submitted directly to VISN 21? This allows us to stop continuously inundating our POC’s with past performance questionnaires, that they have completed multiple times, and do not have the time within their schedule to continue fulfilling these requests.
Government Response: A CPARs may be submitted in lieu of a PPQ. Offer must clearly
Question 4: Factor 1 – Safety (1) Experience Modification Rate states “submit your EMR (which compares your company’s annual losses in insurance claims against its policy premium over a three (3) year period.” Please confirm if the government wishes the offeror to provide only its most recent EMR (i.e., November 2024 – November 2025, 1.00) or its most recent three EMRs (i.e. 2024 – 2025, 1.00, 2023-2024, 1.00 and 2022-2023, 1.00) Government Response: Offeror should provide a single EMR that incorporates a 3-year policy period. The effective date of the EMR shall be no older than 12 months, at time of proposal receipt.
Question 5: Reference Evaluation Factors for Award, Part II – Evaluation Criteria, Factor 2 Recent Relevant Experience of the Firm (RFP Page 58 of 124): This section indicates projects shall be submitted on Attachment A. It also indicates the Government will not consider information submitted in addition to this form (except as specifically requested) and that the total length for each project data sheet shall not exceed two (2) double-sided pages (or four (4) single-sided pages).
a. This section states, “Provide a detailed summary of the most recent five (5) projects that includes:” and this is followed by a bullet-point list of items the Government is looking for.
Not all of these items are asked for i n Attachment A (ex. Subcontractors (Roles, Responsibilities, Percent of work), project location address). Please clarify where on this form we are to include project information that is asked for in the RFP but not asked for in Attachment A.
Government Response: Requested information that does not have a specific space in Attachment A can be included within the narrative in Section D.
b. This section also states, “In addition, for each project submitted, Offeror’s shall provide a narrative that describes recent successful performance and demonstrates experience working on a healthcare installation. Information should include details on complexity, magnitude, challenges, and degree of success. Offeror is encouraged to include supporting documents such as photographs that support the narrative. Furthermore, for each project submitted, Offerors shall provide a narrative that describes if any of the projects were non-typical due to complexity, schedule, unforeseen site conditions, or other unusual factors, and provide details on how the offeror overcame those challenges.”
i. Please clarify whether these additional narratives are to be incorporated into Attachment A, or separate from Attachment A.
Government Response: The narrative is part of the requested information that shall be included in Attachment A.
ii. If these additional narratives are to be incorporated into Attachment A, please confirm these will not count toward the page limitation for Attachment A.
Government Response: The requested information must be included in Attachment A and stay within the page limitation as stated in the Solicitation.
Question 6: Reference Evaluation Factors for Award, Part II – Evaluation Criteria, Factor 3, Past Performance (RFP Page 60 of 124). This section indicates the Offeror’s references should provide completed Past Performance Questionnaires (PPQ) directly to Network Contracting Office 21. It also states that if a completed Contractor Performance Assessment Report (CPAR) evaluation is available, it shall be submitted with the proposal for each project included in Factor 2 for construction experience.
a. If a completed CPARS is available and submitted with the proposal, is a PPQ still required? Please note that clients that have already completed a final CPARS can be more reluctant to fill out a PPQ.
b. If the Offeror has a PPQ that was completed for a previous proposal, will the
Government accept these included with the Offeror’s proposal, in lieu asking the Client to fill out another one and submit it directly to NCO 21?
Government Response: No. PPQ should be sent directly from the Client directly to
NCO21.
Question 7: Reference Instructions, Conditions and Other Statements to Bidders/Offerors: On RFP Page 47 of 124 it states the Administrative Volume shall include ‘Any Small Business Administration (SBA) certifications’. Is the Government looking for copies of the certification(s) themselves, or simply a list of SBA certifications?
Government Response: Offer should provide certifications.
Question 8: Reference Instructions, Conditions and Other Statements to Bidders/Offerors:
Under Phase II (Factor 4), on RFP pages 47/48 of 124 it states, “The Offeror shall submit a high-level Project Schedule summary, identifying major design and construction activities…”.
Please clarify whether the seed project is design-build or design-bid-build.
Government Response: The seed project is Design-Bid-Build.
Question 9: Reference Instructions, Conditions and Other Statements to Bidders/Offerors:
Under Phase II (Factor 4), on RFP pages 47/48 of 124 it discusses a high-level project schedule summary, and key personnel resumes. However, under Evaluation Factors for Award, Part II, Factor 4, Seed Project Technical Solution (RFP Page 63 of 124) it only indicates offerors shall complete a narrative describing the technical solution to the project that meets the seed project [requirements]. Please clarify whether a project schedule and/or key personnel resumes will be required under Factor 4.
Government Response: The Technical Proposal for Phase II (Factor 4) shall include a narrative describing the technical solution include all elements listed on pages 47/48 of 124.
Question 10: Reference Instructions, Conditions and Other Statements to Bidders/Offerors:
Item x. on RFP Page 52 of 124 discusses Pre-Award Survey/Responsibility Determination and indicates the pre-award survey is not a part of the technical evaluation.
a. Please clarify the format and specific information to be included in the pre-award survey.
Government Response: The PreAward Survey is not part of the technical evaluation.
This is conducted by the Government upon receipt of Offerors.
b. Please clarify in which volume the pre-award survey should be included.
Government Response: No additional submission is required. See answer above in section a.
Question 11: On RFP Page 55 of 124 under Enforceability of the Proposal it states, “By submission of an offer, the Offeror agrees that all items proposed (e.g., key personnel, designers, subcontractors, etc.) will be utilized for the duration of the contract and any substitutions will be equal or better than as proposed and accepted for contract award and shall require prior Contracting Officer’s approval.” Please confirm any proposed key personnel or subcontractors are applicable only to the seed project, and that offerors are not limited to those proposed key personnel or subcontractors for the life of the MACC.
Government Response: The submission will be applicable to the seed project. However, for future task orders, Contractor may use other subcontractors or personnel, but qualification must be equal to or better than as proposed.
Question 12: VAAR 852.209-70 (RFP Page 66 of 124) states the Offeror shall provide a statement with its offer which describes all relevant facts concerning any past, present, or currently planned interest or actual or potential organizational conflicts of interest relating to the services to be provided under this solicitation. If the Offeror does not anticipate any organizational conflicts of interest, is a statement to that effect required? If so, in which Volume shall we include this?
Government Response: Offerors shall address any Organization Conflicts of Interest in accordance with VAAR 852.209-70 under the Administrative Volume.
Question 13: FAR 52.222-33 Notice of Requirement for Project Labor Agreement (JAN 2024) is referenced on RFP Page 65 of 124. Please confirm this Clause is not applicable to this MACC and that Project Labor Agreements are not and will not be required.
Government Response: Project Labor Agreements is not required. FAR Clause 52.222-33 will be removed pursuant to this Amendment.
Question 14: FAR 52.216-17 Ordering Limitations (RFP pages 83/84 of 124) indicates the Contractor is not obligated to honor any single item in excess of $2,000.00 or any order for a combination of items in excess of $2,000.00. Was this intended to be orders in excess of $10,000,000?
Government Response: Correct. In excess of $10,000,000.00. FAR 52.216-19 to be revised pursuant to this Amendment.
Question 15: Statement of Work Section 4.0 on RFP Page 12 of 124 indicates the Government seeks to establish a contract ceiling for each contract of $50,000,000. In our experience, this can be quickly maxed out prior to the full term of the IDIQ, particularly by those firms that tend to be the most responsive. We recommend the Government extend the contract ceiling for each contract if possible.
Government Response: Contract ceiling will remain at $50,000,000.00 for each awardee. The government reserves the right to request a ceiling increase in the event an individual awardee meets or exceeds the ceiling.
Question 16: Statement of Work Section 29.0 on RFP Page 21 of 124 states the contractor shall utilize a Construction Management software that allows for the ability to transfer large files to/from VA representatives (cannot be blocked by VA firewall). Please clarify whether Procore meets this requirement (i.e. VA firewall does not block files transferred via Procore).
Government Response: Procore is acceptable and meets the requirement.
Question 17: On RFP Page 49 of 124, under General Information, Item 2 states, ‘The Offeror must represent to the Contracting Officer that it is a – (1) SDVOSB concern; (2) Small business concern under the NAICS code assigned to the acquisition; and Verified for eligibility in the Veteran Small Business Certification (VetCert) database.’ Please clarify in which volume offerors are to include these representations.
Government Response: Offerors should refer to page 47 of 124. Paragraph 4 under the Administrative Volume.
Question 18: Reference Instructions, Conditions and Other Statements to Bidders/Offerors: On RFP Page 47 of 124 it indicates the Administrative Volume shall include Completed and signed VAAR 852.219-75 VA Notice of Limitations on Subcontracting – Certificate of Compliance for Services and Construction (NOV 2022). This Clause is provided on RFP Pages 66 – 68 but it is the ‘(JAN 2023) (Deviation)’ version. Please advise.
Government Response: VAAR 852.219-75 VA Notice of Limitations on Subcontracting – Certificate of Compliance for Services and Construction (Nov 2022) is hereby replacing deviation Jan 2023. See attached.
Question 19: Reference Instructions, Conditions and Other Statements to Bidders/Offerors:
Section v. item 5 (Page Size and Format) on RFP Page 50 of 124 states, ‘Except for reproduced sections of the solicitation document, the text size shall be no less than 11 points.”
Attachments A, B, C, D, and E each contain text size smaller than 11 points. Please confirm that these attachments are considered reproduced sections of the solicitation document and therefore not subject to a minimum font size of 11 points.
Government Response: All standard text on Attachments A, B, C, D, and E are considered reproduced sections and are not subject to the minimum font size.
Question 20: Attachment A - Construction Project Data Sheet, Section F “Completion Date”, #3 states we are to provide “Estimate at Completion”. We are unsure of what the government is looking for here. We assume it is the price at the time of completion, but this entire section revolves around completion date, not dollar amount. In addition, the very next section, Section G pertains to final contract price which would essentially be the same information being asked for in Section F, #3 (if our assumption is correct). Can the government please clarify what information is being sought in Section F, #3 of the Construction Project Data Sheet?
Government Response: Section F of Attachment A is seeking the information in regards to the project completion date(s) and percentage of project completed at current schedule (present date). Section G is for the contact value. See attached Attachment A (revised Feb 2025) providing clarity for Section F.
Question 21: Please confirm that if the contractor has a completed CPAR evaluation for a project being submitted for Past Experience, a PPQ is not required.
Question 22: Please confirm the use of Attachment C is for use of PPQ’s?
Government Response: Attachment C is a Consent Letter, allowing the Government to release past performance information (PPQ, CPAR…) provided from the firm to the offeror.
Question 23: Reference Evaluation Factors for Award, Part II – Evaluation Criteria, Factor 2 Recent Relevant Experience of the Firm (RFP Page 58 of 124): This section states, “Do not alter the Construction & Design Experience Project Data Sheet with the exception of expanding the individual blocks on this form”.
a. Is it acceptable for the Offeror to reduce the size of individual blocks on this form? In some cases the individual blocks are larger than needed to convey the information asked for.
Government Response: As stated in the Solicitation page 58 of 124. Do not alter the Construction & Design Experience Project Data Sheet with the exception of expanding the individual blocks on this form; however, total length for each project data sheet shall not exceed two (2) double-sided pages (or four (4) single-sided pages).
b. Is it acceptable to add information after the last item J on the form? We are trying to determine how to best address specific project information that is asked for in the RFP but not addressed on this form.
Government Response: Address general project information in section D and any unique technical about the project in section J.
