B The terms Engineer, Project Manager and Project Representative are interchangeable between the various Contract Documents.
C If the CONTRACTOR desires to utilize materials, means, or methods which in accordance with the FDOT specifications requires Quality Control testing and approval by the Engineer, the testing shall be performed at the expense of the CONTRACTOR, and reviewed for acceptance by the COUNTY. The COUNTY also reserves the right to require testing above and beyond the FDOT specified LOT testing in situations when the testing of LOT quantities will not provide a reasonable assurance of the quality of the work. This additional testing by the CONTRACTOR will be at no additional cost to the COUNTY.
D At the CONTRACTOR’s option he may submit a Value Engineering Change Proposal, also know as a Cost Savings Initiative Proposal (CSIP), or hereinafter referred to as a VECP or CSIP in accordance with FDOT Standard Specifications for Road and Bridge Construction, Section 4-3.9, Value Engineering Incentive, or Cost Savings Initiative Proposal. The COUNTY reserves the right to reject at its discretion any VECP or CSIP submittal and the CONTRACTOR shall remain obligated to perform the WORK in accordance with the terms of the existing Contract.
E. Control of Materials: The County will accept approved FDOT Quality Product List (QPL) products and materials unless stated to the contrary herein.

At the commencement of construction, the CONTRACTOR shall display the signs and relocate the signs as required by the COUNTY PROJECT REPRESENTATIVE. The CONTRACTOR is responsible for the care and custody of the project identification signs. Damage to, or theft of, the project identification signs shall be reported to the COUNTY PROJECT REPRESENTATIVE by the CONTRACTOR within 24 hours. The Cost of relocating and maintaining the signs shall be considered incidental to the project. The signs will be fabricated per the specifications provided as Attachment A.
1.04R Project Locations Work will be performed at various locations throughout Hillsborough County.
1.05R Sequence of Work The COUNTY reserves the right to arrange the sequence of Project Locations. Work may be removed, or additional work may be added to the contract, not to exceed the Awarded Contract Price.
The CONTRACTOR shall make whatever investigations it deems necessary as to the actual field conditions and to comply with the requirements of the Contract documents.
1.06R Schedule
The CONTRACTOR’s project schedule shall encompass the project’s entire construction duration specified in the CONTRACT and may not indicate a shorter duration. Additionally, the schedule shall reflect the construction phasing specified in the CONTRACT and shall include all WORK, including work to be performed by others such as coordination, material acquisition, utility relocation, COUNTY submittal reviews, permit reviews and approvals, etc.
Bar Chart: The bar chart schedule as described in Section 01310 of the Standard Specifications shall be required under this contract for each project location (Work Order (WO)/Purchase Order (PO)), and as well as an overall bar chart schedule for all active projects, with regular updates as requested by the Project Manager.
CPM: The CPM schedule as described in Section 01311 of the Standard Specifications shall not be required under this contract.
1.07R Special Work Hours The Standard work site operation hours within Hillsborough County to be considered by Bidders in preparing their bids shall be as follows:
8:00AM to 5:00PM - Low volume roadways such as subdivisions or any similar locations.
9:00AM to 4:00PM - High volume roadways (collector and arterial roadways) congested areas, and any similar locations.
9:00PM to 6:00AM - High volume roadways (level “F” roadways) congested areas, and any similar locations.
Monday through Friday, excluding County-observed holidays and weekends. No work shall proceed outside these hours without 72 hours prior notice (minimum) and written authorization by the County’s PROJECT MANAGER. However; the COUNTY reserves the right to establish work hours based on traffic volumes, congestion, or other situations that will interfere with the normal flow of traffic.
Temporary Traffic Control Permits will be issued by the COUNTY, as described later in these Supplemental Specifications. The TTC Permits indicate the allowable hours for operation within the actual roadway limits for each road or portion thereof in each project’s work order(s). The CONTRACTOR may request alternative work hours, based on the allowable hours established by the TTC Permit(s). The approval of alternate work hours for each project is subject to the same authorization described above and will be based on a standard 8-hour shift as provided by the normal work hours. These provisions allow daytime and nighttime shifts, based on the allowable hours indicated by the TTC Permit. Further changes to the approved work hours require a formal request by the CONTRACTOR for the TTC Permit to be amended by the COUNTY and the aforementioned written authorization by the County’s PROJECT MANAGER. If approved, an amended TTC Permit will be issued to the CONTRACTOR.
As long as the work is on schedule, the PROJECT MANAGER is not obliged to consider a shift longer than 8 hours or additional workdays beyond those described above. However, if the work is deemed to be behind schedule, the PROJECT MANAGER may approve longer shifts and/or additional shifts based on the approval of a recovery schedule submitted by the CONTRACTOR.
At the discretion of the PROJECT MANAGER, additional costs incurred by the COUNTY for overtime wages and/or employing additional staff are subject to reimbursement by the CONTRACTOR to the COUNTY.
1.08R Contract Estimated Quantities Unit quantities indicated in the Bid Proposal section are provided as a means of comparing bid proposals and as a basis for award. However, these quantities are estimated, and actual unit quantities may vary during the term of this contract. The COUNTY does not guarantee a minimum usage on this contract.
Bidders are cautioned against predicating their bid prices on an assumed scope of work or estimated bid quantities. The amount of award represents only the upper dollar limit beyond which no further work shall be ordered, except as may be approved by the BOCC, through Change Order. It is not known how much or how little work will be ordered during the term of this contract.
The CONTRACTOR acknowledges that actual quantities may be significantly more or less than those indicated on the bid. The CONTRACTOR agrees that he will not make any claim for damages or for loss of profits because of a difference between the quantities shown on the bid form and the quantities of work actually ordered.
Total purchases shall not exceed the amount awarded by the Board, and no work shall be commenced which is not provided for by the provisions of the contract.
Basis for payment shall be actual field measurement, not estimated bid or plan quantities. The dollar amount of payment shall be determined by multiplying the contract unit price for an item by the field measured actual quantity.
Because quantities are estimated and actual requirements will not be determined until time of need, Items 5.8 and 5.9 of the General Terms and Conditions are hereby modified to remove the necessity for formal change order in the event of quantity overruns or under runs, provided that total purchases do not exceed the amount of award.
1.09R Incidental Items Miscellaneous or incidental items such as dewatering, cutting, patching, grading, saw-cutting, electrical hardware, bolts, nuts, fittings, etc., or other ancillary items may be required to complete the construction as indicated on the plans or in the scope of work. If no specific bid item is shown, such miscellaneous or incidental items are to be included in the unit price (s) for the item (s) with which they are associated. Separate payment for miscellaneous incidental items shall not be made by the COUNTY. All components shown and described on the bid documents are to be included in the bid items shown on the bid form.

The contractor shall protect from any damage all existing structures, underground piping, benchmarks, trees, and other facilities. The CONTRACTOR will be held responsible for damage to such existing facilities. In the event of interruption of water, wastewater or other utility services as a result of accidental breakage, exposure, or lack of support, the CONTRACTOR shall promptly notify the proper authority and cooperate with the authority in the prompt restoration of service. If water or wastewater service is interrupted and the CONTRACTOR is performing or assisting the repair work, the CONTRACTOR shall work continuously until the service is restored. Do not begin work around fire hydrants until the local fire authority has approved provisions for continued service.
