About this file

This is a Worker Protection and Investment Certification Form required by the Commonwealth of Pennsylvania pursuant to Executive Order 2021-06 for all contractors and grantees working on state and local contracts. The form mandates that contractors certify compliance with Pennsylvania's Unemployment Compensation Law, Workers' Compensation Law, and thirteen specific state labor and workforce safety laws, including the Construction Workplace Misclassification Act, Employment of Minors Child Labor Act, Minimum Wage Act, Prevailing Wage Act, Equal Pay Law, and the Construction Industry Employee Verification Act, among others. The certification must be executed by a duly authorized official of the contractor or grantee organization and submitted as part of the contract proposal or award process. Contractors must immediately report any changes in compliance status to the purchasing agency.

Failure to comply with the certification requirements carries significant penalties under Pennsylvania law, including contract termination and three-year ineligibility to bid on future state contracts under 62 Pa.C.S. 531 regarding debarment or suspension. Additionally, providing false certifications constitutes unsworn falsification to authorities under 18 Pa.C.S. 4904, subjecting certifying officials to criminal penalties. The form applies broadly to all contractors and grantees of the Commonwealth, making it a universal requirement for participation in state procurement opportunities in Pennsylvania. This certification is essential for the three Northampton Township contract opportunities identified—the Pedestrian Crossing Improvement Project, the 2026 Milling Project, and the Hauling Services contract—all of which require compliance with Pennsylvania Prevailing Wage Act and PennDOT pre-qualification standards.
