The C&A requirements do not apply and a Security Accreditation Package is not required. If the contractor opts to use a computer or computer system for processing contract documents, the requirements of FIPS 140-2 for encryption of contract documents must be met.

PLANS/SPECIFICATIONS/DRAWINGS: Drawings, specifications, door photos and door schedules are attached in electronic format to this solicitation. Contractors are responsible for downloading and printing their own plan sets. The VA will not provide hard copies of the drawings and specifications to any Contractor. Contractors are responsible for ensuring that any construction document package used for their proposal or construction is complete and up-to-date.

SYSTEM FOR AWARD MANAGEMENT (SAM): Federal Acquisition Regulations require that federal contractors register in the System for Award Management (SAM) database at http://www.sam.gov and enter all mandatory information into the system. Award cannot be made until the contractor has registered. Contractors are encouraged to ensure that they are registered in SAM prior to submitting their proposal.

ADDITIONAL VETBIZ INFORMATION:

(a) Eligibility of SDVOSBs continues to be governed by the Small Business Administration regulations, 13 CFR subparts 125.8 through 125.13, as well as the FAR, except where expressly directed otherwise by the VAAR, and 38 CFR verification regulations for SDVOSBs.

(b) At the time of submission of offer, the offeror must represent to the contracting officer that it is a—

(1) SDVOSB concern

(2) Small business concern under the North American Industry Classification System (NAICS) code assigned to the acquisition; and

(3) Verified for eligibility in the VIP database.

(c) A joint venture may be considered an SDVOSB or VOSB concern if,

(1) At least one member of the joint venture is an SDVOSB or VOSB concern, and makes the representations in paragraph (b) of this section;

(2) Each other concern is small under the size standard corresponding to the NAICS code assigned to the procurement;

(3) The joint venture meets the requirements of paragraph 7 of the size standard explanation of affiliates in FAR 19.101; and

(4) The joint venture meets the requirements of 13 CFR 125.15(b), modified to include Veteran-owned small businesses where this CFR section refers to SDVOSB concerns.

(d) Any SDVOSB or VOSB concern (nonmanufacturer) must meet the requirements in FAR 19.102(f) to receive a benefit under this program.

JOINT VENTURES: See 13 C.F.R. § 121.103

(h) Affiliation based on joint ventures: A joint venture is an association of individuals and/or concerns with interests in any degree or proportion consorting to engage in and carry out no more than three specific or limited-purpose business ventures for joint profit over a two-year period, for which purpose they combine their efforts, property, money, skill, or knowledge, but not on a continuing or permanent basis for conducting business generally.

This means that a specific joint venture entity generally may not be awarded more than three contracts over a two-year period, starting from the date of the award of the first contract, without the partners to the joint venture being deemed affiliated for all purposes. Once a joint venture receives one contract, SBA will determine compliance with the three awards in two years rule for future awards as of the date of initial offer including price.

As such, an individual joint venture may be awarded more than three contracts without SBA finding general affiliation between the joint venture partners where the joint venture had received two or fewer contracts as of the date it submitted one or more additional offers which thereafter result in one or more additional contract awards. The same two (or more) entities may create additional joint ventures, and each new joint venture entity may be awarded up to three contracts in accordance with this section. At some point, however, such a longstanding inter-relationship or contractual dependence between the same joint venture partners will lead to a finding of general affiliation between and among them.

For purposes of this provision and in order to facilitate tracking of the number of contract awards made to a joint venture, a joint venture must be in writing and must do business under its own name, and it may (but need not) be in the form of a separate legal entity, and if it is a separate legal entity it may (but need not) be populated (i.e., have its own separate employees). SBA may also determine that the relationship between a prime contractor and its subcontractor is a joint venture, and that affiliation between the two exists, pursuant to paragraph (h)(4) of this section.

EVALUATION OF OFFEROR PROPOSALS, Lowest-Price, Technically Acceptable (LPTA), SOURCE SELECTION, USING LPTA PROCESS: An evaluation for acceptability will be performed on each proposal, in accordance with FAR 15.101-2. The proposal that provides the lowest price and is otherwise technically acceptable in all factors will be selected for award. To be considered technically acceptable, no technical factor in the proposal may be determined to be unacceptable. The failure of a proposal to meet any of the factors will result in a technically unacceptable rating and preclude award.

EVALUATION OF THE PRICE PROPOSALS:

a. Price will be evaluated and considered, but will not be scored or combined with other aspects of the proposal evaluation. The proposed prices will be analyzed for reasonableness. They may also be analyzed to determine whether they reflect a clear understanding of the requirements, and are consistent with the information provided by the Offeror. Additionally, all offers will be analyzed for unbalanced pricing.

b. The otherwise technically-acceptable, lowest-priced offeror may be required to confirm its price on either a CLIN, element, or total price basis, and/or provide additional information in support of their price, prior to contract award at the Government’s request and discretion.

EVALUATION OF THE NON-PRICE FACTOR PROPOSAL. The Non-Price Factor Proposal will be evaluated based on the criteria below. The Technical Evaluation Board will evaluate each offer’s proposal against the requirements to determine whether the proposal is acceptable or unacceptable, using the ratings and descriptions in the following table:

Table A-1. Technical Acceptable/Unacceptable Rating

RatingDescription
AcceptableProposal clearly meets the minimum requirements of the solicitation.
UnacceptableProposal does not clearly meet the minimum requirements of the solicitation.

FACTOR 1: TECHNICAL APPROACH

SUB FACTOR 1: Project Plan: Provide a Project Plan in any approved Critical Path Method (CPM) format, subject to the approval by the Resident Engineer, with a Tentative NTP date of 10 days after award. Additionally, provide a brief synopsis (NTE 3 pages) describing your technical solution to augment and support the Project Plan to meet the period of performance accordingly. The Project Plan should clearly demonstrate a complete understanding of the tasks necessary in accordance with all drawings, specifications, door photos, door schedules and the statement of work for this project.

Note: This sub factor shall be submitted in no more than 6 pages.

A successful project plan will provide the Government confidence that the project is structured to be executable for the resources indicated. The Project Plan, cost breakdown, and products proposed, and project schedule should clearly demonstrate an adequate understanding of the tasks and resources necessary to meet the requirements listed in the drawings, specifications, door photos, door schedules and the statement of work of this project. The project plan developed for this solicitation is for evaluation purposes only and to assess the contractor’s ability to meet the required period of performance.

SUB FACTOR 2: Description of Equipment: Offeror shall provide a description of equipment to be used on the project including warranties, special features, and characteristics. The equipment shall be in accordance with all the drawings, specifications, door photos, door schedules and statement of work for this project.

Note: This sub factor shall be submitted in no more than 15 pages.

A successful description of equipment will provide the Government confidence that the equipment proposed clearly demonstrates an adequate understanding of the equipment necessary to meet the requirements listed in the drawings, specifications, door photos, door schedules and statement of work of this project. The description of equipment is for evaluation purposed only and to assess the contractor’s ability to meet the required equipment.

Failure to demonstrate the minimally acceptability standards under this factor will result in an “UNACCEPTABLE” rating and possible elimination from further consideration for contract award.

FACTOR 2: Past Performance Offerors are required to demonstrate recent (within the last five years), successful performance under contracts (ongoing or completed) which are similar in scope, magnitude of greater than $500,000, and complexity to the subject requirement. Provide a minimum of one (1) and a maximum of three (3) projects completed within the preceding five (5) years.

Each Past Performance listed shall include:

· Government Agency/Company which awarded contract to offeror

· Contract Number

· Description of Contract Scope

· Total Dollar Value

· Performance Period

· Place of Performance

· Contracting Officer/Procurement Official or, name of individual who can provide Past Performance information providing:

· Name

· Current Email Address

· Current Phone Number

· Physical Address

Note: This factor shall be submitted in no more than 6 pages.

Offeror Past Performance – The offeror’s response to this factor will be evaluated as to its relevance and similarity to work under this project. The Government may contact the offeror’s references for information and may review performance ratings on file for prior Government projects the offeror has performed. Past performance information obtained from sources other than those identified by the offeror may be used. All relevant facts and circumstances gathered from information from the offeror’s listed references and other sources of information available to the Government (e.g., National Institutes of Health [NIH] Contractor Performance System [CPS] and Past Performance Information Retrieval System [PPIRS]) will be used to evaluate the offeror’s overall past performance and quality of performance. If an offeror has not commented on negative past performance evaluations obtained by the Technical Evaluation Board the offeror may be given the opportunity to clarify and/or mitigate adverse past performance during “exchanges” (clarifications, communications, or discussions) after receipt of proposals (FAR 15.306). If discussions are required, and past performance issues remain, these issues will be addressed during discussions.

Past performance will be rated using rating factors of: Excellent, Good, Neutral, Marginal, Unacceptable. Those offerors rated Excellent, Good, or Neutral will receive a “Acceptable” rating. Those offerors rated Marginal or Unacceptable will receive an “Unacceptable” rating.

Offerors who do not have relevant past performance will receive a neutral rating (neither favorable nor unfavorable) (FAR 15.305)(a)(iv).

BASIS FOR AWARD: Award will be made on the basis of the lowest evaluated price of proposals meeting or exceeding the acceptability standards for non-price factors. Tradeoffs are not permitted. Proposals are evaluated for acceptability but not ranked using non-price factors.

The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror’s initial offer should contain the offeror’s best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.

RESPONSIBILITY REQUIREMENTS: A responsibility check will be accomplished for the apparent awardee prior to award. Checks of the VIP database (to insure apparently successful offeror is a verified Service Disabled Veteran Owned Small Business), System for Award Management (SAM) database (Central Contractor Registration, Online Representations and Certifications, and Excluded Parties List System to insure registrations are current, valid, and no debarment records exist), and Experian (to check Supplier Qualifier Rating to insure it is below a risk value of 7). Any information retrieved or received by the Government that would be cause for negative or unsatisfactory responsibility rating may result in the offeror being determined ineligible for award.

CONFORMANCE WITH ENVIRONMENTAL MANAGEMENT SYSTEMS: The Contractor shall perform work under this contract consistent with the relevant policy and objectives identified in the agency, organizational, or facility Green Environmental Management System (GEMS) applicable for your contract. The Contractor shall perform work in a manner that conforms to all appropriate Environmental Management Programs and Operational Controls identified by the agency, organizational, or facility GEMS, and provide monitoring and measurement information as necessary for the organization to address environmental performance relative to the environmental, energy, and transportation management goals. In the event an environmental nonconformance or noncompliance associated with the contracted services is identified, the contractor shall take corrective and/or preventative actions. In the case of a noncompliance, the Contractor shall respond and take corrective action immediately. In the case of a nonconformance, the Contractor shall respond and take corrective action based on the time schedule established by the facility GEMS Coordinator. In addition, the Contractor shall ensure that their employees are aware of the roles and responsibilities identified by the environmental management system and how these requirements affect their work performed under this contract.

All on-site contractor personnel shall complete yearly EPA sponsored environmental training specified for the type of work conducted on-site. Upon inclusion in the contract, the Contracting Officer’s Representative will verify that all contractor personnel have acquired EMS Awareness Training at their appropriate site or location.

REFERENCES TO VA ENGINEER, RESIDENT ENGINEER, SENIOR RESIDENT ENGINEER, OR PROJECT MANAGER: Any reference contained within solicitation documents, and any resultant contract, the terms Contracting Officer's Technical Representative (COTR), Contracting Officer's Representative (COR), Project Engineer (PE), Resident Engineer (RE), and Project Manager (PM), all denote the same engineering official and may be used equally and interchangeably as described by the Contracting Officer (CO).

SMOKE AND CARBON MONOXIDE MONITORING REQUIREMENTS: Contractor, his employees, his subcontractors, and their employees shall adhere to VA, VHA, and VASNHCS Policies for smoke and carbon monoxide monitoring requirements. They are available upon request from COR.

WORK DAYS AND HOURS: Normal work days and hours for this project will be Monday through Friday, excluding federal holidays, from 7:00 a.m. to 4:00 p.m. Access to the work site may be restricted to these hours and days. Work during other than normal work days and hours may be required, but days and hours must still be coordinated in advance with the Contracting Officer through the COR.
