About this file

This is a Solicitation (RFP) for ship repair and maintenance services for the USNS WALLY SCHIRRA (T-AKE 8), a Navy replenishment ship. The solicitation number is N0040627R0004, issued by NAVSUP Fleet Logistics Center Puget Sound. The contract requires completion of a Mid-Term Availability (MTA) from January 25, 2027, through March 15, 2027, at an OCONUS location within the U.S. 7th Fleet Area of Responsibility, with performance strictly excluded from India. Proposals are due by October 16, 2026, at 09:00 AM Eastern Daylight Time, submitted electronically per Section L instructions.

The procurement includes three contract line items (CLINs): CLIN 0001 for the base Mid-Term Availability work package on a Firm Fixed Price basis, CLIN 0002 for Over and Above (O&A) growth work also Firm Fixed Price (projected at 27% of base work for both labor hours and material), and CLIN 0003 for Contract Data Requirement Lists (CDRLs) at no separate price. The contractor must provide a detailed price breakdown in Attachment J-3 including fixed, fully-burdened ship repair labor rates and material handling rates applicable to both baseline and O&A work. Work items are defined in the MSC specification package AWP N0040626R0003, which will be provided via DoD SAFE. The contractor must submit fixed labor rates and material handling percentages that apply to all direct production hours and physical materials, with support functions (supervision, QA, planning, administration) bundled into the labor rate. For O&A work, the contractor must follow a Condition Found Report (CFR) process, obtaining written authorization from the Contracting Officer before proceeding. A blanket work authorization may be issued at award establishing administrative thresholds and dollar limitations for routine CFRs. The contractor must notify the Government when cumulative O&A work exceeds 80% of obligated funds and submit weekly tracking reports and a final settlement report. Payment will be made via Wide Area WorkFlow (WAWF) using the specified DoDAAC and routing data. Small business set-asides do not apply due to the OCONUS performance location. The contract includes mandatory compliance with higher-level quality standards (ABS standards), detailed technical and safety certifications (welding, coatings inspection, fall protection, NDT), and comprehensive management, scheduling, quality control, and hazardous waste management plans.

Additional Information/Notes

NOTE A: FIXED SHIP REPAIR LABOR AND MATERIAL HANDLING RATES FOR OVER AND ABOVE (GROWTH) WORK

1. The Contractor's fixed, fully burdened ship repair labor rate set forth in Attachment J-3 will be used for negotiating and settling over and above work to be performed under this Contract. The fully burdened labor rate and material rate identified in Attachment J-3 (Contractor Price Breakdown).

The Contractor agrees that the number of hours included in its price proposal submitted in response to Contract Change Order (CCO), shall include only direct production hours. For these purposes, direct production hours are for skilled labor at the journeyman level expended in direct production including but not limited to the following functions:

Abrasive cleaning/blasting Fire Watch Welding Burning Brazing Carpentry Machinists (inside and outside) Electrical Work Electronic Work Engineering Design Support Lagging Ship-fitting Boiler-making Painting Sheet-metal Work Pipefitting Rigging General Labor Staging/Scaffolding Diesel Mechanics

2. The fully burdened ship repair labor rate proposed by the contractor and identified in Attachment J-3, includes all costs associated with support functions (whether charged directly or indirectly by the Contractor's accounting systems) provided in support of the direct production functions listed in Note A paragraph 1 above. Support functions are considered to be included in the Contractor's fully burdened ship repair labor rate for direct production hours. Labor hours for support functions shall not be separately proposed, billed, or deducted from Over and Above allocations, including support provided to subcontractors. Support functions include, and are not limited to, those types listed below:

Testing Quality Assurance Execution Planning Cleaning (except tank cleaning) Supervision (all types, including, but not limited to supervision of trades, support personnel and subcontractors) Security Surveying Administration Transportation Purchasing Staff Lofting Other indirect support Handling & Warehousing Safety/Environmental Program Management

3. The fully burdened ship repair labor rate is a fixed hourly rate that includes all wages, (i.e. straight time, overtime, shift differential, holiday time, etc.), overhead, all other indirect costs, general and administrative expenses, Facilities Capital Cost of Money (FCCOM) and profit. The fully burdened ship repair labor rate represents a blended rate including labor transferred between divisions, subsidiaries, or affiliates of the contractor under a common control.

4. Consumable materials are goods used in the ordinary course of work performance such as office supplies, paper, rags, vehicle or equipment fuel costs, cleaning chemicals, disposable tools, welding rods, paint buckets, paint brushes, protective clothing, etc., that are consumed/used in the process of repair and do not become an integral part of the repaired vessel. Consumable material shall be included in the Contractor's fully burdened ship repair labor rate and shall not be separately priced or reimbursed under any Over and Above work.

5. Physical materials are goods that become incorporated into the repaired vessel in the course of the repair, such as replacement steel, pipes, paint, and fasteners. The material handling rate applies to physical materials but not to consumable materials. The material handling rate will be applied to the actual cost of the physical material. Actual cost does not include handling charges, general and administrative cost, overhead, profit, or any other indirect cost.

6. For over and above work involving subcontractors, subcontractor quotes will only be subject to the material handling fee rate identified in Attachment J-3. Subcontractor quotes must be competitively acquired and submitted with the contractor's pricing proposal in response to CCOs, if applicable, issued by the Contracting Officer (KO). At no time will the proposed total to be performed by the prime contractor combined with subcontractor quote, material quote, and applicable material handling fee be allowed to cost more than it would have, had the prime contractor directly provided all material and labor. If the Contractor intends to subcontract a CCO for procurement of material only, the Contractor shall notify the KO prior to submitting its CCO pricing stating the reason subcontracting the CCO is the best value to the Government. The proposed total pricing restriction addressed in the preceding sentence does not apply in any case where the work is required to be performed by Original Equipment Manufacturers (OEMs), or Government directed subcontractors. CCOs that are subcontracted for material only (no associated labor required within the CCO) shall not be subject to the material handling fee. Any material handling fee rate applied to new work shall be approved at the discretion of the KO, upon receipt of supporting documentation in accordance with FAR / RFO 15.404-1(b).

7. The Contract fixed fully burdened ship repair labor rate and material handling rate identified in Attachment J-3 shall be used for negotiating over and above work during the availability and up to three (3) months after the Contract Complete date.

NOTE B: AVAILABILITY SCHEDULE PERFORMANCE

1. The Contractor shall schedule the performance of all items in the work package, including all Base Items, Option Items, and Over and Above work--so as to accommodate scope increases up to the total labor hours and material dollars identified in the Over and Above CLIN 0002.

2. The Contractor agrees that Over and Above labor hours and materials, when authorized by the Contracting Officer, shall be performed, purchased and installed concurrently with the Work Items (WIs), without impacting, accelerating, or causing delay or disruption to the critical path, the redelivery date, or to any other work in progress for the Government.

CLIN Growth Associated with CLIN HOURS MATERIAL

0002 0001 27% CLIN 0001 27% CLIN 0001

1. Scope and Authority:

The Contractor shall perform additional required Over and Above work as authorized by the Contracting Officer in accordance with DFARS 252.217- 7028 and this Note C. These efforts are deemed warranted as over and above normal maintenance requirements or general repairs for equipment identified in the baseline CLIN 0001. Over and Above work includes, but is not limited to, the removal and replacement of worn or damaged components with OEM or commercially available parts, replacement of lubricants, filters, seals, and any additional mechanical, electrical, structural, or piping repairs required for complete machinery and system overhaul discovered during "open, clean, and inspect" evolutions.

3. Authorization Requirement & Blanket Work Authorizations:

The Contractor shall not proceed with any Over and Above work or invoice against CLIN 0002 until authorized in writing by the Contracting Officer.

However, the Contracting Officer may issue a Blanket Work Authorization at time of contract award establishing administrative thresholds, standardized procedures, and an aggregate dollar limitation under which individual routine CFRs may be expedited and authorized.

4. Joint Review and Proposal Evaluation:

The Contracting Officer and the MSC Principal Port Engineer (PPE) will promptly review all CFRs, technical justifications, and cost proposals. If not covered by an active blanket authorization, the Contracting Officer will formally authorize the work via a written Direction Letter (DL) or bilateral /unilateral contract modification. Pricing shall be strictly determined by multiplying direct production hours by the fixed hourly labor rate and applying the fixed Material Handling Percentage (%) to direct material costs, as established in Attachment J-3.

5. Mandatory 80% Obligation Notification:

The Contractor shall notify the Contracting Officer and the Principal Port Engineer in writing via email immediately when cumulative authorized Over and Above work under CLIN 0002 exceeds 80% of the total amount obligated under the CLIN.

6. Scope Disputes and Continued Performance:

If the Contractor believes that any directed effort calls for work outside the scope of the contract, the Contractor shall notify the Contracting Officer in writing within two (2) business days of receipt of direction. In the event of an urgency or cost dispute, the Contracting Officer may unilaterally authorize hours and material against CLIN 0002. The Contractor shall promptly proceed with directed Over and Above work without delay, pending final resolution of any dispute in accordance with RFO 52.233-1 (Alternate I), "Disputes."

7. Allowable Direct Production Deductions:

Only actual, authorized direct production labor hours expended shall be deducted from the CLIN 0002 labor hour allocation. In accordance with Note A, all supervisory, QA, planning, and administrative labor is bundled into the fixed labor rate and shall not be deducted. Contractor quotes shall not include allowances for technical representatives unless specifically directed by the Contracting Officer.

8. Allowable Direct Material Deductions:

Only authorized direct material dollars and approved subcontractor costs shall be deducted from the CLIN 0002 material dollar allocation. In accordance with Note A, the Contractor shall not add handling fees, overhead, G&A, or profit to the settled acquisition cost of materials deducted from the allocation.

9. Final Settlement and 100% De-obligation of Unexpended Funds:

Following redelivery of the vessel and receipt of the Contractor's final availability report, the Contracting Officer will issue a final contract modification settling all Over and Above labor hours and material dollars. Once settled, neither party shall be entitled to an adjustment because actual expended hours or costs differed from the settled amount (except for fraud, gross mistakes, or latent defects). Any unexpended, unobligated balance of labor hours and material funds remaining on CLIN 0002 shall be unilaterally de-obligated by the Government at 100% value.

A Contractor's CCOs price proposal shall remain valid for a minimum of 14 calendar days, unless otherwise specified on an individual CCO. If the Contractor intends to request settlement of a CCOs price prior to 14 calendar days, the Contractor shall notify the KO, in writing, prior to submitting the CCOs price proposal stating the reason the CCOs price proposal must be settled in less than 14 calendar days and propose a revised timeline. The request will be accepted or rejected at the discretion of the KO. The Contractor shall list as part of the CCOs price proposal any specific terms and conditions related to completion of the change order to include impact to milestones, sequencing of adjacent WIs, and revised completion date(s) for impacted work item(s). Any proposed change to a schedule milestone shall include a proposed revised date. If such items are not included as part of the CCOs price proposal (where applicable), the CCOs price proposal will not be considered timely received.

The pricing of the CCOs proposal shall include at a minimum:

a. Labor hours to be performed by the Contractor $_________________________________

b. Subcontractor Quote (If applicable) $_________________________________

c. Material Quote (If applicable) $_________________________________

Proposed labor hours to be performed by the Contractor shall be provided broken down by paragraph and/or task, trade and Note 1 - Labor Hours:

In the event the KO is unable to make a fair and reasonable determination based on the original CCO pricing submission, the Contractor shall comply with RFO 15.402(a)(2) which requires the Contractor to provide data the KO needs in order to determine a fair and reasonable price.

The above documentation must accompany the CCO proposal to be considered submitted to the KO. The number of days Note 5 - Late Submissions:

a Contractor's CCO's price proposal remains valid does not begin until the CCOs price proposal is considered received by the KO.

If circumstances arise where the Contractor is unable to submit a CCO's proposal within three (3) business days, the Contractor shall notify the KO in writing of the specific circumstances and provide a revised date in which a CCOs price proposal will be submitted. Additional time needed to complete a CCO's price proposal may be granted solely at the discretion of the KO. The new timeframe granted solely at the discretion of the KO and which may differ from the Contractor's request, shall be met by the Contractor. Notification of a late CCO's price proposal does not exempt the Contractor from meeting its requirement but will be considered by the Government when conducting a CPARS evaluation and utilized for past performance ratings on future contracts. Late submission of CCO's may result in deductions assessed. Furthermore, all CCO's will be adjudicated within three (3) business days of receipt of the CCO's by the Government. If bilateral agreement cannot be met a unilateral settlement will occur at the price of the Independent Government Estimate (IGE). The Government may continue to negotiate in hopes of reaching a bilateral agreement with the Contractor. If a bilateral agreement is not met the Contractor can submit documentation IAW RFO 52.233-1 (Alternate I), "Disputes.".

If clarification is needed in response to a CCO, the Contractor must submit a Request for Clarification (RFC) Note 6 - Requests for Clarification:

within two (2) business days of receipt of the Government's CCOs. Once a RFC is submitted, the Contractor, KO and Principal Port Engineer (PPE) will meet the following business day to clarify the scope of work. If, as a result of the meeting, a CCOs revision is required, the Contractor's CCOs price submission will run from the date of receipt of the revised CCO. If an RFC is received after the two (2) business day deadline, it is at the KO's discretion whether to accept the submission.

(k) DESCOPING OF REQUIREMENTS: The Government reserves the right to change or terminate this contract. CCO changes to descope work specifications are incorporated into the contract via descope CCOs and may consist of partial deletion of paragraph(s) from a work

. The Government will rely on the labor rates and prices entered in Attachment J-3, for specification or deletion of a work item in its entirety negotiating and settling descope CCOs.

Pricing of Deletion CCOs: The Contractor agrees to descope changes CCOs at the same labor rate awarded in Attachment J-3, as follows:
