About this file
This is a Scope of Work Verification form submitted by the Orange County Transportation Authority (OCTA) for the OC Streetcar Ridership Marketing and Customer Communications Program. The form certifies that the scope of work and specifications were independently prepared to invite fair competition and do not include brand name references, unreasonable restrictions, or vendor favoritism. The project involves developing a comprehensive marketing and customer communications program for the OC Streetcar system, with a budgeted amount of $200,000 over an initial two-year term. The scope of work verification requires that the Project Manager and either the Department Manager, Director, or Executive Director sign the form to confirm compliance with competitive procurement standards and federal transit administration regulations.
The form establishes mandatory guidelines for scope of work preparation, including requirements that specifications clearly identify all characteristics, tasks, and functions; use industry and government standards wherever suitable; and, if brand name specifications are necessary, include clear "or equal" descriptions of salient characteristics to allow competitive evaluation. The document references FTA Circular 4220.1F standards and prohibits consultants from writing or assisting in the development of scopes of work in which they may subsequently bid. No specific response dates, site visits, or bidder conferences are referenced in this verification document, which serves as a procedural certification rather than a complete solicitation notice.

SCOPE OF WORK VERIFICATION
This Form Must Be Submitted with Scope of Work (SOW)
The following general rules shall apply when preparing scopes of work and specifications:
a) Provide a clear and concise Scope of Work (SOW) and not impose unreasonable requirements.
b) Specifications and Scopes of Work shall identify all characteristics and specific tasks and functions of the items or services to be procured, and meet the Authority’s requirements.
c) Whenever possible, the expected quality of services to be provided or the performance characteristics of the item shall be specified.
d) The requestor shall identify all optional items, and the solicitation documents shall set forth the expected needs and the manner in which the related bid prices will be considered.
e) Brand name specifications must be accompanied by an explanation that clearly indicates that the specification is not intended to be restrictive.
f) The salient characteristics represented by the brand names shall be identified to allow for evaluation of possible “or equal” material.
g) Because standard specifications and requirements allow for more efficient operations and result in lower prices, they shall be used wherever suitable.
h) Industry, federal, state and local government specifications and requirements can be used.
Consultants are prohibited from writing the Scope of Work or assisting in the development or writing the Scope of Work in which they may bid.

However, the specific features or salient characteristics of the named brand which must be met by offerors of “an equal” proposal have been clearly stated, as required by Federal Transit Administration regulations.
