About this file
This is an Amendment of Solicitation/Modification of Contract (Standard Form 30) issued by the Department of Veterans Affairs Network Contracting Office 8 (NCO 8) located in San Juan, Puerto Rico, for Solicitation 36C24826R0133 titled "Repair Water Tanks Deficiencies (Design Build)." The amendment, numbered 0001 and effective September 17, 2026, responds to Requests for Information (RFI) submitted by offerors and provides clarifications on proposal submission requirements.
The amendment clarifies multiple evaluation factors for the design-build contract. Factor 1 – Technical Approach and Technical Qualification has a maximum of 30 pages, excluding signed letters of commitment and license copies. Personnel qualifications must comply with requirements in the Statement of Work. The Site Safety and Health Officer (SSHO) qualifications referenced in specification Section 01 35 26 are the minimum required, with minimum 5 years of experience in respective fields. Structural and Mechanical Engineers must possess a bachelor's degree and a U.S. engineering license; the Structural Engineer also requires 5 years of Puerto Rico design experience. Quality Controllers must possess Quality Control training certificates. The Contractor Superintendent requires 5 years of experience as superintendent on similar projects and 30-hour OSHA Construction Training but does not require a Puerto Rico professional license; the superintendent must be onsite during the construction phase. Welder qualifications may be demonstrated through the proposed subcontractor's compliance with applicable AWS and ASME standards without submitting individual certifications at Phase One. Laboratory credentials are not required at Phase One but will be required during construction submittal; the laboratory must possess both NELAP accreditation and Puerto Rico Department of Health certification. Factor 2 – Specialized Experience has a 30-page maximum, with project recency requirement of seven (7) years from solicitation date. The prime contractor must have 10 years of experience managing and supervising construction projects of similar or greater complexity; design-build experience is not specifically required. The three required specialized experience projects may be provided by any combination of the prime contractor and major subcontractors, including the A/E design firm, provided the A/E design firm and any major construction contractor demonstrate the specialized experience. Previously completed PPQs from past projects are acceptable. Section 22 12 16's requirement for five completed projects with references is a post-award submittal applicable to contractors performing potable water storage tank work, not a Phase One submission requirement.

Solicitation: 36C24826R0133
Title: Repair Water Tanks Deficiencies (Design Build) RFI's & Answers
1.) Page 26 of the solicitation indicates Factor 1 – Technical Approach and Technical Qualification has a 30-page max, excluding signed letters of commitments, and copy of licenses. However, page 28 of the solicitation indicates Factor 1 has a page limit of 20 pages. Can the Government please clarify the correct page limit for Factor 1 in its totality and what the exclusions are?
Answer: 30-page max
2.) Factor 1, Item 7 requires offerors to submit professional qualifications for the Project Manager, Project Superintendent, Safety Manager, Quality Controller, Structural Engineer, Mechanical Engineer, and Welders, and states that “Personnel qualifications shall comply with requirements stated in scope.” Can the Government please clarify whether “scope” refers to the Statement of Work contained in the solicitation, the technical specifications included as Attachment 1-D, or both?
Answer: “scope” refers to the Statement of Work.
3.) Factor 1, Item 7 requires submission of qualifications for a “Safety Manager.” Section 01 35 26 of the specifications instead establishes requirements for a Site Safety and Health Officer (SSHO), including OSHA 30 training and minimum construction safety experience, and requires the SSHO to be separate from the Superintendent and Quality Control Manager. Can the Government please confirm whether the “Safety Manager” identified in Factor 1, Item 7 is intended to be the SSHO described in Section 01 35 26, and whether the SSHO qualifications stated in that section are the minimum qualifications that must be demonstrated with the Phase One proposal?
Answer: Provide the required information for a SSHO following specification under Factor 1 – item 7.
4.) Factor 1, Item 7 requires professional qualifications for a Quality Controller, Structural Engineer, and Mechanical Engineer. Can the Government please identify the minimum required qualifications, licenses, certifications, and/or years of experience applicable to each of these positions for purposes of Phase One evaluation, or the document in which those qualifications are listed and the page numbers on which they are listed?
If applicable, can the Government please also clarify whether the Structural Engineer and Mechanical Engineer must each hold current Puerto Rico professional licensure, or whether the Puerto Rico license requirement applies only to the A/E Contractor/Engineer of Record identified in Factor 1, Item 6?
Answer: Each position shall have a minimum of 5 years of experience in the respective field.
Structural and Mechanical Engineers shall possess a bachelor’s degree from an accredited board/institution and an engineering license issued in the United States of America or any of their territories. Structural Engineer shall also possess a minimum of 5 years of experience designing in Puerto Rico. Quality Controller shall possess a Quality Control training certificate. Professional license registered in the Commonwealth of Puerto Rico is required for the A/E Firm performing the design services under this Design-Build Contract.
5.) Factor 1, Item 7 requires submission of professional qualifications for Welders. Attachment 1-D states that tank welding qualification procedures and personnel shall comply with AWS D1.1, AWS D1.3, and AWS D1.4, and that pipe welding qualification procedures and personnel shall comply with ASME BPVC Section IX. Can the Government please clarify what documentation is required with the Phase One proposal to demonstrate welder qualifications?
Can the Government clarify if offerors must identify and submit current certifications/qualification records for individual proposed welders at Phase One, or is it sufficient at this stage to demonstrate that the proposed welding subcontractor has personnel qualified to the applicable AWS and ASME standards?
Answer: Demonstrating that proposed welding subcontractor has the personnel qualified to the applicable AWS and ASME standards will be sufficient.
6.) The Statement of Work states that the Contractor’s Superintendent shall be a professional architect and/or engineer licensed in Puerto Rico and shall be present onsite until completion of the contract. Can the Government please confirm whether the proposed full-time onsite Superintendent must personally hold a current Puerto Rico architect or engineer license as of the Phase One proposal closing date?
If so, can the Government please clarify whether a copy of the Superintendent’s license must be submitted with the Phase One proposal?
Can the Government also please clarify whether it would consider a qualified construction Superintendent who meets the specified OSHA 30 and experience requirements, with the Puerto Rico professional licensure requirement satisfied separately by the project’s licensed Architect/Engineer of Record or another appropriately licensed member of the Design-Build Team?
Can the Government also please clarify whether the requirement that the Superintendent be present onsite until completion of the contract means that the Superintendent must be onsite during all active onsite construction operations, or whether the requirement applies throughout the entire contract period, including design and other periods when onsite construction activities are not occurring?
Answer: A Puerto Rico license won’t be required for Contractor Superintendent. Contractor Superintendent shall possess a minimum of 5 years of experience serving as Superintendent on other similar projects. Contractor Superintendent shall also possess the 30-hours OSHA Construction Training. Contractor Superintendent shall be present onsite during construction phase.
7.) Factor 1, Item 8 requires offerors to “Provide laboratory credentials complying with NELAP LAB accreditation; also with Puerto Rico Department of Health Certify Laboratory for collection and analysis of microbiological and chemical water quality parameters.”
Can the Government please clarify the specific documentation required with the Phase One proposal to demonstrate compliance with this requirement? Specifically, can the Government please confirm whether the offeror must identify a laboratory at the time of Phase One submission and provide copies of its current NELAP accreditation and Puerto Rico Department of Health laboratory certification?
Can the Government please also clarify whether a single proposed laboratory must hold both credentials and whether any separate certification or credential is required for personnel performing collection of water samples?
Answer: Laboratory credentials won’t be required to be submitted as part of this factor. Laboratory credentials will be required under the construction submittal process. The laboratory shall possess both credentials.
8.) Page 26 of the solicitation states that Factor 2 – Specialized Experience has no page limit;
however, on page 29 of the solicitation it indicates Factor 2 has a 30-page max. Can the Government please clarify the correct page limit for Factor 2: Specialized Experience.
Answer: Factor 2 has a 30-page max.
9.)The Statement of Work states that the Design-Build Contractor (DB-C) must have at least ten years of proven experience in the management and supervision of construction projects of similar or greater complexity.
Can the Government please clarify whether this requirement must be satisfied solely by the prime contractor, or whether the experience of the proposed Design-Build Team, including major subcontractors and the proposed A/E design firm, may be considered in demonstrating compliance with this requirement?
Can the Government please also confirm whether the required ten years of experience must specifically consist of design-build project experience, or whether experience managing and supervising construction projects of similar or greater complexity satisfies the requirement?
Answer: Experience requirement is solely for Prime Contractor. Experience requirement can be managing and supervising construction projects of similar or greater complexity.
10.) Factor 2 contains multiple references to projects completed or turned over within the past “seven (5) years,” while the Factor 3 Past Performance evaluation criteria refers to relevant Design- Build Team experience turned over no longer than seven (7) years from the date of the solicitation.
Can the Government please confirm whether the recency requirement for projects submitted under Factor 2 is five (5) years or seven (7) years from the date of the solicitation?
Answer: Seven (7) years.
11.) Is it acceptable to submit previously completed PPQs from past projects, or do new PPQs need to be submitted?
Answer: It is acceptable previously completed PPQs from past projects.
12.) Factor 2 states that, for purposes of specialized experience, “Offeror or Offeror’s” refers to the proposed prime contractor and all proposed major subcontractors. Can the Government please confirm that the three required specialized experience projects may be provided by any combination of the proposed prime contractor and proposed major subcontractors, including the proposed A/E design firm and/or a firm participating as the prime contractor’s SBA-approved Mentor, provided the Mentor is proposed to perform a meaningful role under the resulting task order and the submitted projects otherwise satisfy the stated recency, size, scope, and complexity criteria?
Can the Government also please confirm that there is no requirement for the prime contractor itself to have performed one or more of the three submitted design-build projects?
Answer: Offeror shall demonstrate that A/E design firm and any major construction Contractor possess the specialized experience.
13.) If specialized experience is submitted for an SBA-approved Mentor proposed as a project team member, can the Government please confirm whether the Mentor is considered a “key subcontractor” for purposes of Factor 2, Item 5, requiring submission of the signed Letter of Commitment provided as Attachment 06?
Answer: If SBA-approved Mentor is not an employee/member of the prime company/contractor then that means his services are being subcontracted, therefore, Mentor is considered a key subcontractor.
14.) For specialized experience projects performed by a proposed major subcontractor or SBA-approved Mentor, can the Government please clarify whether it requires any information beyond that requested in Attachment 03 to identify the submitting team member's role on the project, such as whether the firm performed as prime or subcontractor, the scope and duration of its involvement, or the dollar value/percentage of work performed?
Answer: Refer to Solicitation Phase One - Factor 1: item 2. (Page 28)
15.) Attachment 1-D, Section 22 12 16, Paragraph 1.5.A.3 requires submission of a list of five completed projects of similar type and size with references, while Phase One, Factor 2 requires submission of three specialized experience projects. Can the Government please confirm that the five-project list required by Section 22 12 16 is a post-award technical submittal applicable to the installer/service supplier and is not an additional Phase One proposal submission requirement?
Answer: Specification requirement is for a post-award submission applicable to Contractors performing work in the potable-water storage tanks.
