About this file

This document is a VA Notice of Limitations on Subcontracting—Certificate of Compliance for Services and Construction, dated January 2023. The attachment requires offerors to certify compliance with specific subcontracting limitations for service contracts, where the contractor cannot pay more than 50% of the government-paid amount to firms that are not certified Service-Disabled Veteran-Owned Small Businesses (SDVOSBs) or Veteran-Owned Small Businesses (VOSBs).

The document outlines strict requirements for completing the certification, including matching the legal business name exactly as registered in SAM.gov, providing a signature from an authorized representative, and acknowledging potential penalties for false certification. Failure to properly complete the attachment will result in the offer being rejected and deemed ineligible for evaluation and award. The VA reserves the right to review compliance documentation and may take actions including referral to a Suspension and Debarment Committee, imposing fines, or pursuing prosecution if the subcontracting limitations are not followed in good faith.
